Today the International Court of Justice (ICJ), principal judicial organ of the United Nations, delivered its Judgment in the LaGrand Case (Germany v. United States of America). In its Judgment, which is final, without appeal and binding for the Parties, the Court, with regard to the merits of the dispute, · finds by fourteen votes to one that, by not informing Karl and Walter LaGrand without delay following their arrest of their rights under Article 36, paragraph 1 (b), of the Vienna Convention on Consular Relations, and by thereby depriving Germany of the possibility, in a timely fashion, to render the assistance provided for by the Convention to the individuals concerned, the United States breached its obligations to Germany and to the LaGrand brothers under Article 36, paragraph 1, of the Convention; · finds by fourteen votes to one that, by not permitting the review and reconsideration, in the light of the rights set forth in the Convention, of the convictions and sentences of the LaGrand brothers after the violations referred to in paragraph (3) above had been established, the United States breached its obligation to Germany and to the LaGrand brothers under Article 36, paragraph 2, of the Convention; · finds by thirteen votes to two that, by failing to take all measures at its disposal to ensure that Walter LaGrand was not executed pending the final decision of the International Court of Justice in the case, the United States breached the obligation incumbent upon it under the Order indicating provisional measures issued by the Court on 3 March 1999; · takes note unanimously of the commitment undertaken by the United States to ensure implementation of the specific measures adopted in performance of its obligations under Article 36, paragraph 1 (b), of the Convention; and finds that this commitment must be regarded as meeting Germany's request for a general assurance of non-repetition; · finds by fourteen votes to one that should nationals of Germany nonetheless be sentenced to severe penalties, without their rights under Article 36, paragraph 1 (b), of the Convention having been respected, the United States, by means of its own choosing, shall allow the review and reconsideration of the conviction and sentence by taking account of the violation of the rights set forth in that Convention. Reasoning of the Court In its Judgment, the Court begins by outlining the history of the dispute. It recalls that the brothers Karl and Walter LaGrand ¾ German nationals who had been permanently residing in the United States since childhood ¾ were arrested in 1982 in Arizona for their involvement in an attempted bank robbery, in the course of which the bank manager was murdered and another bank employee seriously injured. In 1984, an Arizona court convicted both of murder in the first degree and other crimes, and sentenced them to death. The LaGrands being German nationals, the Vienna Convention on Consular Relations required the competent authorities of the United States to inform them without delay of their right to communicate with the consulate of Germany. The United States acknowledged that this did not occur. In fact, the consulate was only made aware of the case in 1992 by the LaGrands themselves, who had learnt of their rights from other sources. By that stage, the LaGrands were precluded because of the doctrine of "procedural default" in United States law from challenging their convictions and sentences by claiming that their rights under the Vienna Convention had been violated. Karl LaGrand was executed on 24 February 1999. On 2 March 1999, the day before the scheduled date of execution of Walter LaGrand, Germany brought the case to the International Court of Justice. On 3 March 1999, the Court made an Order indicating provisional measures (a kind of interim injunction), stating inter alia that the United States should take all measures at its disposal to ensure that Walter LaGrand was not exe

There was now a functioning 4,000-strong Kosovo police force which cooperated closely with the UN administration UNMIK and NATO-led peace force KFOR. In Kosovo above all, preparations were now going on for elections in the autumn. After the elections, those in office would concentrate on economic development. However, they are also conducting a terror campaign against ordinary ethnic Albanians and it is considered that serious violence will flare up by the forthcoming election. They seem to think that scape-goating asylum-seekers will win them the next general election.Yet when this racist system tried to deport Amanj to face persecution in Iraqi, ordinary people united in solidarity in their disgust at this appalling abuse of human rights. Protests at Heathrow and Gatwick airports to stop the forced deportation raised people's awareness of the plight of refugees in this country and as a result, the campaign grew quickly.After being rejected by 6 European countries and fleeing for 5 years because Iraq is considered a "safe haven", Amanj has developed Paranoid Schizophrenia and is now sectioned in a Nuremburg Psychaitric Clinic awaiting removal to Baghdad this summer. Within 48 hours of hearing about the threat to Amanj's life, the AEEU shop stewards committee at the gigantic Rolls Royce aircracft engine factory in Bristol adopted him and started to lobby the UK Home Office. Almost immediately, 5 trade unions and 4 MPs joined the lobby forcing the government to review the case in the High Court.Within a week of his appeal being turned down at the High Court, BA pilots and air traffic control workers in the IPMS union were refusing to cooperate with the deportation, activists were boarding planes, passengers were refusing to sit down and multinational airlines like Lufthansa were pulling out.One year on, the struggle continues to grow. Tony Benn has sent a letter out to the unions calling for support. It is too early to say which of the aspirants will meet the political and military criteria for membership by then. I hope that the noble Lord will accept that assurance from me. Baroness Williams of Crosby: My Lords, can the Minister confirm that the Government will give special attention to the need to recognise the human rights of minorities in some of the candidate countries, with particular regard perhaps to two of the Baltic countries, given the presence of tense international relations with Russia? Baroness Symons of Vernham Dean: My Lords, of course the human rights of the countries concerned are very important. I believe that those are covered by the parts of the Membership Action Plans that deal with politics and legislation. 16 Jul 2001 : Column 1267 I did not pick up the latter part of the question posed by the noble Lord, Lord Wallace, about consultation on these issues. As the House may know, there will be meetings towards the end of this year. The NATO Foreign and Defence Ministers are due to meet towards the end of this year and next May before we reach the conclusion of the process in Prague in November of next year. There will be an opportunity, which I am sure that your Lordships will readily take, for consultation on the widest possible basis. A number of your Lordships have already expressed views on those countries which some of you believe are readier than others for membership. But the criteria for membership will be assessed on the same basis for everyone at the time. Lord Howell of Guildford: My Lords, will the Minister agree that the role of the three Baltic countries deserves special sympathy in this process? Does the Minister accept that those three brave little countries always used to regard Britain as their champion and look to Britain today to see them right? Further, can the Minister reassure us that in considering their applications and their role neither this Government nor the NATO governments will be overawed by Russian grumbling in seeing that the proper security of Europe and these three states is secure? Baroness Symons of Vernham Dean: My Lords, I agree that the three Baltic countries have a very special place in these considerations. They will of course be judged in the same way as any other aspirant country; that is, in relation to NATO's readiness to absorb the new member in question; as to that country's readiness to sustain the burdens of the relationship with NATO; and the overall effect on European security. There is no way to circumvent those three criteria. Scotland Yard noted a 300% increase in racist attacks following William Hague's notorious Britain as a "foreign land" speech. The leader of the far-right British National Party, Nick Griffin, has announced his intention to stand in Oldham, with the aim of inflaming racist tension. He says that scapegoating "legitimises the idea that we cannot afford to have asylum seekers here in the first place". Britain a vibrant multiracial country which has benefited greatly from immigrants' contribution. Meanwhile, the right to work has been denied to refugees under New Labour. Some 1,500 asylum seekers are detained in prisons and holding centres. The home secretary boasts of his intention to deport 30,000 asylum applicants this year. The voucher system has stigmatised those fleeing persecution and oppression, while the dispersal programme has created isolation and alienation for asylum seekers. We object to New Labour's draconian racist policies on asylum seekers and believe that Jack Straw's policies are directly fuelling racism. Instead of scrapping the voucher system, the dispersal programme and detention centres, Jack Straw wants to abolish the 1951 Geneva Convention. I have no objection to making money out of my trees as long as they are replaced and the wildlife is protected and the forest sustained. This company sounds extremely suspicious to me. The consequence of a devastating storm named Israel causing massive destruction and death - with the accompanying headlines - has enraged Jewish leaders, who called it "bizarre," "stupid," and "insensitive." In addition to Israel, the name "Adolph" is on the same alphabetized list of Eastern North Pacific Names for 2001, further fueling the indignation of Jewish groups. Max Mayfield, director of the National Hurricane Center in Miami and chairman of the UN's hurricane naming committee, told The Jerusalem Post that no one on the committee thought about the implications of the name Israel. "We have four billion people on the planet, and you are the only person I've ever had express a concern about the name Israel," which he called a "good Spanish name." Adolph, added Mayfield, is "not the German spelling, and there are a lot of good people with the name Adolph, too." Abraham Foxman, national director of the Anti-Defamation League, expressed outrage over the use of either name. "How about Jesus?" Foxman asked. "That's another good Spanish name. They wouldn't name a hurricane Jesus, would they? If there were a headline that said 'Jesus hits Philippines,' a lot of people would be upset. "It is totally insensitive. One would have hoped that people who have the responsibility of picking names would have a greater sensitivity about what names reflect. Adolph, in the lifetime of people still alive, to name anything after [that] by an international body is offensive and hideous." There are 10 regional storm areas with lists of tropical storm names. Other first names that are also countries, for example "Jordan" and "Chad," do not appear on any list. "I understand that there may have been a lack of understanding in terms of Israel, but there, too, one should look at every name that they pick from 14 views, and test them out in 14 ways," Foxman said. Names for hurricanes are provided by a 25-man international naming committee under Regional Association IV of the World Meteorological Organization, a Geneva-based UN agency. The committee, which meets once a year, approved of the list at the last meeting in April. "There is a certain terrible irony to naming a hurricane Israel, given that the Nazis forced Jewish males who did not have what they considered to be a distinctly Jewish name to add the name Israel as a middle name," said Efraim Zuroff, Israel director of the Simon Wiesenthal Center. "It was done in order to make sure that they were clearly identified as Jews, and therefore subject to the racial laws and other discriminatory measures. "With all our current security problems and the concurrent struggle over Israel's image in world opinion, a killer hurricane named Israel is the last thing we need," said Zuroff. "I shudder to think how terrible it would be in Muslim countries in the Far East if they found themselves suffering from a storm by that name. All we can hope is that if a hurricane is named Israel, it will be the least destructive one in recent history." Mort Klein, national president of the Zionist Organization of America, mused whether the use of both names wasn't intentional hatred against Jews. "It's funny that in an era when almost no one names their children Adolph, for them to name a hurricane Adolph forces one to question their motive," Klein said. "It seems likely that this group has employed this name, which brings up ugly memories, simply to show hostility toward the Jewish people. With the UN's record of anti-Israel policy, it does not seem far-fetched that they have now come up with a new method to bash Israel." The WMO states on its Web site that not all names are used: "The use of people's names for this purpose is, however, not done everywhere. The practice of naming storms, which usually bring destruction, after persons appears to run counter to Oriental sensibilities. Thus, Asians, like the Japanese and Chinese, prefer to name their storms after other living things and also after inanimate objects like flowers, rivers, etc." Both Mayfield and Arthur Dania, president of Regional Association IV, said there was no possibility this year of removing the names from the list.
