Then acting on a silent hand signal from their leader, they all break into a jog trot and fan out around the house. The first two demolish the front door with sledgehammers, while the other six simultaneously smash windows at the sides and rear of the small suburban dwelling. Screams can be heard from inside as these apparitions from hell burst into the bedrooms and force the unarmed occupants face-down on the floor. A woman and her four small children lie sobbing hysterically, while the âbraveâ leader of the masked goons sticks a Glock semi-automatic pistol up her husbandâs nose, and cuffs his hands behind his back. Readers could be pardoned for thinking this was a scene from the old Stalinist Russia, or maybe just everyday brutal Jewish oppression of Palestinians in Palestine, but they would be wrong. This is 5.15 a.m. on 30 October 2002 in the sleepy suburbs of Perth, Western Australia, and the brutal masked goons are acting on the direct warrant of Daryl Williams, Australiaâs equivalent to Donald Rumsfeld. Just like Rumsfeldâs prisoners illegally kidnapped and held in Cuba, the only crime this Australian family had committed was that of being Muslim, and thus causing political paranoia in Canberra. As Mr Williams himself rather foolishly admitted on national television, the goon operation, âis directed only at individuals who MAY have SOME KNOWLEDGE of J.I. [Jemaah Islamiah] in Australia. An illegal operation, perhaps? It certainly was. Australian law states that if the Australian Security Intelligence Organization [ASIO] has concerns about specific individuals, then those individuals may be approached to make voluntary statements on the matter. This is understood by police officers to mean making an appointment by telephone, or knocking politely on the front door during daylight hours. There was nothing at all voluntary about this operation, which horrified and outraged the lady living next door: âThey broke down the door with sledgehammers. They were carrying machine guns and wearing black helmets and flak jackets, with balaclavas covering their faces. It was very frightening to look at, like something from a movie set. I was shaking and terrified, it was as though we had gone back fifty years to Nazi Germany.â Daryl Williams has clearly made the same mistake as Donald Rumsfeld, apparently believing that because he is a âpowerful officialâ, he can do whatever he wants to whomever he wants, whenever he wants. Actually, as megalomaniacs go, both men are actually on solid historical ground here. Atilla the Hun and Joe Stalin thought exactly the same way. The Perth family raided by the masked goons are ethnic Indonesian Muslims who have lived quietly in Perth since 1989, with the oldest child preparing to sit high school exams, and the youngest only two years of age. The shocking âcrimeâ their father âmayâ have had some âknowledgeâ of, was visiting Sydney back in 1996 to listen to a lecture given by Abu Bakar Bashir, who according to the media is,â now under arrest in Jakarta and a key suspect in the Bali bombings.â After harassing the terrified family for six hours, the armed and masked goons left without pressing any charges or making any arrests, proving in absolute terms what Mr Williams had unwisely said on nationwide television. Whether or not the innocent occupant âmayâ have had some âknowledgeâ of a lecture given by Bashir back in 1996 [long before ASIO made him into a âTerroristâ last week], could very easily have been established by a simple legal telephone call, or a simple legal knock on the door during daylight hours. The elderly and very frail Abu Bakar Bashir himself, could only be a viable suspect if he had somehow managed to steal an Israeli micro nuclear device from Dimona in The Negev Desert, which seems most unlikely. No matter, the Mossad had to create alternative suspects in a hurry, and the CIA rushed to oblige by bringing heavy pressure to bear on its subordinate antipodean ally. The tea lady at Langley called the Australian Government, and less than two days later, all members and supporters of Jemaah Islamiah were labeled âTerroristsâ by ASIO, which reports directly to Daryl Williams. The words âIntelligenceâ in ASIOâs title is a little misleading, because it seems to infer that members are highly skilled operatives with years of experience countering terrorism in its many different manifestations. The Tongan-born Hopoate, who played two Tests for the Australian national side, the Kangaroos, in 1999, was banned for 12 National Rugby League championship matches. NRL commissioner Jim Hall described it as a "disgusting, vile and offensive act". "During my 45 years in rugby league, never have I come across a more disgusting act," Hall added. However, Talk-back radio was inundated with fans and ex-players telling how common the act was. And Hopoate's club coach, Terry Lamb, who played 349 first grade games, said it was reasonably common to be touched in the region of the testicles. Bernie Gross, who defended Hopoate before the NRL disciplinary commission, claimed he was only giving the players a "wedgie". But North Queensland's Peter Jones, one of three players Hopoate attacked, dismissed the claim. "Wedgies are when your pants are pulled up around your arse. I think I know the difference between a wedgie and someone sticking their fingers up my bum," Jones said. The 27-year-old Hopoate, a teetotaller Mormon with five children, has been in trouble with the NRL disciplinary commission seven times in the last four years, usually for fighting. The Defence Legislation Amendment (Aid to the Civilian Authorities) Bill seeks to establish the legal and political basis for using troops to suppress political disturbances, seriously undermining the centuries-old principle that the armed forces should not be mobilised against the civilian population. The Bill was passed through the House of Representatives in one day (June 28) virtually unnoticed with the country in the grip of GST mania, and is due to be voted on in the Senate by the end of August in time for the Olympic Games. Under the pretext of ensuring public safety during the Olympics, the government and the Labor Opposition have combined to rush through the legislation which will permanently and fundamentally change the military's role. The Bill authorises the Prime Minister, the Defence Minister and the Attorney-General to advise the Governor-General (the Commander-in-Chief of the armed forces under the Constitution) to call out military personnel to deal with "domestic violence" that is considered a threat to the nation or one of Australia's states or territories. The words "domestic violence" do not refer to violence against family members or in the home. It is a vague and undefined expression derived from s.119 of the Constitution, which was intended to cover civilian disorder that the state police forces prove incapable of putting down. Today, the term "domestic violence" is widely interpreted to mean more than just "terrorism" and can include strikes, political demonstrations or riots. Already the term "terrorism" has been used by police and security forces to encompass protests such as those planned for the World Economic Forum in Melbourne in September. It is possible that "domestic violence" will be interpreted to include protests at the Olympics or the WEF. Section 119 of the Consititution provides that the federal government shall protect each state against domestic violence, but only on the application of the state's government. Section 51A of the Bill goes well beyond the existing s. 51 of the Defence Act 1903 (Cth), which is based on s. 119 of the Constitution. The new section will allow a military callout where the three ministers are satisfied that domestic violence is occurring "or is likely to occur" that will affect "Commonwealth interests" (also undefined), regardless of whether there is a request by any state or territory government. Section 51B retains an existing proviso in s. 51 that a state government cannot request reserve forces for use in an intervention to deal with an industrial dispute, but no such restriction applies to the use of the armed forces to protect Commonwealth interests. For that reason, many consumers were more than happy to let the vendor do the installing. Now all you need do is put the right plugs in the right holes, press the on button and the computer is ready to rumble. The staggering growth of Microsoft Windows has meant that if you buy a PC unless you buy an Apple Macintosh you have a choice of it being bundled with Windows or Windows (98 or NT that is). Even IBM, which has its own operating system, OS/2 Warp, ships Windows as standard. If you decide you want OS/2, you have to buy the PC with Windows and pay for a copy of OS/2. If you're happy with Windows, none of this is really a problem: all you want is your computer to work smoothly. Users of other operating systems, however, are not thrilled at having to pay for software they have no intention of using. It's like buying a new CD player and also having to purchase a Celine Dion CD you don't want. Until recently, the solution has been to wear it. But when South Australian-based Linux user Geoffrey Bennett bought a new notebook PC from Toshiba last year, he also read the end-user licence agreement for the copy of Windows that came with it. The agreement stated that if he didn't agree to the conditions of the licence "you may not use or copy the software product and you should promptly contact the PC manufacturer for instructions on return for the unused product(s) for a refund". Bennett contacted Toshiba and says that while the company originally refused to refund his money, he was later offered a refund for the entire machine. Finally, Toshiba gave him a cheque for $110 for the return of the unused software. Toshiba declined to comment on Bennett's case, or the wider implications of the refund, but it is not a situation unique to that company. Few, if any, name-brand vendors in Australia are willing to ship a PC without Windows. This is for a number of reasons, says Michelle Vanzella, marketing and business development manager with computer vendor Gateway. Gateway is unwilling to ship machines without an operating system because such machines cannot be tested before shipping. The company is currently considering offering Linux as an alternative. "Gateway is in rigorous compatibility testing for Linux and we're also doing market research to determine whether or not there is a demand for the product," she says. Vanzella explains that part of the reason for the company's hesitation is that Gateway offers free support for Windows for its customers and wants to offer the same service to Linux customers, which has training and support implications for Gateway staff. In the meantime, customers who want a Gateway machine but don't want Windows have the choice of either paying for it and not using it or returning both the hardware and software. "Our warranty service agreement allows the user to return the full system. We've never allowed them to return just the software bundle," says Vanzella. Most computer vendors have a similar policy. While Compaq offers customised orders for large corporate clients and alternatives to Windows on its servers, it's an all-or-nothing deal for PCs. Consumers not willing to accept the end-user agreement have the option of returning the hardware and software for a refund. Some believe this practice may contravene the Trade Practices Act. "It appears that it may be a case of third-line forcing," says Patrick Fair, a lawyer with Philips Fox specialising in computer issues. Section 47 (6) of the Act makes it illegal, he says, to "refuse to supply particular goods or services if the purchaser has not acquired, or not agreed to acquire, other goods or services from another person". When Living IT contacted the Australian Competition and Consumer Commission, a spokeswoman said the ACCC had not investigated Microsoft and the end-user agreement in regard to Section 47 (6).
