Now, in RRB centralized ads, they are asking the details of scribe to be sent 
with the application form itself.
They propose to issue separate identity cards for scribes of VI.
Mind you, exam dates are not fixed yet, and a VI has to find and convince 
somebody to be the scribe at an indefinite date in future.

  The Persons with Disabilities (Equal Opportunities, Protection
of Rights and Full Participation) Act, 1995 casts responsibility on the
appropriate governments and local authorities to make necessary facilities
available for persons with disabilities in matter of education and
employment, including providing of scribe, aids and appliances, appropriate
environment and seating arrangements for visually impaired and other
physically disabled persons. However, in the absence of clear guidelines or
policy in the matter, different authorities adopt different approach in
providing such facilities, which is leading to a lot of confusion and
inconvenience to persons with disabilities.



A meeting to discuss   the existing difficulties and to workout
recommendations for arriving at the policy on conduct of written examination
for persons with disabilities was held on 19th February, 2008 under the
chairmanship of Dr. Manoj Kumar, Chief Commissioner for Persons with
disabilities, Govt. off India. List of Government
officials/Organisations/individuals who participated in the meeting is
enclosed at Annexure-I.  The background material, which was circulated to
the participants, is enclosed at Annexure-II.



  After the discussion and deliberations on the various issues
the recommendations of the members emerge as follows:



I.  There should be a uniform and comprehensive policy
across the country for persons with disabilities for written examination
taking into account improving technology and new avenues opened to the
persons with disabilities providing a level playing field.  Policy should
also have flexibility to accommodate the specific needs on case-to-case
basis.



II.There is no need for fixing separate criteria for regular
and competitive examinations.



III.  The facility of Scribe/Reader/Lab Assistant should be
allowed to any person having disability of 40% and above, certified by the
competent medical board irrespective of the nature of disability, if so
desired by the person



IV. The candidates should have the discretion of opting for hisown s
cribe/reader/lab assistant or request the Examination Body for the same. In
second instance the examining body should identify the scribe/reader/lab
assistant to make panels at the District/Division/State level as per the
requirements of the examination.  In such instances the candidates should be
allowed to meet the scribe a day before the examination so that the
candidates get a chance to check and verify whether the scribe is suitable
or not.



V.   Criteria like educational qualification, marks scored, age
or other such restrictions for the scribe/reader/lab assistant   should not
be fixed.   Instead, the invigilation system should be strengthened, so that
the candidates using scribe/reader/lab assistant don't indulge in
mal-practices like copying and cheating during the examination.

Well Amilesh
Isn't it arbitrary and improper interpretation?
If  eligibility is graduation, then one grade junior naturally means second 
year of graduation.
If eligibility is graduation appeared, then one grade junior means first year 
pass.
Question of +2  not pass does not arise in any case, except when eligibility is 
+2 appeared.

The percentage sealing of the scribe is still far from settled.
Kanchan has perhaps got some ruling in a particular case, so she may please 
share it with us.
Anyway, rulings in particular cases are hardly applied across various similarly 
situated bodies and situations.
This is one more bane of judicial recourse.

On another relevant note, In RBI banking ombudsman annual report, they are 
converting ombudsman rulings into class actions and directives to be followed 
for all similar cases, there too, no disability rulings about banking are to be 
noted.

It is high time we have uniform guidelines about scribe by either a court of 
law, or government.

as interpreted by me should be if the minimum eligibility is
graduation then one grade less means the scribe should have not

for 50% exemption. Today, I noted that the percentage of exemption is not 
the same in all cases. I could not find out what percentage of donation is 
eligible for exemption under section 80g. There is no mention of the 
percentage in the certificate we received from the department of income 
tax. The office is at an inaccessible place. Can yousuggest if I can check 
it online? I have already checked the ministry's web site and they do not 
mention anything what I already knew, i.e., 100% and 50% cases.

a small utility free pdf to word converter may solve the problem. or you 
have to install the accessible version of adobe reader. if higher version is

A company at Cochin is ready to employ few of my students. They are using 
a software called "Hotsoft". JAWS is working with out much difficulty in 
that. But their final report is in PDF format. Using Adobe reader 9 I 
could read it completely. the problem is that the report contains data 
arranged in a tabular format. Even though it is arranged in a tabular 
format there is no table actually. While trying to use a table command it 
says "not in a table". JAWS is not reading the data properly in the order 
in which it is arranged in the document. I tried to read using PC cursor, 
JAWS cursor and invisible cursor. Some times it reads the data arranged in 
the columns in the reverse order. That is while using down arrow we can 
hear the column heading of the last column and by pressing down arrow 
again it reads the second last column heading. To a visually challenged 
person it is really difficult to findout the needed information from that 
document. Is there any solution to the problem. If you can help me in 
solving the problem that will help at least 2 VI people to become employed 
and financially independent. I have a copy of that PDF file but as it is 
not possible to sent attachment I am helpless to send. Those who want to 
see the real problem that I am facing please be kind enough to ask me I 
will surely send you that file.

10. all branches of the banks must keep a copy of said circular with them. 
however, here i am pasting the particular section. you can also refer the 
judgement of CCPD.


9.5 Need for Bank Branches / ATMs to be made
accessible to persons with disabilities
Banks are advised to take necessary steps to provide all existing ATMs / 
future ATMs with ramps so that wheel chair users / persons with disabilities 
can easily access them and also make arrangements in such a way that the 
height of the ATM does not create an impediment in its use by a wheelchair 
user. Banks may also take appropriate steps including providing ramps at the 
entrance of the bank branches so that the persons with disabilities / wheel 
chair users can enter the bank branches and conduct business without much 
difficulty.

10. Providing banking facilities to Visually Impaired Persons
In order to facilitate access to banking facilities by visually challenged 
persons, banks are advised to offer banking facilities including cheque book


facility / operation of ATM / locker etc. to the visually challenged as they 
are legally competent to contract.
In the Case No. 2791/2003, the Honourable Court of Chief Commissioner for 
Persons with Disabilities had passed Orders dated 05.09.2005 which was 
forwarded by IBA to all the member banks vide their circular letter dated 
October 20, 2005. In the above Order, the Honorable Court has instructed 
that banks should offer all the banking facilities including cheque book 
facility, ATM facility and locker facility to the visually challenged and 
also assist them in withdrawal of cash.
Further, in Para 14 of the above Order, the Honorable Court has observed 
that visually impaired persons cannot be denied the facility of cheque book, 
locker and ATM on the possibility of risk in operating / using the said 
facility, as the element of risk is involved in case of other customers as 
well.
Banks should therefore ensure that all the banking facilities such as cheque 
book facility including third party cheques, ATM facility, Net banking 
facility, locker facility, retail loans, credit cards etc. are invariably 
offered to the visually challenged without any discrimination.
Banks may also advise their branches to render all possible assistance to 
the visually challenged for availing the various banking facilities.

10.1 Guidelines framed by IBA based on the judgement of
Chief Commissioner for Persons with Disabilities
Indian Banks' Association has framed operational guidelines for 
implementation of its member banks on providing banking facilities to 
persons with disabilities. Banks should adopt / follow the operational 
guidelines meticulously.

10.2 Talking ATMs with Braille keypads to facilitate
use by persons with visual impairment
Banks should make at least one third of new ATMs installed as talking ATMs 
with Braille keypads and place them strategically in consultation with other 
banks to ensure that at least one talking ATM with Braille


keypad is generally available in each locality for catering to needs of 
visually impaired persons. Banks may also bring the locations of such 
talking ATMs to the notice of their visually impaired customers.

Hello,

I knew that donations made to certain specified funds under section 80g of the 
income tax act are eligible for 100% exemption from tax. Donations made to 
other bodies such as our Blind Persons' Association are eligible for 50% 
exemption. Today, I noted that the percentage of exemption is not the same in 
all cases. I could not find out what percentage of donation is eligible for 
exemption under section 80g. There is no mention of the percentage in the 
certificate we received from the department of income tax. The office is at an 
inaccessible place. Can yousuggest if I can check it online? I have already 
checked the ministry's web site and they do not mention anything what I already 
knew, i.e., 100% and 50% cases.

This is a good idea. However, I think that we should not remain
confined to the issue of accessible currency, although it is very
important. We also need to ask the Governor whether after the passing
of circular about the banking facilities for visually challenged
customers, he has so far planned and implimented any large scale drive
for sensitization of bank employees regarding the rights of persons
with vvisual impairment? Without this measures, many dblind persons
are still facing discrimination of various kinds by the banks. I have
recently got a reply from RBI in a case that I have filed in the
disability commission that it has so far not issued any cercular for
Non-banking Financial Corporations (NBFCs) to ensure equal treatment
for persons with visual impairment. Why is it that the RBI has been
showing this careless attidued ? These and similar other questions may
be asked.
