2002-11-24 Thread [EMAIL PROTECTED]
Hello,
Perhaps I'm missing something, but what is it exactly that the "OsGold
Recovery Team" is saying that the Market Makers and Pecunix, I presume,
did? They can't possible sue you for selling OsGold? can they? In the
court papers handed to each of you, what are they accusing you of?

2002-11-24 Thread Colonel Bosco
I don't know? It seems pretty simple to me. If you don't want to be
subject to US courts or US laws then don't do business with US residents.
Refuse it! Then you don't have to worry about being sued in US Courts if
you get involved in something like OSPyrite or many of the other Ponzis out
there.

Don't accept US business, don't use US Banks, etc.. If you do the
opposite, then offshore jurisdiction bullshit means nothing. It's all an
illusion peddled by snake oil salesman who make a lot of money selling false
security.

These guys all want the money from US residents,, but WTSHTF they want to
run to some offshore Banana Republic for protection and say: "hey, why am I
having problems? I'm not even a US Company??...

Complaints about exchange providers are a suitable topic
for discussion. However, it is not as easy to gain
sympathy with bad language. An earlier post suggests
that Ragnar should plan to put flowers on the grave of

Or have the U.S. office operate as an independent agent and under a thin
shell corporation with only offshore directors and offficers. Its cheap
and effective at thwarting deep pocket searches. Offshore directors or
officers rarely face trouble in their resident countries from civil
corporate misdeeds. Even serious criminal matters rarely lead to extradition.

Founders of tech-oriented companies often ignore simple procedures which
offer jurisdictional arbitrage. Perhaps its money, a unfortunate focus on
only business matters or technology of their ventures, or Boyscout ethics,
but too many weasels are looking to make a mark out of them.

I've got an idea. Many on this list are e-gold business owners, or hope to
be, facing possible problems from past or future weasels. Many are located
in a variety of countries. All need protection from these criminals in
suits. Why don't we band together for mutual protection. What I have in
mind is an offshore directors and officers exchange program to promote
jurisdictional arbitrage. I haven't thought through the details but the
idea is to create a sort of board/officer LETS guild. Participants would
offer to serve as officers or directors of guild members in exchange for
these other guild members serving similarly in their own
ventures. Compensation would be worked out between the parties on a cases
by case basis, as is customary, but the service obligation would be known
to all guild members.

Thoughts?

And it should be pointed out that Kelly is a very common surname

And even if it was the same guy, so ASIC charged some alleged builder
with telling fibs to get a $20,000 loan from Westbastards. Big hairy
deal.

[e-gold-list] whatever transpires!

2002-11-24 Thread Graham Kelly
Guys,

Further investigation reveals that the frivolous lawsuit that has been
lodged against the existing market makers and other defendants, is in
fact a larger smokesreen than I previously imagined. (A few emails from
very wise folks further educated me)

I have come to the realization that big business cannot control the
spread of the ecurrencies, so they aim to control it. They cannot control
the ecurrencies in the structures that currently exist. So, they needed
an excuse to "take over". The failure of OSGold/Reed was the perfect
opportunity to use as an excuse to start the process. The only real
problem was the wild card Pecunix. So, they "invented" a ficticious Reed
"testimony" to implicate them, so as to add them to the defendant "fold".

Yet, hope still remains... infighting will minimize the impact, and sheer
incompetence will give everyone a breather

I, Graham Kelly, owner of GoldNow, a proven honest businessman, father of
9, grandfather of 7, christian (but not perfect!), happily married (but
we had our up's and downs!) am declaring that I am innocent of the
alleged (rubbish) claims, and I can easily prove it. However, not being
as "wealthy" as some might believe, I cannot afford the US attorney fees
demanded to combat these scurrilous claims. I am amazed at the US legal
system being so financially brutal. Don't like competition? Slap a
lawsuit on them. Even if they cam prove they are false, it would have
cost serious $$$, just to defend themselves.

You guys (We, the people...) can bring about a change to the obviously
flawed US legal system. However, don't ask me how... it WILL change, but
not overnight, but it can START overnight.

I have submitted a dismissal request/claim to the NY judge, based on
jurisdiction. I have answered all the claims made against me, easily and
truthfully, and without guile or malice. The allegations were a sick
joke, easily disproved, based on some greedy idiots imagination. I do NOT
live in the US, nor do I want to. I love the US folks, they are great,
but I wouldn't want to live there. I am an Australian, and currently I
live in Australia.

We have well over 10,000 happy customers, and our repeat business is
running at 80%. We are proud and pleased to have worked with you all, and
I'd like to say thank you.

Next time we have a US "office", it'll be based in St Kitts or similar...
what an indictment to the US business system! No wonder long established
US companies are RAPIDLY moving offshore! For just simple protection!

So whatever transpires, it's been interesting, and I've made some good
friends, and customers. I appreciate you all... we are around for the
long haul, whatever transpires.

Oh, and BTW, order levels are UP!
