Maybe, but the point is whether the architectural spec includes that
capability.  After all, any OS could restrict what applications you
run; you don't need special hardware for that.  The question is whether
restrictions on software are part of the design spec.  You should be
able to point to something in the TCPA spec that would restrict or limit
software, if that is the case.

Or do you think that when David Wagner said, "Both Palladium and TCPA
incorporate features that would restrict what applications you could run,"
he meant "that *could* restrict what applications you run"?  They *could*
impose restrictions, just like any OS could impose restrictions.

But to say that they *would* impose restrictions is a stronger
statement, don't you think?  If you claim that an architecture would
impose restrictions, shouldn't you be able to point to somewhere in the
design document where it explains how this would occur?

There's enormous amount of information in the TCPA spec about how to
measure the code which is going to be run, and to report those measurement
results so third parties can know what code is running.  But there's not
one word about preventing software from running based on the measurements.

The plan, already implemented, is to flood file sharing systems
with bogus files or broken files.   The solution, not yet
implemented, is to attach digital signatures to files, and have
the file sharing software recognize certain signatures as good or
bad.

This involves scaling problems that have not yet been thought
through or implemented.

As files get copied around, they would accrete ever more digitally
signed blessings.   The signatures should be arbitrary nyms, as in
Kong, not true names. The files could also accrete digitally
signed discommendations, though such files would probably
propagate considerably less.

When we approve a file, all the people who approved it already get
added to our trust list, thus helping us select files, and we are
told that so and so got added to our list of people who recommend
good files.  This gives people an incentive to rate files, since
rating files gives them the ability to take advantage of other
people's ratings.

If onr discommendd a file, those who discommend it are added to
our trust list, and those who commended it to our distrust list.

How can they force you to present something that they can't force you to
have in the first place?

[Same reason as for driver's licenses to drive. If you don't want an
identification, that's fine -- but then you won't be allowed to do
certain things where identification is necessary for security reasons.]

I promised that I wouldn't send him any more mail for at least a week but

One doesn't need a driver's license to ride in a car. The government is
now claiming that you need ID to ride in a commercial aircraft. Since the
development of passports for international travel at the beginning of the
20th century, passports (or other travel documents) have been necessary
to enter other nations. Commercial carriers began to check them on
boarding not for security reasons but because if passengers were refused
entry at their destination the carrier was responsible for their
maintenance and return.

The problem with such ID requirements is not merely that ID is required.
The problem is that the activity can be barred for reasons other than
lack of ID. You will also be banned for your characteristics. After all,
what's the point of requiring ID to fight terrorism if you can't ban
terrorists from flights. Or people who fit a terrorist profile. Or people
who owe child support (drivers licenses, fishing licenses, and passports
are denied to those owing child support).

An ID requirement, when you combine it with online verification and
authorization, creates a federal license requirement to engage in the
particular activity. In the above case, a federal license to fly on a
commercial aircraft. In other proposals, a federal license to take a job,
open a bank account or rent an apartment.

A federal license that can be denied for any reason since it is issued
via a computer analysis system driven by a secret algorithm.

It's a license because the federal government is required to
affirmatively grant you permission before you can do something.

The right to fly is controlled by the Computer Assisted Passenger Profile
System (CAPPS) -- soon to be replaced by the presumably wider-ranging
CAPPS2. At the heart of CAPPS is a secret algorithm that determines
whether you are or may be a terrorist. You can't know what facts or
behaviors cause CAPPS to ban you from a flight since the algorithm is not
for public consumption.

In fact, since the Feds have not set up an administrative procedure for
you to challenge a denial of flight boarding (or any of the future
activities that will be subject to CAPPS2 and similar systems) only those
with the $25K to 100K needed to bring a federal civil suit will be able
to challenge their denials. The Feds require private businesses that deny
you credit to follow an appeals process but don't impose such a
requirement on themselves in the much more significant denials that
CAPPS2 will make. And even for the rich, these court challenges will be
hard to win since the reasons for the denials will be a state secret.

So those who support such ID requirements and such federal licenses
should be required to answer a basic question -- what activities should
be subject to state and federal permission and which activities should
not?

Holding terror suspects breaches rights, rules

A British tribunal today ruled that detention without trial here of nine
foreign terror suspects under emergency laws imposed after the September
11 attacks breached European human rights regulations.
The Special Immigration Appeals Commission said Britain's new
anti-terrorism powers, rushed through in December, were "not only
discriminatory and so unlawful ... but also disproportionate".
In a ruling which dealt a blow to the government, commission chairman
Andrew Collins said the laws were unfair because they allowed the
detention of foreign nationals only, even though British citizens may
have been equally involved with terrorist organisations.
It therefore breached the European Convention on Human Rights.

Practical products are about to emerge from the weird world of quantum 
mechanics. Erica Klarreich finds out how quantum cryptography made it from 
the lab to the marketplace
The Enigma code machine, used by the German military during the Second 
World War, was a masterpiece of complexity. Each letter of the alphabet was 
encoded by a system of wheels that could be set in an almost endless array 
of configurations, creating a seemingly unbreakable cipher. But Enigma had 
a chink in its armour.

Messages could not be decoded unless the receiver knew which wheel settings 
the sender had used. Users exchanged this information, known as a key, at 
the beginning of the message and encoded it using another, prearranged, 
key. But security for this second key was not perfect. Enigma users changed 
it only once a day. After cracking a few messages by focusing on commonly 
used words, code-breakers could tease out the second key and decipher all 
of the day's transmissions.

More then half a century later, secret messages are still only as secure as 
the keys used to encrypt them. Sensitive data are exchanged every day, yet 
no one has developed a system that ensures that the keys to these messages 
are absolutely secure.

This may soon change. Companies are close to marketing cryptographic 
systems that use quantum mechanics to offer absolute security — guaranteed 
by the laws of physics. Devices that can securely transmit keys through 
fibre-optic cables may soon be available. And it might eventually be 
possible to transmit quantum keys using satellites, allowing users across 
the world to form secure connections.

The keys used to encrypt most messages, such as those used to exchange 
credit-card information over the Internet, are themselves encrypted before 
being sent. The schemes used to disguise keys are thought to be secure, 
because cracking them would take too long for even the fastest computers. 
The widely used RSA algorithm is one example. Anyone wanting to receive a 
message publishes two numbers, one of which is the product of two very 
large prime numbers. Senders convert their message into a series of digits, 
and perform a simple mathematical calculation on the series using the 
publicly available numbers. Messages are deciphered by reversing the 
calculation.

Prime movers
This is easy to do if you know the values of the prime numbers, which are 
not published. An eavesdropper can, in principle, work them out, but for 
big enough numbers this would take millions of years with the computing 
power available today.

The future performance of such systems depends on estimates about the speed 
of future computers, and such guesses have proved wrong is the past. In 
1977, for example, Scientific American challenged computer scientists to 
decode a message encrypted using a 129-digit number1. Ron Rivest, a 
computer scientist at the Massachusetts Institute of Technology and one of 
RSA's creators, estimated that it would take 4  1016 years to factor such a 
number. But in 1994, a team of computer scientists and amateur volunteers 
managed to decipher the message by applying 1,600 computers to the problem 
over a period of eight months2.

In the same year, computer scientist Peter Shor of AT&T Labs in Florham 
Park, New Jersey, described a new kind of threat. Shor was interested in 
quantum computers — hypothetical machines that should be able to carry out 
a large number of calculations simultaneously. He showed that if such a 
computer is ever built, it will be able to factor large numbers rapidly, 
and could quickly crack all the commonly used public key systems3.

A quantum computer or new factoring technique might not come along for 
decades. But some secrets encrypted today, such as the design of nuclear 
weapons, will still be important then. "We have to assume that any 
information encrypted today is probably being recorded by eavesdroppers in 
the hope that it will be of value 10 or 20 years into the future," says 
Richard Hughes, a physicist at Los Alamos National Laboratory in New Mexico 
who works on quantum cryptography. "If they have quantum computers, they'll 
be able to look at information encrypted today and learn useful things from 
it."

But while quantum computers remain no more than an interesting possibility, 
another quantum technology could soon be ensuring total security. In 
quantum mechanics the act of measurement changes the properties of the very 
thing being measured. This is a boon to cryptologists, because it means 
that eavesdroppers cannot listen to certain types of information without 
leaving an unmistakable disturbance.

You most likely have just seen this story recently featured
on a major nightly news program (USA). And reported
elsewhere in the world (including my neck of the woods - New
Zealand). His mother was cleaning and putting laundry away
when she came across a large brown paper bag that was
suspiciously buried beneath some clothes and a skateboard in
the back of her 15-year-old son's closet.

 Nothing could have prepared her for the shock she got
when she opened the bag and found it was full of cash.
Five-dollar bills, twenties, fifties and hundreds - all
neatly rubber-banded in labelled piles.

 "My first thought was that he had robbed a bank",
says the 41-year-old woman, "There was over $71,000 dollars
in that bag - that's more than my  husband earns in a year".

 The woman immediately called her husband at the
car-dealership where he worked to tell him what she had
discovered.He came home right away and they drove together
to the boys school and picked him up. Little did they
suspect that where the money came from was more shocking
than actually finding it in the closet.

 As it turns out, the boy had been sending out, via
E-mail, a type of "Report" to E-mail addresses that he
obtained off the Internet. Everyday  after school for the
past 2 months, he had been doing this right on his computer
in his bedroom.

 "I just got the E-mail one day and I figured what the
heck, I put my name on  it like the instructions said and I
started sending it out", says the clever 15-year-old.

 The E-mail letter listed 5 addresses and contained
instructions to send one $5 dollar bill to each person on
the list, then delete the address at the top and move the
others addresses Down, and finally to add your name to the
top of the list.

 The letter goes on to state that you would receive
several thousand dollars in five-dollar bills within 2 weeks
if you sent out the letter with your name at the top of the
5-address list. "I get junk E-mail all the time,and really
did not think it was going to work",
the boy continues.

 Within the first few days of sending out the E-mail,
the Post Office Box that his parents had gotten him for his
video-game magazine subscriptions began to fill up with not
magazines, but envelopes containing $5 bills.

 "About a week later I rode [my bike] down to the post
office and my box had 1 magazine and about 300 envelops
stuffed in it. There was also a yellow slip that said I had
to go up to the [post office] counter.

 I thought I was in trouble or something (laughs)". He goes
on, "I went up to the counter and they had a whole box of
more mail for me. I had to ride back home and empty out my
backpack because I could not carry it all".

 Over the next few weeks, the boy continued sending
out the E-mail."The money just kept coming in and I just
kept sorting it and stashing it in the closet, barely had
time for my homework".He had also been riding his bike to
several of the banks in his area and exchanging the $5 bills
for twenties, fifties and hundreds.

 "I didn't want the banks to get suspicious so I kept
riding to different banks with like five thousand at a time
in my backpack. I would usually tell the lady at the bank
counter that my dad had sent me in to exchange the money and
he was outside waiting for me.One time the lady gave me a
really strange look and told me that she would not be able
to do it for me and my dad would have to come in and do it,
but I just rode to the next bank down the street (laughs)."

 Surprisingly, the boy did not have any reason to be afraid.
The reporting news team examined and investigated the
so-called "chain-letter" the boy was sending out and found
that it was not a chain-letter at all.In fact, it was
completely legal according to US Postal and Lottery Laws,
Title 18, Section 1302 and 1341, or Title 18, Section 3005
in the US code, also in the code of federal regulations,
Volume 16, Sections 255 and 436, which state a product or
service must be exchanged for money received.

 Every five-dollar bill that he received contained a little
note that read, "Please send me report number XYX".This
simple note made the letter legal because he was exchanging

There are consumer protection laws that may be used to open this up.
Manufacturers are required to provide for repair parts for a minimum 
amount of time.  Being able to take your car to an independent repair
services has in the past been defined as an owner's right.

Data pertaining to the specific car will probablly be required to be
available.   Data only used to build aggregate fleet data might still
be protected.  

Being able to modify the parameters might impair the manufacturers "Fleet"
air quality/fuel efficiency averages, without a exeption which may be
part of the final law.
 
An owner could of course replace the entire control system with a retrofit.

This practice of encryption might also be to protect the market for 
computerized tools sold to repair shops.  At $5000 apiece per car make per
repair shop that's a lot of money.

If safety is really the issue then tamper evident seals on the systems
might be able to absolve the manufacturers, unless the ability to hack
the systems is considered an "Attractive Nusiance".  Consumer Protection
laws are pretty harsh in the country, remember computers don't usually kill
people when they fail,  cars certainly can.

And all this is just the complexity that I can think of.  Imagine a team
of lobbyists and their presenations.

The carmakers say this is for safety.  Perhaps this is as lame as the
political powergrabs justified fnord in the name of "national security".

Clearly, as engineers, we know that IFF the carmakers
documented what their employees know, then third-parties could
do as good a job.  But there is no obligation to document what you
sell.  Or make it easy for others to fix your stuff ---those stupid
proprietary screws used on some equiptment to keep you out
are not illegal.  But neither is defeating them.  Modulo your
warrantee, which is fair.

Of course, the State might well use the "safety" lever to open
the codes; or it might simply extend a tentacle of fascism
and require it for the nominal benefit of the sheeple.  Consider
if this behavior were applied more generally.

Actually, this clicks neatly onto cp debates over open vs closed
systems, TCPA, DRM, and 'freedom to hack'.

Most modern cars are substantially computerized. Diagnosing a
problem usually involves hooking up a PC to a port on the car's
engine management system, and studying the readouts.

The 'problem' that the congresscritters are trying to 'solve' is
that some car manufacturers are now closing this interface -
they are refusing to document the protocols, and/or encrypting
the data.

As a result, the manufacturers are able to restrict who has
access to this diagnostic data, and are using this power to
shut out independent repair shops and other competition to
their own dealerships. The meeting is going to discuss 
whether 'something should be done'. I have no idea what will
happen, if anything.

So, let's see:

* The manufacturers are using DRM technology, including crypto,
to restrict access to the data.
* If you reverse-engineered the system, the DMCA could get
involved (not sure on this one).
* The manufacturers are closing the system to outside inspection,
and actively working to make it impossible for owners to tinker with 
or modify their own cars. 
* There is absolutely no benefit to the car's owner - this is simply
large corporationsfiguring out another way to get more revenue.

This is essentially 'Palladium for cars'.
