Re: [AI] Pls Advise - Case of Shalini Sethi from Delhi
Really very sad indeed. A complaint to National Womens Commission could be helpful. Niranjan On 6/25/10, Subramani L lsubram...@deccanherald.co.in wrote: This is certainly a case of serious and extreme harassment. It is disappointing to know that CCPD, who is supposed to protect our rights and due enforcement of the disability law, has abandoned the cause so shamelessly and decided to side with the bank. Sometimes, you can't help but accede to the cynicism of those in this list who sometimes we -the over-optimists- often disagree with. Let us consider a few things we can do: I am no legal specialist... All that I can think of is to take this up as a citizen journalist exercise by one of us, record the statements of all those involved (if possible on camera) and pass the tape to a news channel. The best way is to name and shame those who show their courage to persons with disability. Let them face the public... Another thing I can think of is an open public campaign through press conference (making the person involved nd her father speak to the press) and explain the whole thing. Third thing is to take this to IBA and see if some remedy can be sought. The person in question here has been subjected to emotional stress for efficiently discharging her duty. The officials who should have supported her in situations like this and who failed utterly in their duties have to be brought to some sort of an open court and questioned in full public glair. Let us see if they can still taunt persons with disability again. This is not merely the experience of one person, but a forewarning that something similar may happen to any person with disability in future. This has to be severely dealt with. I joined the IDBI Bank at its Chandni Chowk branch on 26.11.2007(later shifted to its Rajouri Garden Branch) as Executive , based on my selection in the all India Test conducted by the said Bank, under the quota for persons with disabilities, as per the PwD Act, 1995. This post was initially on contract, to be renewed year-to-year, to be absorbed in the services of the Bank as Assistant Manager, an A category post, on availability of vacancies, performance and a further selection process. 2. I was performing well, doing multi-task duties, as a Teller, handling cash, preparation of demand drafts, handling Demat accounts, tax collection matters. I also worked on cheque clearing seat. During this period I also participated in two training seminars, conducted by the Bank. Trouble started for me when Shri Rajesh Kumar joined this Branch as Head in July, 2008. He was harassing me for no reasons, teasing me on my disabilities, calling me mad, threatening the non-renewal of my contract etc. Things came to peak on 21.11.2008, when I could not bear the daily bickering and indignities any longer, I talked on my mobile to Shri K.P.Nair, Head HRD, who sits at Bombay Headquarters of the Bank, because he had earlier helped me in my posting problem, expecting that he will again sort out my problem. But instead of getting any relief I got a fax from his office at 5.00pm on 25.11.2008, when I was leaving the Bank, after my days work, informing me that my contract is not renewed and that I should apply to the Bank for encashment of my leave etc. I talked to him in the evening the same day on returning home but he informed me that the contract has not been renewed because of performance. When I talked to him about my complaint, he told me that he was looking into the matter. It took the Bank nearly 6 months and several e-mails to honor encashment. 3. Not getting any response, my father wrote to him on 1.1.2009 seeking proper justice, considering that I got this job quite late in my life and now at the age of 38 yrs. I had no further job opportunities; pleading that the state policy is to properly rehabilitate persons like me so that they could live their lives with dignity and self respect to become a part of the mainstream of the Society, but this letter failed to get any response. 4. Realizing that waiting further for justice from the Bank was futility, my father formally lodged the first

Re: [AI] Pls Advise - Case of Shalini Sethi from Delhi
Hello subramani sir and all, I've personally talked to the aggrieved person and it is quite clear that whatever MR. TD. Dharial has done is not expected and reasonable at all in any circumstance. Now, how many of us are ready to mail our concerns to the CCPD directly about its attitude? I've personally experienced the carelessness and irresponsible attitude of Dy commissioner for persons with disabilities. Most of the employees in the office of CCPD are not good at all, and they behave very badly. They don’t like to call the guilty party for hearing, they don’t like to decide the matter within the time frame stipulated under the pwd act, and they also don’t like to adhere the provisions of pwd act. Many matters are being dragged for years, and no hearing at all!!! Just reminders after reminders to the culprit, promoting the wrongdoers against persons with disabilities in a well organized manner. I personally request to the persons who are working in media sector to make this information to public. Now start a mail campaign against the Dy. CCPD to tell that we’re well aware whatever they’re doing. I’ve experienced it all, and that’s why I’m talking from my experience. Please keep writing on this, and express your views. Its not the matter of shalini sethi only, but of whole community. Expecting a massive response from you all, Akhilesh. Re: [AI] Pls Advise - Case of Shalini Sethi from Delhi
Let us talk to some television channel and arrange for a sting operation. If Shalini is ready we shall ask her to talk to the CCPD and record the whole thing and let the whole world see the way they function. Exposing them, shaming them and making them answer for all this misdeeds is the only way we can get to change the way they function. They think sitting in their chairs is a god given right and the big favour they do for us; let us prove to them that they are sitting there to protect our interests and not the interests of the offending officialdom. Whether you are in the media or elsewhere the rule is very simple; do not offend, do not err in judgement, if you do then be ready to face the consequence. I would be happy if folks in Delhi are ready to take this up. I would also like to see the IDBI manager responsible for this mess be punished as well for his pathetic and appalling ttitude towards a person with disability. Harassment of any kind is wrong and those who indulge in harassment need to be told in no uncertain trms tht they cannot do this. Wht is the guarantee tht he won't do the same to someone else? Tht is my even bigger concern. [AI] Quarries about writer in Bank exams
Hello friends, Would anyone respond my quarries pertaining to the provision of writer for v.i. Examinees in bank exams which include following 1.If the writer is provided by bank? Or the examinee has to arrange his/ her own. 2. What are the eligibility conditions for writer? 3. If these rules equally apply in all bank exams or vary from bank to bank? 4.If the rules may vary from state to state even in same bank? 5.Some one has told me that one of the conditions is that the marks of the writer in last passed exam should be less than 60 p.c. Is this true? 6. Does this condition not cause inconvenience to get a suitable writer? Thanks in advance. With due regard, Gautam agarwal. Re: [AI] facebook users please response to me
It used mostly for personally communicating with friends who you can add as contcts after crating an account for yourself. You can share with them pictures and videos and can even chat with them. If you do not like someone, you can de-friend' them from the list which is another way of saying that you can remove their contact from your list. You can set personal prferances with whom you would like your collections to be shared and who to exclude from that. These upgrades (on personal settings) were made in May. George sir, This is not the matter of Shalini only, but also matter of the careless attitude of CCPD. As I've earlier pointed out, that they're not deciding the matter within 90 days, and MR. TD. Dharial has a habit of prolonging the cases by sending out reminder after reminder to the respondent. There is urgent need that we should come together and demand we need a retired judge of at least of high court to be CCPD. The persons with disabilities have no representation in CCPD office, except few clerk and that's it. Imagine we have no chief commissioner, and the government officer is discharging the duties of in-charge CCPD. Believe me sir, present Dy commissioner MR. Dharial doesn’t deserve to be in his office any more. I’ve got the opportunity to experience his attitude, not in my case, but some other cases and its really pathetic… leave it sir, I’ve no words to explain that moment. I wonder what the group has to say. If a blind person is removed from his or her job on account of non delivery on the job or on the basis of bad behaviour, would it be a violation of rights. Exposing them, shaming them and making them answer for all this misdeeds is the only way we can get to change the way they function. Re: [AI] Pls Advise - Case of Shalini Sethi from Delhi
Anyone who deserves to lose the job has to lose it. Disability doesn't count. If there are better technologies/aids/appliances that can help them perform well, that needs to be provided, but that can only ensure that they don't stand at a disadvantage while working with able bodied peers. However, performance is a different matter. In fact, the whole purpose and idea of equality will be defeated if we don't take that extra effort to justify our presence at the work place, particularly in corporate situations where performance appraisals are an integral part of employee assessments. If performance is shown as a reason or even if the company cannot afford to keep or pay them (due to unforeseen losses or economic circumstances) probably we may consider it to be a fair treatment. But if disability becomes the basis of any decision taken to remove a person, that too a well-performing one, I feel we have a right to fight it. This is of course my personal feeling. We can ask for jobs, ask for equal consideration and technologies that make us perform well, but we can't afford to think that we would have it because we happened to be more severely (economically nd financially) challenged than others. At work place, we must fight for our success and not for survival. Re: [AI] Quarries about writer in Bank exams
hello sir, rules for a writer in bank exams are as follows. the scribe is to be arranged by the candidate itself. bank does not provide any such facility. the qualification of writer must be one grade less than the required qualification for the post. for example, required qualification for the post of clerk is 10 + 2, than writer should be of 10 + 1 or less. but not equevilant to 10 + 2. percentage of scribe in last passed exam in any case should not be more than 60%. probabely, all banks have same eligibility criteria for scribe. it does not vary from bank to bank. every state has same rules regarding writer. while filling form you have to specify in the form whether you need a scribe or not. hope everything is clear. gautam wrote: Hello friends, Would anyone respond my quarries pertaining to the provision of writer for v.i. Re: [AI] Pls Advise - Case of Shalini Sethi from Delhi
Dear Friends, To come back to the main discussion, I do agree there are shortcomings in the working of the office of CCPD and I find precisely four reasons for it: (a) No full time independent Commissioner (b) Lack of staff vis-a-vis number of complaints received per day (c) No power to direct, its more of advisory nature, so often respondents don't take CCPD seriously and do not reply or appear. (d) staff transferred from other ministries/departments on deputation with no knowledge of the disability, laws and its practice and how does a court work. Mr. Dhariyal is now an experience hand at the office of CCPD we have our own interest in retaining him. In fact when we had full time CCPD and two Dy Commissioners, (Ms. Sunita Singh, if you remember who looked after the court work) the work started to roll but Ms. Sunita Singh was recalled soon. Its less of his fault than of the system that he works in. I am not defending the officer, but the sheer number of staff and multiple responsibilities that have been handed over to the counted staff is mind boggling and the Ministry is least bothered about it for no one is agitating. None of us would be able to justice with that pendency number with higher expectations of the sector from them. Then gradually when they can't handle the sheer number they start prioritizing and take action on cases which are urgent in nature, or on which there is likelihood of ministry or media or court taking a note of. This further rottens the system and most cases start dragging for years with no justice seems coming. Also lot of work that the state commissioners should be doing is falling on the office of CCPD being the central office and half the time the CCPD does only post office work - forwarding representations from states to state commissioners - ofcourse with handly much action happening on them. I think the way out is to expand the CCPD office and provide trained staff to the office. At least four Dy. Commissioners and one full time CCPD with trained staff and fully computerised system of tracking matters. I would agree with the idea of having a judge or an advocate experienced in disability law human rights holds this office instead of Babus and NGO heads. The Ministry of Social Justice has to seriously take a note of it and disability sector should lead a strong agitation. On George's point of removal of employee with disability on ground of non-performance, we have got an infamous order from none other than Hon'ble Supreme Court in the case Union of India Vs. Devendra Kumar Pant, on which I wrote my reflections on my blog: http://disabilityrightsthroughcourts.blogspot.com/2009/07/reflections-on-supreme-court-judgement.html However, before deciding the legality of removing a person with disability from job on account of non-performance, I would say, it is necessary to look at whether the employee was given reasonable accommodation, assistive aids and devices required to perform that job and sufficient training. Also whether the bad behaviour has been construed because the employee demanded such accommodation and support and was not given. Mere declaring a person useless and charge him with bad behaviour is the easiest thing to do which is often done by insensitive employers and colleagues. There is an urgent need of guidance to the employers to this effect- both in Govt. and in private and also there is an urgent need of providing support systems like technology, assistive aids, adaptation and reasonable accommodation at the cost of Government to provide equitable opportunities to those experiencing disabilities. regards Subhash Chandra Vashishth Advocate-Disability Rights 09811125521 Voice your thoughts in the blog to discuss the Rights of persons with disability bill at: http://www.accessindia.org.in/harish/blog.htm To unsubscribe send a message to accessindia-requ...@accessindia.org.in with the subject unsubscribe.
