In the circumstances the most appropriate solution. The dust had barely settled on this decision, before another controversy engulfed the disability rights legislation. There are rumours running rife that the government is planning to enact the Bill of 2014 as Ordinance in order to meet the long pending concerns of the disability sector. Two questions are on everyone's lips: can the government enact the Bill of 2014 through the Ordinance route after it had been referred to the House Committee; and two, should the government take this route? Under Article 123 of the Indian Constitution the President has power to make law through Ordinance provided: one, both Houses are not in session; and two, the President is satisfied that circumstances exist which render it necessary that immediate action should be taken. Once both these conditions are satisfied then the President may authorize the promulgation of any Ordinance which the circumstances may require. Insofar as the two Houses are not in session, the first condition is satisfied. However the second condition is not met. The Bill was sent to a House Committee and not passed by Parliament because it was accepted that it needed more work. The Bill was only introduced in the House and sent to the Committee. No other urgency to enact the Bill was either expressed or demonstrated. In such circumstances, it cannot be contended that there was any circumstance which showed that urgent enactment of the Bill was required. In fact any effort to enact the Bill as Ordinance, after it has been referred to the House Committee would, in the light of the Supreme Court's ruling in DC Wadhwa,be seen as a colourable exercise of power and a fraud on the Constitution. Both on a plain reading of the Constitution and by relying on judicial decisions, it can be stated that the President cannot enact the Bill of 2014 by promulgating an Ordinance. Ordinarily, the inquiry on this question should stop with the above answer. However since many may consider the above response a purely technical one, it is important to also ask whether the Government should enact the Bill of 2014 by using the Ordinance route? To answer this question, it is important to appreciate that disability rights is not an unoccupied field. The Persons with Disabilities (Equality of Opportunity, Full Participation and Protection of Rights) Act 1995 already controls the area. If the Bill of 2014 is promulgated as Ordinance, it cannot become operable unless the Act of 1995 is repealed. The Act of 1995 has empowered a series of individual, bodies and authorities to implement the statute; all these entities would become dysfunctional if the Act of 1995 is repealed but there would be no time to establish and render functional the new authorities because an Ordinance can remain operable for a maximum period of seven and a half months without obtaining parliamentary approval. The enactment of the Bill through the Ordinance route will obtain no benefit to the freshly included impairments but would create an enforcement vacuum even for the disabilities already included in the 1995 Act. It can thus be concluded that it is not desirable to enact the Bill of 2014 through the Ordinance route because this procedure would usher confusion and chaos and could cause all disabilities to lose legislative protection. However, the reference of the Bill of 2014 to the House Committee puts the freshly included disabilities at a special disadvantage. Since 1999, when a Committee set up to suggest amendments to the Act of 1995 highlighted the need for inclusion, the battle has been on, to recognise excluded impairments. Hello Aishwarya, From my limited knowledge: Music - They can learn from anywhere or access music from youtube etc. just like any able bodied person using screen readers on computers Dance - I learnt a bit from Shaimak Davar institutes. They are more cooperative and experienced. Readings - Bookshare.org, livrebox for audio books, for Braille and audio books NAB Delhi and NAB Vorli, Mumbai Craft - Not commercially rewarding, but people with not very high qualifications can go for NAB workshop or NAB rehabilitation at Mahalaxmi, Mumbai. There are many centers who are teaching employment skills in computer trainings and physic therapy. Sports - In Mumbai, we do have chess and cricket competitions. Audio games - Namely, Papa Sangre. Not very assuming though on iPhone. Audio movies - I think you mean to ask about audio descriptive movies. You do get them online. More relevant for Hollywood movies. Some I've heard are: Titanic, wedding crashers etc. They do it very well. Can you be pleased more specific about camps, institutions? Like for trekking Young Zingaroh and Kalpvihar take Vis along. Just a last request, please try to make newly blind feel less marginalised. I mean, all things catering to special needs of blind are fine, but they should not feel less confident to make room for themselves in mainstream facilities. Being an organ of bureaucracy itself, writing a strong letter to Prime minister directly shows the dedication and sensitivity of the head of this office headed by person with disability. Don't know about others, but I myself have never heard of CCPD before Pinchas sir's term. Senior editer Mr. Varghese George, a JNU alumna was willing to listen to our side, and the paper at least carried out a couple of reports. Visually impaired girl escapes accident at metro station Sowmiya Ashok The gap between the platform and a Delhi Metro train got the better of a visually impaired commuter on Thursday evening as she was about to board the train at the Nehru Place metro station. Sweety Bhalla, a government employee, who was entering the train found her legs collapsing into the gap - which was not exceptionally large. But for two male co-passengers, who hurriedly pulled her up, she could have suffered grievous injuries. The incident happened around 5-20 p.m. I put a leg forward thinking I will step on the train but my left leg went in completely into the gap between the platform and the train. It was so unexpected, I couldn't understand and when I was pulled up I felt bruises on my right ankle, knee and elbow, she said. Fortunately for Ms. Bhalla, her co-passengers helped her up before the train's doors shut on her. A resident of Karol Bagh, Ms. Bhalla travels from Jhandewalan to Nehru Place and back on a daily basis. The gaps at all stations should be uniform so that no untoward incident happens. This is especially dangerous for young children who can fall into the gap while boarding or de-boarding the train at rush hours, she said. The problem is that in some places the gap is smaller and at others it's larger. There should be some uniformity, she added. Ms. Bhalla said similar incidents have happened twice before at Rajiv Chowk and Udyog Bhavan stations. There is a lot of rush especially at stations such as Rajiv Chowk. The Metro should have segregated entry and exit points into trains so it helps manage the crowds in an orderly manner. Ms. Bhalla, who suffers from retinitis pigmentosa, which has rendered her blind since birth, was part of a committee that did an external audit on the first line of the Delhi Metro that connected Welcome and Kashmere Gate. I was part of a 'disability committee' that provided inputs to the Delhi Metro on how to make stations friendly for Persons with Disability. We had then reviewed three stations, she said. Following Thursday's incident, she rang the helpline number of the Delhi Metro and was told that she will be contacted after the footage from the station is reviewed. A Delhi Metro spokesperson said that at the point of frisking, Ms. Bhalla was asked by CISF staff if she needed assistance to reach the train but she declined because her colleague had accompanied her to the station. We do make regular announcements asking passengers to mind the gap between the platform and the train. The passenger had called the helpline number but it takes some time to review the footage, said the spokesperson. Music- I used to normally learn Indian Vocal Music with sighted people so singing is not a problem. For learning musical instruments online a person named Bill Brown has made audio tutorials for the visually impaired to teach guitar, flute, piano etc. Literature- These days Bookshare has become popular. However, I search the web for ebooks and always have been successful till now. Sports- Organisations such as YMCA are quite good and I learn swimming there. As Ekinath rightly mentioned, try giving all the possible information about the ways they can do this recreation stuff with the available main stream media. Don't let them feel that they have to do it with some specialized platforms. Especially with the available social platforms like FP, let them learn things by interacting with, and on, the main stream platforms. Also, let them feel that the way to go ahead in life is only, and only, by staying connected with their surrounding environment, whether it be real or virtual. New Delhi, dated the 10th October, 2013 SUBJECT: INCOME-TAX DEDUCTION FROM SALARIES DURING THE FINANCIAL YEAR 2013-14 UNDER SECTION 192 OF THE INCOME-TAX ACT, 1961. . 5.5.7.2Deductions in respect of a person with disability (section 80U): Under section 80U, in computing the total income of an individual, being a resident, who, at any time during the previous year, is certified by the medical authority to be a person with disability, there shall be allowed a deduction of a sum of fifty thousand rupees. However, where such individual is a person with severe disability, a higher deduction of one lakh rupees shall be allowable. DDOs should note that 80DD deduction is in case of the dependent of the employee whereas 80U deduction is in case of the employee himself. However under both the Sections the employee shall furnish to the DDO following: 1. A copy of the certificate issued by the medical authority as defined in Rule 11A(1) in the prescribed form as per Rule 11A(2) of the Rules. The DDO has to allow deduction only after seeing that the Certificate furnished is from the Medical Authority defined in this Rule and the same is in the form as mentioned therein. 2. Further in cases where the condition of disability is temporary and requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority as in 1 above and furnished before the DDO. 3. Very sad I spoke with Sweety a short while back and she is very hurt and very shaken. She is almost losing her confidence of travelling independently around! In case that happens, what will become of her? How does she remain a contributing member of the society? And who then is going to look after her and her little daughter? This is a problem in metros all over the world. There have been several instances of blind people falling into the gap between the train and the platform in London, some coming out with severe injuries. Some years ago, a blind person with a guide dog in London fell on to the tracks, ignoring his guide dog's attempts to push him away. The metro system in London's stations announces frequent warnings to passengers to mind the gap between the train and the platform, as also the system in Delhi it appears. Besides, the voice announcement systems in trains have this announcement as well. As blind persons travelling independently on the metro, it is perhaps unfair to blame the metros for the gaps. As we are aware of these gaps, it is our responsibility to use the cane and negotiate these gaps. The gaps between the train and the platform vary in London as well. During my initial days in London, In response to my question about uneven gaps between the train and the platform, an underground staff member informed me that these gaps are inevitable due to curves in some stations. These gaps are apparently not a result of faulty planning, but essential in some stations due to their layout in order to protect trains. The decision to hold the Cabinet comes a day after government appeared to be having second thoughts on bringing ordinances, including those being pushed by Rahul Gandhi. These ordinances were on the agenda of the Cabinet meeting yesterday but were deferred, apparently after senior minister and NCP chief Sharad Pawar raised questions over the need for promulgation at the fag end of the tenure of the government. He is understood to have said that there was no tearing hurry and the matter should be left for the future government to decide, sources said. The government's reluctance is also believed to have been influenced by the fears that President Pranab Mukherjee might raise questions on similar grounds. But the decision to hold the Cabinet tomorrow evening indicates that government has made up its mind to bring ordinances. Sources in the government suggested that instead of bringing several ordinances, government could restrict itself to approve ordinances on Prevention of Corruption (Amendment) Bill, SC/ST (Prevention of Atrocities) Amendment Bill and Rights of Persons with Disability Bill. The Cabinet which met for nearly two hours yesterday decided to postpone the ordinances. These included ordinances on Prevention of Corruption (Amendment) Bill and Right of Citizens for Time-Bound Delivery of Goods and Services and Redressal of their Grievances Bill - both dealing with corruption, which were on the agenda of the meeting. These are among the anti-corruption bills being pushed by Rahul Gandhi to create a framework to fight graft. Along with these, the SC/ST (Prevention of Atrocities) Amendment Bill, Rights of Persons with Disability Bill, Security Laws (Amendment) Bill and Delhi High Court Act (Amendment) Bill were also on the agenda. This morning, on P7 news they reported about the protest and the protesters breaking the barricade, but no news about the lathi charge which followed it. However, where such individual is a person with severe disability, a higher deduction of one lakh rupees shall be allowable. DDOs should note that 80DD deduction is in case of the dependent of the employee whereas 80U deduction is in case of the employee himself. However under both the Sections the employee shall furnish to the DDO following: 1. A copy of the certificate issued by the medical authority as defined in Rule 11A(1) in the prescribed form as per Rule 11A(2) of the Rules. The DDO has to allow deduction only after seeing that the Certificate furnished is from the Medical Authority defined in this Rule and the same is in the form as mentioned therein. 2. Further in cases where the condition of disability is temporary and requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority as in 1 above and furnished before the DDO. 3. For the purposes of section 80DD and 80 U some of the terms defined are as under:- (a) Administrator means the Administrator as referred to in clause (a) of section 2 of the Unit Trust of India (Transfer of Undertaking and Repeal) Act, 200 ; (b) dependant means- (i)in the case of an individual, the spouse, children, parents, brothers and sisters of the individual or any of them; (ii) in the case of a Hindu undivided family, a member of the Hindu undivided family, dependant wholly or mainly on such individual or Hindu undivided family for his support and maintenance, and who has not claimed any deduction under section 80U in computing his total income for the assessment year relating to the previous year; (c) disability shall have the meaning assigned to it in clause (i) of section 2 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 and includes autism, cerebral palsy and multiple disability referred to in clauses (a), (c) and (h) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999; (d) Life Insurance Corporation shall have the same meaning as in clause (iii) of sub-section (8) of section 88; (e) medical authority means the medical authority as referred to in clause (p) of section 2 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 or such other medical authority as may, by notification, be specified by the Central Government for certifying autism, cerebral palsy, multiple disabilities, person with disability and severe disability referred to in clauses (a), (c), (h), (j) and (o) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999; (f)person with disability means a person as referred to in clause (t) of section 2 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 or clause (j) of section 2 of the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999; (g) person with severe disability means- (i)a person with eighty per cent or more of one or more disabilities, as referred to in sub-section (4) of section 56 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995; or (ii) a person with severe

However, where such individual is a person with severe disability, a higher deduction of one lakh rupees shall be allowable. DDOs should note that 80DD deduction is in case of the dependent of the employee whereas 80U deduction is in case of the employee himself. However under both the Sections the employee shall furnish to the DDO following: 1. A copy of the certificate issued by the medical authority as defined in Rule 11A(1) in the prescribed form as per Rule 11A(2) of the Rules. The DDO has to allow deduction only after seeing that the Certificate furnished is from the Medical Authority defined in this Rule and the same is in the form as mentioned therein. 2. Further in cases where the condition of disability is temporary and requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority as in 1 above and furnished before the DDO. 3. The same incident happened with me at akshardham metro station. It was really scary, though I acted fast and pulled my leg out in time. It was just like a flash, I got hurt on the leg but after the incident what was most frightening was to imagine that what would had happened if I could not had been able to get my leg out on time and the train had moved. I also have retinitis pigmentosa and I travel by metro regularly. After the incident I thought of things I could have done better in this case. Sharing it here so that it can help anyone who might unluckily get into such situation, because at that time the mind just go blank I realised that I should had first asked the people on the metro to block the door or myself had done it by putting bag I was carrying, on the door way. As the train does not move till all its doors gets closed. This would had made me safe even if I would had not been able to take my leg out in time. As Geetha says, gaps between trains and platforms are unavoidable in some stations. However having some sort of tactile indication at the end of the platform in the form of blister tiles or something similar will help a lot. But for two male co-passengers, who hurriedly pulled her up, she could have suffered grievous injuries. The incident happened around 5-20 p.m. I put a leg forward thinking I will step on the train but my left leg went in completely into the gap between the platform and the train. It was so unexpected, I couldn't understand and when I was pulled up I felt bruises on my right ankle, knee and elbow, she said. Fortunately for Ms. Bhalla, her co-passengers helped her up before the train's doors shut on her. A resident of Karol Bagh, Ms. Bhalla travels from Jhandewalan to Nehru Place and back on a daily basis. The gaps at all stations should be uniform so that no untoward incident happens. This is especially dangerous for young children who can fall into the gap while boarding or de-boarding the train at rush hours, she said. The problem is that in some places the gap is smaller and at others it's larger.

I'm no longer using OE as my primary email client so don't exactly remember but you will get it in the options, and sent tab, there must be a setting called html setting... and within that there must be something indent message check box, I guess it has to be done with that. Really very sad, metro should be more blind friendly so that these insidence should not recur in the future. The girl should not abandon the hope. Sweety Bhalla, a government employee, who was entering the train found her legs collapsing into the gap - which was not exceptionally large. But for two male co-passengers, who hurriedly pulled her up, she could have suffered grievous injuries. The incident happened around 5-20 p.m. I put a leg forward thinking I will step on the train but my left leg went in completely into the gap between the platform and the train. It was so unexpected, I couldn't understand and when I was pulled up I felt bruises on my right ankle, knee and elbow, she said. Fortunately for Ms. Bhalla, her co-passengers helped her up before the train's doors shut on her. A resident of Karol Bagh, Ms. Bhalla travels from Jhandewalan to Nehru Place and back on a daily basis. The gaps at all stations should be uniform so that no untoward incident happens. This is especially dangerous for young children who can fall into the gap while boarding or de-boarding the train at rush hours, she said. The problem is that in some places the gap is smaller and at others it's larger. There should be some uniformity, she added. Ms. Bhalla said similar incidents have happened twice before at Rajiv Chowk and Udyog Bhavan stations. There is a lot of rush especially at stations such as Rajiv Chowk. The Metro should have segregated entry and exit points into trains so it helps manage the crowds in an orderly manner. Ms. Bhalla, who suffers from retinitis pigmentosa, which has rendered her blind since birth, was part of a committee that did an external audit on the first line of the Delhi Metro that connected Welcome and Kashmere Gate. I was part of a 'disability committee' that provided inputs to the Delhi Metro on how to make stations friendly for Persons with Disability. We had then reviewed three stations, she said. Following Thursday's incident, she rang the helpline number of the Delhi Metro and was told that she will be contacted after the footage from the station is reviewed.

A copy of the certificate issued by the medical authority as defined in Rule 11A(1) in the prescribed form as per Rule 11A(2) of the Rules. The DDO has to allow deduction only after seeing that the Certificate furnished is from the Medical Authority defined in this Rule and the same is in the form as mentioned therein. 2. Further in cases where the condition of disability is temporary and requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority as in 1 above and furnished before the DDO. 3. Further in cases where the condition of disability is temporary and requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority as in 1 above and furnished before the DDO. 3. Hi During the AI convention, we used the Delhi metro. The warning regarding the announcement to be careful about the gap was done in all stations. On some station it was more emphasised. Probably the gap there was more alarming perhaps. The Delhi metro indeed has tactile tiles on the platforms. What we had seen, The metro staffers encourage the blind persons to board the ladies coach next to the driver coach. Perhaps, it would be more prudent to do so. Interacting with an IVR is fairly hard on android. The primary problems I faced in doing this before I moved from a google nexus to the IPhone were: 1. The option to turn on loud speaker is clumsy and time consuming - most IVRs time out by the time you get the speaker working. 2. The android accessibility platform is not responsive enough to allow quick identification of keypad numbers. This becomes even worse if you use a third party TTS like the ivona voices instead of the built in google TTS. With the IPhone, IVRs are extremely easy to use because the above two problems have been solved. The IPhone is prohibitively expensive though. So, if you can afford only an android phone, you should try to get a phone with a good processor, not use third party voices and keep a minimum of background services running to conserve processing power. Also, if you try to use an IPhone 4 with the latest IOS 7 update, you run into the same problem as android because the iphone 4 processor is not fast enough for the new OS. So, if you are using or buying an IPhone 4, do not upgrade to IOS 7. I don't second this opinion that blind people should be encouraged to travel in the ladies coach because you know quite often some of the people with vision impairment are not easily noticed that they are blind and once some of the ladies see men around them in the ladies coach they pass a very dirty comments over them, although once they get to know about that, they indeed regret! I personally never intend to be in the ladies coach because on every station, to the new comers I cannot explain why I'm in the ladies coach, so, better to be careful! It was really scary, though I acted fast and pulled my leg out in time. It was just like a flash, I got hurt on the leg but after the incident what was most frightening was to imagine that what would had happened if I could not had been able to get my leg out on time and the train had moved. I also have retinitis pigmentosa and I travel by metro regularly. After the incident I thought of things I could have done better in this case. Sharing it here so that it can help anyone who might unluckily get into such situation, because at that time the mind just go blank I realised that I should had first asked the people on the metro to block the door or myself had done it by putting bag I was carrying, on the door way. As the train does not move till all its doors gets closed. This would had made me safe even if I would had not been able to take my leg out in time. The problem arises when during office hours, it is so crowded and people push around crazily that is becomes a very big problem. And there no tacktile indicators indicating the edge of the platforms and the flor is too slippery. With the rush, it becomes very difficult to even use your white cane. People simply dont notice. It was so unexpected, I couldn't understand and when I was pulled up I felt bruises on my right ankle, knee and elbow, she said. Fortunately for Ms. Bhalla, her co-passengers helped her up before the train's doors shut on her. I am long staying in India now and I came from Tokyo, Japan. Railway transport ation system is the most common in big sities in Japan, and we have been heard similar sad news every year. In a recent a few decades, tactile tile system have been widely installed in m ajor railway platforms. It is definetely better than nothing though, still sot ime blind persons fell down or touch with approaching train and died or sivier ly injured. Besides the blind persons, certain amount numbers of ordinary sighted persons kill themselves by jumping in front of a train Sometimes accidentally fell dow n by faint or walking drunken. This is a new system called safety guard platform, or nickname is platform- door is popularizing, and many busy railway stations are going on the installm ent, like everywhere in Tokyo. Railway platform is like a bridge without any guard fence in the side, and thi s sfafety guard has fence with sliding doors. The doors are open only train st op and its door open. Of course it is going on automatically. The most popular major railway lines have 11 coaches-linked and in the rush ho urs, every 2-3 minutes interval coming in the station platforms. This is a very good news for the blind and everybody in Japan. Some newly built and completely renovated metro lines have this safety guard s ystem in all staions, and the train operated by one-man which means having no conductor.
