RE: [drakelist] Burned on a Transaction

2003-09-25 Thread Bruce Marton

Be very careful on E bay... There is a false sense of security about
transactions there, which they work very hard at promoting.

I purchased an older Harley Davidson, which I spent a lot of time
looking for and the one I found on E Bay appeared to fit the bill very
well. The seller listed everything done on the bike in terms of
restoration and new parts. He was very careful to list in bold print,
"ALL WORK PROFESSIONALLY PERFORMED, NEEDS NOTHING". Not to mention all
the phone calls I had with the seller prior to my bid to confirm all of
this.

Then E bay has their 'E Bay Motors' super duper power whatever warrantee
on the drive train you can forget about ever collecting in my
opinion. Too complex, too many this or that's you had to do, within
certain amounts of time, with a minimum of so many percent of damages or
restorable damages before you can put a claim in via internet only, no
reps to talk to, 6 months to review, on and on and on... It all looks
nice and feel good before the transaction, good luck after.

My bike I had delivered by the seller to me in my state. So the actual
sale occurred here, not where he was located. He was paid by a local
bank check at my door. Within 1/2 hour of his departure out of driveway
with bank check in hand, the kick start lever gear broke. I called him
on his cell phone to come back and look at it. He said 'really' and
never returned. Then the clutch went, and the transmission seal was
leaking tranny fluid all over, the engine bolts were too long, so the
motor was not nailed down into the frame, would not pass inspection due
to electrical issues on and on again. But boy did it look good in the
photos and even the close ups with that fancy digital camera of
his...JERK.

I took care of the problems myself and had my attorney contact him, with
a nice letter of "MY RIGHTS" since the transaction was completed here in
Maine. So I was going to sue him in my local court for all damages,
plus the value of the motorcycle as diminished by the "lack of
Professional" work, which this idiot admitted to in writing, he did the
work. So he was going to have to fly out from the Midwest to defend
himself and incur the costs of his attorney and probably loose the case.

Long story short, he mailed me a check to cover all of my costsE bay
seller=looser, E bay=not much credibility in my eyes, and me-buyer=much
more aware. The only reason this worked out for me was due to the high
value of the merchandise, meaning it was worth legal costs and the fact
that I got him to do the transaction in MY state.

It's a tough world out there boys, be careful.

2003-09-25 Thread Tim Kass
Well, Ebay isnt perfect by a long shot, its your word against theres most of
the time, I recently had a bad experience in getting a manual for a piece of
equipment, I won the bid, paid and received the manual...about 3 weeks later
I got a notice from Ebay stating that the seller did not receive payment. I
contacted seller (a company - power seller) they stated they didnt receive
money and didnt send out the manual to me, that its still there...I didnt
save the packaging from them and threw out the stub from the USPS Money
Order so I couldnt prove that the manual I got came from them...so...keep
everything for 6 months now, is my rule, even after the transaction seemed
smoothe. 73 Tim

I have had several poor transactions on EBay. I got substantially lower
quality items then advertised. What do you do with poor quality, well you
just try to avoid further transactions like that. If you post negative
feedback, you get it back with "it said as is", so to some extent why
bother.
Now on the items that I did not receive, I filed fraud report on EBay, and
then posted that fact in the feedback. EBay allows for 1 reply to
feedback, so have your facts lined up and your comments ready if someone
negatives your feedback. I had waited almost 90 days before I started all
my reports. With that, I got my merchandise without explanation. And the
accounts I have filed fraud reports against are no longer registered on
EBay.
Guess what I am saying is, if you can prove it easily go for it. If you
just got junk, well try to work it out with the seller, and be prepared to
"suck it up".

Ron

Wow, I read this guys feedback!
Its Great, I mean there are hardly any negative comments when you consider it, in almost 4K of comments.
I guess even the best get things mixed up a bit but have you exhausted all avenues?
I just sent this Seattle goodwill outfir $16.99 for an old camera via PayPal.
They never responded in 10 days so I notified Ebay & PayPal, The meatball outfit refunded my $16.99 via paypal.
But wait a Minute, was'nt he supposed to send me my High Bid Camera?
Ergo, he got a negativo comment!
Another meatball was high bidder on this Brand New $40 mobile UHF antenna for a big $9.99, he never even bothered to contact me & AOL said he was not a member, go figure?

Hey Chris -

I'm sorry that happened to you bud, and I certainly hope things work out in the end.

I only had one slightly negative experience with eBay. I bought a US Robotics modem
one time and the guy sent me (instead) a Hayes modem. I still use it, and I can't
complain, but wondered at the time if this particular guy does this to other people
all the time.

Be sure to leave extremely nasty feedback if the guy does not shape up quickly (IMHO).

I've been down the same route with anothjer person, I paid by money order:

A. File a complaint with ebay...give him negative feed back.
B. OIn ebay you will find a link to the national fraud information
   centerfill that form out.
C. Call the police department where he lives and file a fraud complaint if
they will take it over the phone.

When it happened to me I found out that the Post Office was no help
whatsoverand that ebay was too slowbut the detective in the
scumbag's home town made a visit and relayed to him that I would press
charges.

Good Luck!
