It Switzerland you can sue for actual damages and reasonable attorney
fees, much like in worker's compensation.  Even though they are a very
expensive country ($25 defacto minimum wage) they have about the
finest health care in the world at 40% less than the U.S. and everyone
has an insurance policy.
Tort reform is very much needed.  In my business, private
investigations, I was required to have $1 million liability insurance
policy.  The cost, even though we were not armed like security guards
and did not have contact with the public, was nearly $1,000 per
month.per employee.  Before all the suits it cost me $700 per year for
the entire company.  I knew a lot of doctors who complained about the
same thing, as did the insurance companies.  Liability medical
insurance has skyrocketed.  When it happened in CA, governor Jerry
Brown (D) passed tort reform to limit damages to $250,000.  In Florida
an OB/GYN can spend $200,000 per year for malpractice insurance.  If
they deliver 50 babies that cost is passed on at $4,000 per newborn.
Not an insignificant cost, wouldn't you say?
