What the insurance company pays out in claims has only a little to do
with the preminums they charge their doctors/clients. Please refer to
the link I posted earlier. A lot has to do with them seeking  to
recoup diminishing returns on their investments.  The famous/infamous
McDonalds coffee spill would fall under the catagory of general
libality insurance and not medical malpractice insurance. Punative
damages means just that, it's punative so as to make sure the company
dosen't do anything that stupid again.
The one and only way one can punish a corporation is to cost them
money, it is their blood
