The Centre has exempted posts under the Indian Police Service (IPS) from the 
mandated 4% reservation for persons with disabilities (PwD) in government jobs, 
a move that rights groups say goes against the Rights of Persons with 
Disabilities Act, 2016.

On Wednesday, the Social Justice Ministry issued a notification saying that 
Section 34 of the RPD Act, which provides for 4% reservation in jobs for PwD in 
government establishments, would not apply to all categories of posts of IPS, 
the Indian Railway Protection Force Service and police forces of Delhi, Andaman 
and Nicobar Islands, Lakshadweep and Daman and Diu and Dadra and Nagar Haveli.

At the same time, the Ministry issued another notification on Wednesday making 
a distinction between combat and non-combat roles in the security forces. The 
Ministry exempted all combat posts in the Border Security Force, the Central 
Reserve Police Force, the Central Industrial Security Force, the Indo-Tibetan 
Border Police, the Sashastra Seema Bal and the Assam Rifles from the 
non-discrimination and reservation provisions of the RPD Act.

V. Muralidharan, general secretary of the National Platform for the Rights of 
the Disabled, called for a withdrawal of the notification regarding the police 
forces.

“Exemptions should be granted only in cases of combatant roles in keeping with 
the intent and spirit of the proviso under Section 34 of the RPD Act. It is 
regrettable that a department that is supposed to safeguard the rights of the 
disabled and empower them is doing just the opposite,” he said, referring to 
the Department of Empowerment of PwD under the Social Justice Ministry.

He added that the proviso of the Act did not intend to give blanket exemptions 
from hiring PwD, but to make sure that combat roles are not assigned to them. 
He said the decision was even more shocking given the fact that the Delhi 
Police had in October 2019 issued an advertisement for “head constable 
(ministerial)”, with reservations for PwD.

In March this year, the Goa Police invited applications for various posts, 
including 34 posts of “lower division clerk”, with four posts reserved for PwDs.

A rights activist and doctor, Satendra Singh, of the Doctors with Disabilities 
group, said there were many roles that PwD could fill within police forces and 
exempting all categories of roles was wrong.

“It seems to be an oversight by the Ministry. Why deny the chance to PwD when 
the role may not be combat-related? They can work in clerical jobs, as cyber 
security experts and many other roles. And on the other hand, police personnel 
can be hit by a bullet or lose an arm in the line of duty, does that make them 
unfit automatically?” Dr. Singh asked.

‘Justice delayed is justice denied’ is a statement often used in the context of judicial cases that have been or are pending for long in courts of law. There could be several factors responsible for such a situation to arise. These include the complex nature of cases; a lack of judicial attention as far as the aggrieved party is concerned, and even a lack of resources/power/other kinds of support available to the aggrieved side. One such issue that has become a victim of such a state of affairs is reservation in the promotion of persons with disabilities.Editorial | Making disability count: On why NFHS will yield more robust data on the disability sectorThe Persons With Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1995, or the PwD Act, first recognised the right of the disabled person to be employed and promoted in government jobs on equal basis with others. In order to ensure this, it introduced 3% reservation for the disabled in employment. The reservation of seats for the disabled existed in Groups C and D prior to the introduction of the PwD Act. Now, the Act extended reservation for the disabled in Groups A and B — a progressive step towards ensuring the dignity of and equality for the disabled at all levels including career advancement in government jobs. In addition to this, it also fixed the percentage of reservation of seats at 3%, which opened the gates of recruitment to disabled people in different sectors of the government.An integral part of reservation
Reservation for the disabled in promotion in all groups was first interpreted as an integral part of reservation by the Department of Personnel and Training, order no. 3603517195-Estt./SCT, which was passed in 1998. This Government Order was issued by the department in 1998 after the passage of the PwD Act, 1995. It happened after Parliament enacted the provision of reservation of promotion for Scheduled Castes (SC) and Scheduled Tribes (ST), reversing the Supreme Court of India verdict in Indra Sawhney Etc. vs Union Of India And Others, Etc., where reservation in promotion for SCs and STs was withdrawn. The Department of Personnel and Training interpreted the Parliament enactment to be applicable to persons with disabilities also as they are from the marginalised sections of society as well, and hence enjoy similar protection from the state of law.Also read | Centre exempts police forces from disability reservation rule, rights groups cry foulUnfortunately, another Department of Personnel and Training order, i.e., no. 36035/3/2004-Estt/Res, in 2005 withdrew the reservation of the disabled in promotion in Groups A and B. The department’s reversal of its own order was not only shocking but also clearly reflected the apathetic and hostile attitudes of the administration and government towards the needs and aspirations of the disabled. The department’s order of 1998 opened the doors of opportunity to the disabled to progress in their organisations in keeping with the spirit of the PwD Act. But the department’s order of 2005 may be understood by the ruling dispensation as an _expression_ of denial of equal space and place to the disabled at the higher level in organisations.
Counter action, contempt filing
As a result, a case, no. 36035/3/2004-Estt(Res) was filed in the Supreme Court in 2008, by Rajeev Gupta against the Union of India. After deliberations and hearings for around eight years, it was adjudicated to grant reservation in promotion for the disabled in Groups A and B, which, regrettably, had been taken back by the Department of Personnel and Training order of 2005. The final judgment was made in 2016, granting reservation in promotion in Groups A and B. But the Government of India did not make any effort or give any direction to implement the judgment.
Mr. Gupta then filed a case of contempt in the Supreme Court in 2017; the hearing still continues. The government counsel filed an affidavit arguing for the stopping of the proceedings in the contempt petition by Mr. Gupta citing the presence of another case, i.e., Siddaraju vs State of Karnataka & Ors. in the Supreme Court, in 2017. 1.The correctness of the judgment of this Court in Rajeev Kumar Gupta & Ors. v. 
Union of India & Ors.1 was raised by Union of India before a Division Bench of 
this Court. In Rajeev Kumar Gupta & Ors. v. Union of India & Ors. (supra), this 
Court held that persons with disabilities are entitled for reservation in 
promotions. The matter was referred to a larger Bench for considering the 
issues raised by the Union of India. After a detailed consideration of the 
judgments of this Court in Union

of India & Anr. v. National Federation of the Blind & Ors.2, National 
Federation of the Blind v. Sanjay Kothari, Secretary Department of Personnel 
and Training3 and Rajeev Kumar Gupta & Ors. v. Union of India & Ors. (supra), 
this Court answered the reference on 14.01.2020. The submission on behalf of 
the Union of India that Rajeev Kumar Gupta & Ors. v. Union of India & Ors. 
(supra) warrants reconsideration was rejected. This Court held that the Union 
and the State Governments are bound by the judgments of this Court in Union of 
India & Anr. v. National Federation of the Blind & Ors. (supra), National 
Federation of the Blind v. Sanjay Kothari, Secretary Department of Personnel 
and Training (supra) and Rajeev Kumar Gupta & Ors. v. Union of India & Ors. 
(supra).
2.This Miscellaneous Application has been filed by the Union of India for 
clarification of the judgment dated 14.01.2020. Notice was issued on 12.01.2021 
and the Union of India was directed to submit a written note identifying the 
points on which clarification was sought. Pursuant to the said direction, a 
written note was filed by Ms. Madhavi Divan, learned Additional Solicitor 
General seeking clarification on the following four issues:
a. whether the vacancies for promotion for PwDs would be computed only on the 
basis of the vacancies against the

identified posts or against the vacancies in both identified
and non-identified posts.
b. whether reservation can be given to PwDs at the time of
induction from SCS/Non-SCS to IAS.
c. whether the intention of the judgment is to grant
reservation in promotion beyond the lowest rung of Group- A or up to the lowest 
rung of Group-A.
d. whether the judgment dated 14.01.2020 in Civil Appeal No.1567 of 2017, 
titled Siddaraju v. State of Karnataka & Ors. along with its tagged cases needs 
to be implemented on the basis of the Persons with Disabilities (Equal 
Opportunities, Protection of Rights and Full Participation) Act, 1995, (based 
on which the case was filed) or the Rights of Persons with Disabilities Act, 
2016 (the latest Act applicable on the date of judgment).
3. It was submitted by the learned Additional Solicitor General that 
reservation in promotion shall be in accordance with such instructions that are 
issued by the appropriate Government from time to time as provided in Section 
34 of the Rights of Persons with Disabilities Act, 2016. As implementation of 
the three judgments mentioned above has given rise to some doubts, it is 
necessary that the points raised by the Union of India be answered and 
clarification be given to enable the Union of India to proceed with issuing 
instructions.
4. Ms. Jayna Kothari, learned Senior Counsel and Mr. Rajan Mani,
learned counsel opposed the submissions made by the learned

Additional Solicitor General by contending that there is no necessity for any 
clarification of the judgments of this Court referred to above. They have 
raised a grievance that the delay in issuing the instructions under the proviso 
to Section 34 resulted in stalling the implementation of reservation in 
promotion for persons with disabilities.
Having examined the judgments of this Court and the submissions made on behalf 
of the parties, we are of the opinion that there is no ambiguity in the 
judgments which warrants any clarification. The Union of India is directed to 
issue instructions regarding reservation in promotion as provided in Section 34 
of the Rights of Persons with Disabilities Act, 2016 within a period of four 
months from today.
Miscellaneous Application stands disposed of accordingly.

(IACA) to survey its
members as well as other specialists working in or with courts about
technology and access to justice
Courts and justice systems worldwide are undergoing digital
transformations. It is not clear that their technology roadmaps
include a commitment to ensuring
access to justice for persons with disabilities
In order to promote greater progress on CRPD Article 13, G3ict has
launched a global Access to Justice and Technology initiative
Key Findings:
Courts worldwide are investing in technology
67% of courts deploy mainstream technologies for internal and/or public use
Primary reasons for technology deployment are to increase efficiency,
increase access to justice and save costs
60% of courts have budget allocated for digitization, but less than
10% specifically allocate budget to funding for ICT accessibility and
digital inclusion
of PWDs
75% of courts deploy digital documents and digital case management,
over 50% of them deploy digital payments and procedures and provide
remote access to

Online teaching-learning is becoming a new normal these days, especially owing 
to the continuing hazards relating to the covid-19 pandemic. In a sense, 
e-learning  has potentials to enable people with disabilities to participate in 
teaching-learning process from their home, without exposing themselves to the 
pandemic risks. However, lack of adequate information and awareness of online 
tools and the available assistive alternatives would inevitably result in 
exclusion of people with disabilities. Both The disability community as well as 
education sector in general have to be aware of mainstream online educational 
tools and their inbuilt assistive solutions. Unfortunately, institutions while 
rapidly transitioning to online mode appear to be doing the least to create 
required awareness of this kind. 

In our attempt to contribute and intervene in the field of e-learning from the 
disability perspective, Sambhavna invites all for a demonstration of online 
tools offered by Google which are widely been adopted.  Mr. Viraj Kafle, 
Assistant Professor, Dyal Singh College, DU will give a demonstration of Google

Public Statement by Sambhavana Organization on the support rally by
some DPOs for RPD Bill:--

We are deeply disturbed to learn that various Disabled Persons
Organisations (DPOs) are planning a demonstration on December 3rd,
2015 in support of the Rights of Persons with Disabilities (RPD) bill
(which may be tabled in Rajya Sabha in the winter session of the
Parliament) without knowing and discussing its contents. In our
opinion, the demand for parliamentary debate prior to public
consultation amounts to garnering support for the existing format of
the Bill. In this context, we feel it essential to recall the
formation of All India Disability Alliance (AIDA), a joint forum
consisting of various DPOs to demand a legislation accommodating the
needs and aspirations of all disabilities without discrimination.
Sambhavana was a strong presence in its campaign in 2014 and had
worked vigorously to mobilise cross-sections of disabled people. The
strength of our campaign, which compelled the Government of the day to
forgo its intentions to bring in the legislation through an Ordinance,
was a collectivism achieved through democratic engagement and wide
consultation amongst all organisations who were the part of AIDA.
Following the initial success, however, we did not witness any
intention on the part of the Convener, AIDA, (Shri Santosh Kumar
Rungta of National Federation of The Blind), to steer ahead the joint
campaign. It is really beyond our comprehension that why no
consultation  was facilitated by the AIDA Convener amongst member
organisations to inform the progress, if any, regarding the inclusion
of our demands in the bill! The decision to organize a support rally
on 3rd December 2015 by some DPOs in favour of the passage of the RPD
bill in the Parliament without any discussion raises some fundamental
questions:
Has any substantial change in the RPD Bill occurred since then?
Have all the serious points that we raised during our many rounds of
consultations among ourselves, as well as during our agitation against
the weak RPD bill, been included?
Has The present draft of the RPD bill with the suggestions of the
Standing Committee been put in the public domain for
consultation/deliberation?
Why no meeting of AIDA was organized to discuss the present development?
Questions such as these are very important and the disability
community owes an explanation from the Convener, AIDA, for this
non-transparent U-turn through bypassing the democratic process.
While the community all-in-all has been kept in dark regarding the
actual form in which the bill is being tabled in the upcoming
Parliament session, there are strong apprehensions about the inclusion
of many of our significant demands in the bill.  If this happens, we
fear that the tireless efforts which has been put in by the Disabled
community through a momentous disability movement for an effective RPD
bill could be wasted  and we may be thrown back in to the pre 1995
era. Therefore we strongly feel that the occasion of the International
Day for Persons with Disabilities could have been best utilised by
once again regrouping and re- strengthening our campaign for a strong
and effective RPD bill.
It is therefore disappointing that a support rally has been planned
without any round of consultation or discussion amongst all the member
organisations.
In the light of such unfortunate developments, we wish to clarify that
Sambhavana is not a part of the support rally being organised on
December 3rd, 2015. The organisation, however, will keep striving for
an inclusive and progressive legislation for persons with disabilities
and will readily contribute to similar efforts by
individuals/organisations championing the rights of the disabled.

must have known that there are two separate rosters are operational in 
Delhi University. One, 100 point roster is for ph candidates and two; 200 
point roster is for SC/ST/OBC. 100 point roster which was for SC/ST, 
implemented in 1997 has been replaced by 200 point roster came in to 
effect in 2007.


Eversince, 200 point roster has come in to force , administration of 
colleges has put 100 point roaster for ph under the carpet. Number of 
ad-hoc teachersin colleges has increased remarkablybut ph have not been 
appointedaccording to 100 point roster. Few days back , I had posted the 
case of my college whereteaching strength has crossed 167but only 4 ph 
have been appointed while it should be 6. Yesterday, I had registered my 
protest to EOC, university of delhi which I I am pasting below.i request 
all the ph teachers of delhi university to ensure proper implement ation 
of 100 point roster in their respective colleges so that we could record

seek necessary action in the case of violation of 100 point PH roster for 
appointments in teaching post in Swami Shraddhanand College, University of 
Delhi, Delhi -- 36.


This is for your information the I, Manish Sharma, received a letter from 
the Principal, Swami Shraddhanand College, datedinforming the schedule of 
selection committee to appoint ad-hoc Assistant Professor in the 
department of History. However, the college in violation of the legal 
norms had not made public the 200 point post based roster for appointment 
to teaching post. I duly protested this. (cf. letter to the principal 
dated, Annexure I, pagesof the file.)


Following my protest, the 200 point roster was finally displayed on the 
college website in the second half of of 23/12/2013. (cf. 200 point roster 
for teaching post of SSN College for academic semester Jan-April 2014, 
Annexure II, pagesof the file.)


In the less than 24 hours available to me, I perused the roster and found 
various discrepancies that were duly conveyed to the Principal, Swami 
Shraddhanand College in my note of dissent submitted before the 
commencement of the interview process. (cf. note of dissent, date, 
Annexure III, pagesof the file.)


Of these one concerns your jurisdiction. As per the information provided 
in the 200 point roster displayed on the college website the college has a 
workload of more thanteaching posts. As per the Persons with disability 
(PWD) Equal Opportunity, Protection of rights and full participation Act 
(1996), the college should have appointed six teachers through PH roster 
i.e. through proper identification and advertisement of seats duly 
reserved for VH and OH candidates. As per the PH roster 1^st , 34^th , 
67^th , 101^st , 134^th and 167^th post are to be reserved for PH 
candidates. Only four appointments have been made in the college on the PH 
roster till date, */in gross violation to the undertaking/* */given to the 
honourable High Court of Delhi, Swami Shraddhanand College has neither 
advertised not recruited the appropriate numbers of PH Assistant 
Professors./*


Sir, this act of the Principal is in violation of the PWD Act (1996), as 
well as the undertaking that the University of Delhi and Swami 
Shraddhanand College gave to honourable High Court of Delhi on correct 
maintenance and compliance with the 100 point roster for teaching post for 
PH candidates. Given the severity of the violation I request you to take 
immediate cognizance of the matter and take necessary steps to ensure the 
following:


1.Correct and updated 100 point PH roster is displayed in public domain 
including the websites of Swami Shraddhanand College and the University of

In the instant case, the Institute of Chartered Accountants of India (ICAI)
examinees with disabilities who were due to write their exams tomorrow
onwards i.e. 03rd May 2012,  received  the Admit Card and impugned writer
guidelines on 26th April 2012, just days before the examination with weekly
holiday in between. Despite the fact that this guideline titled; *“Guidelines
and Procedure to be followed regarding granting of Writer/ Extra Time to
the Differently Abled Candidates”* was finalised by the Examination
Committee in its January 2012 meeting, the same was never put up on the
website while there exist detailed instructions for examinees taking CA
exams this year.

The examinees found these guidelines discriminatory and arbitrary and
against the settled norms of writer guidelines.  This amounted to
discouraging the students with disabilities to appear for the exams. The
examinees immediately contacted Mr. Somasekhar, Addl Secretary (Exam) who
told the candidates that he could not do anything since this is the
decision of the Examination Committee taken during January 2012.

The examinees then contacted the author to help them resolve this issue so
that they could appear in the examination with a proper writer.  It is
pertinent to mention that the examinees with disabilities fearing
retribution from the ICAI did not want to come out in open against the
ICAI.  The author also telephonically contacted the Addl. Secretary above,
but he only promised that “he will look in to it”.

The author then immediately filed a complaint before the Chief
Commissioner- Disabilities on 27th April 2012 and sought an urgent
intervention in view of the exam starting 03rd of May 2012.


The Chief Commissioner, having verified the facts and the documents on
record, immediately sent his order dated 30.04.2012 by email  Fax to the
ICAI directing them to remove the unreasonable conditions for the writer to
be used by candidates with disabilities and sought an action taken report
by email/fax.

The author has been following up since then with the ICAI but to no avail.
The Institute  neither gave any assurance nor  withdrew the impugned
guidelines.

Since no student was ready to come forward in open against the mighty
Institution set up under an Act of Parliament in 1949 and the second
largest accounting body in the whole world, the

forced to become petitioner in an urgent public interest litigation filed
before the Delhi High Court yesterday morning praying quashing of the
impugned guidelines and staying the examinations/ making proper
arrangements for the conducting examinations of persons with disabilities
who may be using the writers/ scribes based on the earlier guidelines in
the interest of justice.

The double bench of Hon'ble Chief Justice Shri. AK Sikri and Hon'ble
Justice Rajiv Sahai Endlow directed the Institute to relax all three
impugned conditions i.e. Writer to be not more than 20 years, Only one
writer to write all exams and lastly that relative can not write the exams.
The Hon'ble court also verbally asked the media people present in the court
to give wide coverage to this issue in national dailies so that it reaches
all affected students and their families.

Respecting the autonomy of the Institution, the Hon'ble Court clarified in
its order,  *This order is only applicable for the current examination
(May 2012 Exam.) and the Examination Committee of the ICAI  who is meeting
to discuss this issue on 13 May 2012 will be entitled to take its own
decision after considering the difficulties pointed out by the petitioner
in this petition. This petition shall also be placed before the Examination
Committee and treated as representation of the petitioner and the
aforesaid arrangement made by us for the present examination would not be
reflective of any final opinion in this matter.*


At the same time, it also addressed the fears of the petitioner by
ordering, *We make it clear that in case any amendments in the Guidelines
are made by the respondent ICAI pursuant to the recommendations of the
Examination Committee and the petitioner still feels aggrieved
thereagaisnt, it would be open to the petitioner to approach the Courts
again*.

Ministry of Railways Issues Notification for Extending Concession to 
Orthopaedically Handicapped/Paraplegic Persons in Rajdhani and Shatabdi Trains 

 

The New Facility to be Effective from 1st June, 2011 

Ministry of Railways has issued a notification for extending the concession in 
Rail fares admissible to Orthopaedically/paraplegic persons in Rajdhani/Shatadbi

trains also. This comes as a follow up to the announcement made in Railways 
Minister's Budget speech for 2011-12 on 25th February, 2011. 

 

Accordingly, Orthopaedically handicapped/paraplegic persons who cannot travel 
without the assistance of escort are eligible for 25 per cent concession

in 3-AC  AC Chair Car in all inclusive fares of Rajdhani and Shatabdi trains. 
The same concession will also be admissible to one escort accompanying the

concerned handicapped person. 

 

There is no change in other terms and conditions. 

 

The concession will be effective on tickets purchased on or after 01.06.2011. 
In case of tickets already issued for travel on  after 01.06.2011 refund

or difference of fares will not be admissible.
