A Physically Challenged Person is not willing or will rarely fight for his right, he is either too scared and he is in minority, further also many a times the O.M’s or GR’s issued by the Govt do not reach the persons. Approaching the courts is a lengthy process and too expensive, hence upliftment required. The Physically Challenged Persons suffer from multiple disabilities as their age, their medical expenses are high a rise in salary due to promotions will help them, hence upliftment required. The promotions in Govt are either by selection or seniority. However, it is noticed that in some of Ministries like CBEC there are also physical standards, here chances of Physically Challenged Persons qualifying is very dim if not next to impossible, hence upliftment required. Circulars / GR’s were issued by DOPT granting reservation to Physically Challenged Persons in Group A, B, C D also various judgments have emphasized the reservation aspect. Now stating that reservation be granted only at entry level will go against the Physically Challenged Persons and the various judgments passed by the Courts, hence upliftment required. Justification :- Case of Mr Jadhav a Kabaddi player was rejected to the post of Prev Officer as he was handicapped with three fingers amputated. Shri Balseram P.H with polio of leg though passed the physical standard test of CBEC was not given reservation inspite of being the only PH candidate. Shri A.C. Rodrigues though the High Court and CAT had given judgment in his favour asking the department to consider him for promotion, however the department slept on the matter thereby denying him his due promotion. Should identification of posts in employment suitable for Physically Challenged Persons? At present very few posts have been identified for Physically Challenged Persons, it is suggested that the process of identification of post should be cancelled. The reason being, that the right to choose the post should be with the candidate. If he/ she feels that he is comfortable and confident with the job after a brief tenure of probation with the approval of his seniors / liaison officer. The above statement is justified by an example:- The post of P.O /E.O Customs, Inspector Central Excise had been identified by the Expert Committee as suitable for one leg handicapped person, with physical criteria of sitting, standing, bending, manipulating with fingers and seeing, the same was challenged by Shri Mahadeswar and Shri P.E. Rodrigues of Mumbai Customs, (both handicapped by one arm.), as the above said can be performed easily by persons with one arm handicapped. After much persuation CBEC, Expert Committee and the Ministry of Social Justice amended the same. EXPRESSED OPINIONS FROM DISCRIMINATED DISABLED PERSONS: that even prior to the enactment of the Persons with Disability Act, 1995 there existed Reservation in promotions for Persons with Disabilities in Group `C `D'. Subsequent to enactment of the PWD Act, 1995. the said not less than 3% Reservation got extended to Direct Recruitment to Gr.`A' `B' and for promotions in the said Group i.e. `A' `B' respectively. In short, consequent upon enactment of the PWD Act, 1995, the not less than 3% Reservation exists in all Groups ie. `A', `B', `C' and `D' respectively. This issue is very important from the point of the employed Disabled Persons in various Organisations. However, unfortunately this benefit meant for the Disabled Section is not been utilised in the correct manner with the result that many vacancies meant for the Disabled Persons based on the Reservation have been filled up by the General Category and the Disabled Fraternity had to take matter to the Judiciary.

Besides, we will provide testing aid for them,” said Himanshu Rai, Convener, CAT 2010. The guidelines drawn up by the IIMs have defined categories like low vision/blindness, hearing impairment, locomotor disability/ cerebral palsy for differently-abled students. They will be allowed to use technical aids like abacus, hearing support, wheelchair, magnifying screen and scribe/reader. However, all these approved means of assistance will have to be brought by the candidates. Candidates suffering from low vision, blindness, cerebral palsy will be allowed to bring a scribe. Differently-abled candidates will have to sit for a longer version of CAT exam at their specific test centres. The total time for the test under special accommodations will be increased from two and a half hours to three and a half hours. However, a differently-abled candidate requiring support at the test cannot re-schedule the test. But a differently-abled candidate not requiring support during the test can re-schedule his/her test online. Sangameswaran The Madras High Court has made it clear that the government should implement three per cent reservation in all posts, including those in groups ‘A' and `B' and for all future recruitments under the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act. Justice N. Paul Vasanthakumar passed the order on a writ petition filed by a physically challenged person with locomotor disability. He also restrained authorities from inviting applications in future for filling the posts without reserving three per cent for the physically challenged. In his petition, G. Sureshkumar stated that the TNPSC issued an advertisement in July 2005 for recruitment of 1295 Assistant Surgeons (General) and 530 Assistant Surgeons (Speciality). He sought quashing of the notification citing the note embedded in it that “3 per cent reservation for physically handicapped persons will not apply to this recruitment.” He had secured high marks in the written test and was called for the interview. Only on account of failure to make the reservation, he was not selected. He sought a consequent direction to authorities to follow the reservation for persons with disability, consider him under reservation for persons with locomotor disability or cerebral palsy as per the provisions of the Act and recruit him. In its counter, TNPSC contended that General Rules stated that reservation for physically challenged candidates should be made applicable in respect of posts in groups ‘C' and ‘D' alone. The government had issued orders in February 1988 in respect of Executive Posts in ‘A' and ‘B' categories and no reservation needed to be made for the differently-abled. It also said that by a Health Department G.O. of July 1999, posts of Assistant Surgeon (both clinical and non-clinical), Medical Officer (Siddha) had been classified as Executive Posts. Therefore, no reservation was made in the notification. Mr. Justice Paul Vasanthakumar, citing rulings of the Supreme Court and the High Court, said in the light of the Supreme Court judgment, the authorities' stand could not be sustained. They could not now rely on a proviso to Rule 22 of the Tamil Nadu State and Subordinate Service Rules as the rule had been declared ultra vires by a Division Bench. The judge said that the petitioner's application submitted under the general category having been rejected on the ground of not signing it and the said decision having been upheld by the Supreme Court in a connected matter, he was unable to give any relief to the petitioner in respect of the selection already made. She was travelling to Chennai to present a paper at a national conference when she met with a road accident, resulting in permanent loss of mobility in both her lower limbs. She completed her graduation and internship in a wheelchair, and also topped her college in orthodontics and community dentistry. Barely a month out of a major surgery in 2009, she wrote her P-G entrance exam and passed with a good score. BATTLE FOR RESERVATION Though the government of India had reserved 3% seats for persons with disability, the Rajiv Gandhi University of Health Sciences had reserved only one seat for a physically challenged candidate in 2009. Since the university was supposed to reserve 3% seats, Dr Rajalakshmi approached the then state commissioner for disabilities Das Suryawanshi, who issued a order to reserve 3% seats. Surprisingly, the university ignored this order. Not one to give up, Rajalakshmi's mother Dr Shobha Murthy filed a writ petition in the high court. After a year-long battle, the court issued a historic order, making 3% reservation mandatory for disabled students in government and private educational institutions. Her battle enabled 24 disabled students to pursue their dreams in medical and dental PG courses this year. 'MY LIFE CHANGED' When I suddenly became disabled, my life completely changed. It was shocking for us to know that an Act enacted 15 years ago was not implemented, and people with disability were denied their rights all these years. My mother was struggling to get justice for me and I was worried about her health. On several occasions, I wanted her to give up, but she was confident and fought till I and many like me got justice. I thank my mother and brothers for being my pillars of strength, Rajalakshmi told TOI. All her life, my daughter has been a meritorious student and when I knew she rightly deserved the seat, I had to fight for her rights. I have argued my daughter's case alone in court. But I am happy the struggle benefited the entire disabled student community. From the current year, it is mandatory that all educational institutions reserve 3% seats as per the PWD Act, said mother Shobha Murthy. The government turns the disabled into beggars by only distributing wheelchairs and clutches. They should empower them by efficiently implementing the PWD Act, she added. Since the state government had failed to implement the Act, Dr Rajalakshmi lost one year. But not really — the plucky girl did a course in fashion designing and pursued her Masters in Psychology through distance education.
