An illegal immigrant is walking around. Some cop asks him for his ID, he
does not have it, the cop asks why, he says that as a citizen he does
not have to, the cop walks away.

Now if this is not the case then the cop has some way of previously
knowing you are a foreigner. This can be due to your skin colour or to
some ESP cops have.
Through skin colour it's discrimination, every citizen of hispanic
origin will *have* to carry ID or be constantly *detained*.
Through ESP then the cop does not need the law, he just calls the
immigration people and they carry the foreigner away.

So which is it?
