[AMRadio] New Vanity Callsign
Pete- This is Bob Scupp, formerly WB5YYX of Albuquerque, New Mexico and now Mountainair, New Mexico. I am one of your customers and a subscriber to this AM Radio mailing list. Just wanted to say hello and that I always enjoy your informative, well thought out comments here. On June 7 the FCC issued to me a new vanity callsign K5SEP, Kilowatt Five Sporadic E Propagation. I am celebrating 37 years of VHF and above operation. This September I will have been licensed 38 years and counting. I thought why not recycle and reuse some of the 1950's 1 X 3 call signs? [AMRadio] Liquidation Sale
More goodies and priced to sell if you want to travel to Johnstown, PA HQ-180A (no clock) most knobs have been replaced (I have no idea where the original knobs went to) and some front panel lettering needs redone. The receiver works well and is very clean. I would say that it is in above average condition. I find it all very entertaining. Indeed, the requirements of his class of license do not keep the riffraff out. After what he does with a part of the spectrum that I would like to use but for one requirement, I hope they throw the book at him. One FCC term I see is apparent liability If it is merely apparent and the FCC does not accuse him of actual liability, why would he be motivated to pay a dime? And does the FCC have the authority and the power to actually take money from him? Just curious as to how these things play out. PJ

Pat, innocent until proven guilty. Nothing happens until he appears before a ALJ who rules on the guilty part. Once found guilty, he can appeal to federal courts. If guilty, his case is referred for collection, to whom I forget (maybe the U.S. Marshals), but he will be hounded until he pays. If any person fails to pay an assessment of a forfeiture penalty determined under subparagraph (A) of this paragraph, after it has become a final and unappealable order or after the appropriate court has entered final judgment in favor of the Commission, the Commission shall refer the matter to the Attorney General of the United States, who shall recover the amount assessed in any appropriate district court of the United States. In such action, the validity and appropriateness of the final order imposing the forfeiture penalty shall not be subject to review.
