IN DEFENCE OF THE LAWYER... AND THE LAW

The banners said it all. In the forefront it ran the text:
"An appeal -- No advocate should encourage this crime". This
was the message to one and all. Advocates stay far away from
the proceedings in connection with the shocking, sad and
untimely death of the young Mandar Surlekar. The innuendo
came through loud and clear: the accused in this dastardly
crime did not deserve the benefit of any advocate whose
skills could perhaps help set them free.

Yes, they were guilty as hell, and damned besides.

The next question which automatically arises as a necessary
rider is, why only "this crime"? Why not the numerous other
murders? Or, why not the number of rape-cum-murders of young
innocent girls, some of whom have not even the benefit of
reaching the age of ten?

Why not apply the same yardstick to those ghastly crimes?
What is so special in 'this crime', that only here advocates
were not to 'encourage' it?  Yes, what was it that was so
unique and special in 'this crime' that warranted the doing
away of all rights afforded to accused, and to attain which,
humankind has struggled for centuries!

The bigger underlying question is whether there could be any
crime so heinous and horrifying that could give us Indians
the gumption to walk the streets, banners in hand, screaming,
the accused ought not be given the benefit of an advocate to
defend him both in and out of court?

If ever, we as Indians, can answer this question with a
"Yes", then for sure, we can certainly say: "Humanity Has
Vanished." And, unwittingly, this was what the very next
banner in the rally proclaimed.

What made the whole scene not just sad, but pathetic, was the
fact that the youth who marched through the streets of Vasco
on that fateful Friday screaming justice for Mandar, did not,
or, could not, realize, that there cannot be any justice if
any one is deprived of his fundamental right under Article 21
of the Constitution of India. An article which in no
uncertain terms lays down that no person shall be deprived of
his life or personal liberty except by procedure established
by law. And it is not necessary to once again teach educated
youth the meaning of this cardinal principle of society.

The demand of the rally is even more alarming, because it
came in less than a week after we had all celebrated our
Independence day anniversary.

I imagine that most of these youth had participated in the
ceremonies and flag hoisting while India recalled its tryst
with destiny. Yes, it is frightening to know that within a
couple of days of such an event, the "future of our country"
could so easily have forgotten its past.

  As an advocate who mainly practices on the criminal
  side of the law, I am very often asked this
  question: How can I defend criminals? And, believe
  me or not, this query also comes from advocates who
  are involved mainly in civil cases.

The answer is very simple.

The law demands that every person accused of an offence has
the right to be defended by an advocate if he wants one. As a
matter of fact, even if an accused cannot afford an advocate,
the State has to provide him one free of cost. And it is both
the duty and responsibility of the judge to inform any
accused brought before him that he has such a right to be
represented by an advocate.

The only time that a trial can proceed without an advocate
for the defence is when the accused himself refuses to accept
any. In such cases the presiding judge will make it a point
to record in the trial proceeding sheet that the accused
refused legal assistance even though offered under the free
legal aid scheme.

In this context there is a classical case arising from Goa.

The accused was charged with an offence under the Narcotic
Act. On the day when the charge was put to him, he stood
alone before the trial judge and pleaded guilty to possession
of a certain quantity of drugs (morphine in his case), and
claimed it was for his personal consumption since he was a
drug addict.

Unfortunately, the court refused to give him the benefit of
the lesser punishment prescribed for addicts, on the
reasoning that the quantity he was shown to have possessed
was beyond that permitted by the Act. The accused was shocked
to find himself sentenced to the minimum of 10 years and fine
of one hundred thousand rupees.

I don't know how my name and "focus" was mentioned in
connection with public crucifixions, organ harvesting,
biblical justice, frothing mouths and gasping breaths.


Perhaps your years in the practice of medicine (if you
are medical doctor) have made you immune to blood and
gore, and public crucifixions are just a nice Sunday
outing. I can assure you that my stomach is made of
much weaker stuff. I can barely endure a spicy
sorpatel, much less someone's organs being harvested.
By the way, in the interest of biblical purity, I
assume this harvesting will be done before they are
actually dead.

I just wanted to state for the record, that I do not
support your views in any shape or form, and to
refrain from using my name in this connection,

One Indian, two passports: The Indian diaspora debates

Dual citizenship is a fact for certain Indians now but
Indians back home are up in arms. Is it a case of
trying to serve two masters or a boon to the country?

 On the first rung of the 21st century, the signs
of portable patriotism - a citizenship of convenience
is here. Briefly stated, a second or even a third
passport has become not just a link to a homeland but
also a glorified travel visa, a license to do
business, a stake in a second economy, an escape
hatch, even a status symbol.
 But in India as well as in the Great Indian
Diaspora, the debate continues. Both publicly and
privately, Indians are grappling with the notion of
dual citizenship. And, despite the fact that the
government of India has decided to grant dual
citizenship (Overseas Citizenship of India) to Indians
in selected countries, there is no end in sight to the
debate.
 Opponents argue the practice weakens national
identities and leads to ethnic separatism. Supporters
say it is a natural response to an increasingly
interconnected world, for greater communication and
understanding between countries - a "win-win"
proposition. Recently, when two media giants, the BBC
and the Indian news portal Rediff, asked their
audience if they thought granting dual citizenship to
Persons of Indian Origin would be beneficial, the
response it generated was overwhelming. It opened a
virtual Pandora's box. And in that ensuing tide of
arguments and counterarguments, the debate had to be
closed.
 To inject as many voices from the diaspora as
possible, we are quoting a number of individuals who
joined in that debate.
 Their arguments may be summarized in the
following set of opinions.
 Basically, one group believes that dual
citizenship will be a great dishonor to the true
patriots. Another group is of the view that it is the
right thing at the right time.
 As one Indo-Canadian commented, "The wealth,
experience and talent of NRIs and PIO's call now be
tapped to make India a stronger economy."
 But for Gautam Sarkar, dual citizenship means,
"no more standing in line in the embassies to deal
with incompetent staff. Yes hope fully no more long
lines in the airports as well, dealing with the stupid
arrogant idiots working for Indian immigration." And
for Pooja Ahluwalia it is a personal matter of
competing both in India as well as in the U.S. She
says: "1 want to fight in karate tournaments in India,
but I was not allowed. 1 am karate champion here, and
I want to defeat karate champions in India, so if I
have dual citizenship I can be the karate champion of
India and USA."
 Kamal Shroff, a psychologist, thinks it will
enrich India. "I am delighted to know that we call be
dual citizens (USA & India). We call visit India and
start clinics for children to develop intellectually
by providing needed professional counseling services,
consultation to students, parents and behavior
therapies. We call undertake research projects to see
where were at present and where we need to go. I hope
we can bring new perspectives to old problems."
 Sudhakar Rajapu worries, "We already have lots of
problems with foreign mercenaries and terrorists. How
do we make sure such miscreants don't get dual
citizenship? Even if there were measures to check
these unwelcome people, they can always find loopholes
in our bureaucracy. Even ordinary people, why should
someone get back their Indian citizenship when he/she
opted to drop their Indian citizenship to become a
citizen of another country? I think a PIO card or
something like a green card should be enough. Even if
citizenship is given, it should be given only after a
period of 10-15 years, during which time his
contribution to India should be evaluated.
 Thus arguments are thrown back and forth in
support of as well as against dual citizenship.
 One Indian-American observed: "I am a born and
bred American whose parents are of Indian origin. The
idea of dual citizenship is not just absurd, it's an
oxymoron. When you declare your allegiance to one
country, your allegiance belongs to that country
alone. You call have cultural ties to a nation. But
that is independent from your nationality."
 Another echoed a parallel view: "I am an Indian
settled in the USA. I don't see any reason why India
should allow dual citizenship. When you become a

MY GOAN CONNECTION AS A YOUTH

My youth was spent partly in Dar-es-Salaam (East Africa) but mainly in Pune 
(India). In fact, I
have lived my whole life, except for brief holidays, outside Goa. As such, I am 
most grateful that
my father and mother took special care to instill in me and my sister and 
brother, what they
considered some of the core elements of Goan culture. This provided the bedrock 
that has remained
one of the sheet anchors in my life.

I learnt Konkani at my mother's knee and it was amchi bhas (our language) that 
was spoken at home.
My father, a man of few words, strove to inspire us by his example. My mother 
lent him invaluable
support, and it was their immense sacrifices and hard work that provided me 
with a solid
foundation for the future.

My parents always had a Konkani proverb on the tip of their tongues to prove a 
point or to drive
home the moral of some incident or event. Some were similar to those in other 
languages but many
were unique and rooted in the Goan ethos. Ingratitude evoked the saying Kam 
zalem, voiz melo (When
your work is done, don't forget the one who helped). 

Another favourite aphorism - Moddlelea khursac resped na (No one respects a 
broken down cross.) -
was probably derived from my father's bitter experience of friends deserting 
him when in later
life he was in need of help. Yet another saying that keeps ringing in my ears 
is Fudlem zoth
voitam toxem fatlem (The oxen behind follow in the footsteps of those in front.)

While in Pune, we would visit my uncle's home in Sorantho, Anjuna, generally 
during the summer
holidays. Theirs was a different world, where life was simple and unaffected, 
with none of the
conveniences that we took for granted such as electricity or piped water. The 
happy memories of
those visits remain indelibly etched in my memory.

My aunt and cousins would prepare the most delicious meals rounded off with 
mangoes that grew in
plenty on the trees in the garden. Another treat was tender coconut water and 
sur. In general no
effort was spared to make our stay as enjoyable as possible. In the evenings we 
would go to the
near-by beach, a rare pleasure for us from Pune. I would collect shells and 
different coloured
pebbles, some of which are still with me as precious souvenirs of a distant 
past.

At night, we would gather by the flickering light of the ponti (oil lamp) to 
say the rosary,
concluding with the uniquely traditional and beautiful prayer Deu bori rat … I 
was too young to be
allowed to go fishing with the elders, but would watch with fascination as they 
prepared for the
expedition that was generally at night. The next morning I would wake up to the 
excited cries of
delight over the good catch, and the mock-serious complaints of the women in 
the house as they had
to clean the fish, and cook it immediately as there were no fridges then. Feast 
days meant a
special trip to the Church of St. Michael's, and as this was quite far away, we 
had the luxury of
going there in a taxi. Even though I have since traveled to several parts of 
the world, I cannot
think of any holidays that were as enjoyable or memorable as the ones I spent 
in Goa.

On the few occasions that a Tiatr came to Pune, my father would invariably take 
us for this
entertainment. It was then that I came to know of Boyer and other veterans of 
the Goan stage and
enjoy their songs. As I grew up, I discovered role models in the community like 
Cardinal Gracias
and Frank Moraes, respectively the first Indian cardinal and the well-known 
editor of The Times of
India. I wanted very much to follow in their footsteps, but fate sent me into a 
completely
different profession.

Today, although far away from Goa, I often think nostalgically of my Goan 
connection and try to
remain attached to what is otherwise a fa

Our homes would have been an ideal heaven if only we had to develop positive 
attitudes in our day-to-day dealings. The relationship between husband and 
wives would have been very good if each husband and wife had to chalk out 
their programme positively. Today wives shout at the top of their voices 
that their husband makes them slog between the office and the kitchen. They 
know very well that the wives are in a better position to attend to cooking 
than husbands even though we husband may claim we are equal to wives as far 
as cooking is concerned but God has given our other half a better asthetic 
sense in every thing they do at home. A particular husband when on holiday 
would love to read books or newspaper while his wife wanted him in the 
kitchen. She knew her husband could not cook anything but would attempt but 
she found cooking boring and had she to grumble there would be a big fight 
which she always wanted to avoid as her husband in the past would walk out 
to her sister’s house in anger and stay there for few days till the time he 
felt a deep craving for his wife. She did not like this to happen every now 
and then and so the positive way is to call him in the kitchen make him sit 
and they would both gossip or he would tell her the important news in the 
newspapers. The husband did not like his mother in law but the wife would 
positively tell him to drop him at her mother’s place and request the 
husband to sit in the car  while she would visit her mother but in the end 
the husband too would come to the house and sit and talk for hours till the 
wife told him to quit the place as it is getting dark and they have to 
return home. Wives should remember that the ego of man is the most sensitive 
part of him and so it has to be handled with care

Dear Mario,

First of all you have created an oxymoron with
"emigrated temporarily". I've always liked the word
oxymoron, largely because of the latter part of the
word, which so aptly describes so many things we write
:))

One does not emigrate temporarily. One either
emigrates or is a guest-worker. Now, since I am
probably the only known spouse of guest-worker on this
forum, I am assuming that dig was meant for me. So let
me explain to you, how the world has changed in the
last 10 years, or as Friedman puts it "become flat".

Today's guest-workers, have to assimilate into
societies far quicker that immigrant populations that
have been there for decades. The reason is, the guest
worker moves constantly. He maybe posted in the US for
a year and in the UK for the next five years and in
Nepal for 6 months. He is expected to work in foreign
companies with foreign nationals, learn the culture of
each organisation, make acquaintances and friends, and
be a fully functional member of this environment in a
relatively short period of time.

To a global contract worker, one airport seems pretty
much the same as the next and when you strip away the
veneer of cosmetic differences, one human being the
same as another. In a way, their identity and
assimilation is seamless and yet, without a culture to
call their own, they will lose the core of their
being.

So do I. I hope the following generations of Indians
in the diaspora awaken to the wisdom of Amina's words.
It is curious how, even if we become quite realistic
and cynical about our own lives, we normally remain
quite idealistic about our children, and most of us in
the diaspora, rightly so, want our children to be
well-adjusted in a global context, yet at the same
time hold on to their Indian heritage with the right
level of comfort. This is of course one of the
diasporic challenges that parents in India don't have
to deal with.
 But the reality seems to indicate that the idea of
India, being Indian and all that it contains seems to
have largely faded from the minds of most third and
fourth generation PIOs. What amazes me is the complete
disinterest some people exhibit in even visiting their
country of origin and getting to know their roots. Yet
they call themselves Indian (though some don't even do
that) - something they can't avoid doing because they
can't change the way they look! Maybe in their hearts,
they have no connection with the land of their
ancestors and find it easier to only associate
themselves with their adopted countries that too
pretty poorly for many, as inevitably they face subtle
or blatant discrimination.
 Eugene, a fourth generation Malaysian Indian
confesses, "I had never been to India, neither was
there any interest on my part to visit India when I
was young. However, I learnt about India's struggle
for independence and her development process during my
schooling in Malaysia. In my 20's, 1 remained
uninterested due to the realities of being a fourth
generation PIO and some of the negative realities of
India or being Indian."
 Kusoorn Vadgama, historian and optometrist in UK,
observes, "Second and third generation Indians in
today's Britain have no intentions of returning home;
Britain is the only home they know. The Indian youth
 of the UK have emerged as instant internationalists
for %drom there are no racial or cultural divides.
They don't carry the Indian identity with them and
have no conflict of personality or loyalty being
citizens of the UK. They know that even if they live
in Britain for a thousand years, they will always be
British, never English,,Scottish, Welsh or Irish (as
only white folks are defined by). Similarly in the US,
every non-European immigrant is given a label for life
according to his ethnicity. people are graded as
African-American, Asian-American, Hispanic-American,
American-Jew. never just American."
 Author and widely respected speaker Ravi Zacharias
who left India when he was 20 years of age, digs
deeper: "One's identity is a hard thing to describe.
Your soul is carved in a cultural ethos, but your
dreams and goals and aspirations sometimes end tip in
a differcut context. Because I am now a writer and
speaker, having spoken in nearly sixty countries, I am
unwillingly drawn into the public eye. I function in
four arenas - the academic, the business, the
political and the arts. These are the shapers of
culture and my work takes me into these arenas all the
time. Cradled in India and seeing myself as in heart
and mind Indian, my identity ultimately will always be
first and foremost as a follower of Jesus Christ. That
is what shapes every choice I make professionally or
relationally. Unfortunately, in a world that places
such value in "success and fame" we are seen in
distorted and exaggeretted frames of reference. At the
end of the day if those closest to you do not respect
you, everything else becomes a veneer."
 Shashi lharoor writes in his book India, From
Midnight To The Millenium (New 1ork: Arcade Publishing
1997), "Most of the contemporary world's emigrants arc
people who left their homelands in quest of material
improvement, looking for financial security and
professional opportunities that for one reason or
another, they could not attain in their own countries.
Many of them left intending to return: a few years
abroad, a few more dollars in the bank, they told
themselves, and they would come back to their own
hearths, triumphant over the adversity that had led
them to leave. But the years kept stretching on, and
the dollars were never quite enough, or their needs
mounted with their acquisitions, or they developed new
ties (career, wife, children, schooling) to their new
land, and then gradually the realization seeped in
that they would never go back. And with this
realization, often only half acknowledge

Folks,

I decided not to allow Gilbert's wisdom to waste in his benign neglect of 
smokers, atheists,
homosexuals and wife-cheaters. So I printed 20 copies of his rock solid moral 
advice (call is
Gilbert's wisdom sheet) and took it to the Anjuna Wednesday night flea market 
today to hand out to
immoral people.

1. 5 smokers passed by and I gave them each a copy of Gilbert's wisdom sheet. 
They took the paper,
rolled a joint and delightedly smoked it while thanking Gilbert.
2. 5 atheists came along and I warned them they need to pay heed to Gilbert's 
wisdom sheet to save
their behind from the fires of hell. They quickly took the sheet, placed it on 
the ground and sat
on it to save their behind and pants from the red soil. 
3. 5 homosexuals came along and were looking for protection. You have come to 
the right place I
told them, here is Gilbert's wisdom sheet to protect you from sin and eternal 
damnation. They took
the paper and since this is a family friendly forum I cannot disclose how they 
used it for
protection.
4. Finally, 5 wife-cheaters came by. Sinners, how can you ignore the code, I 
admonished them on
behalf of Gilbert. Oh yes they replied, we often forget the code and proceeded 
to write down the
phone codes of all the immoral women who had given them their phone numbers.

I will be visiting the Friday Mapusa bazaar soon. Gilbert, please send more

Amita Kanekar is a Mumbai-based writer, whose well-received debut
novel A Spoke in the Wheel was published by Harper Collins Publishers,
India. Kanekar teaches comparitive mythology at the University of
Mumbai. She was born in Goa in 1965. She is currently (2006) working
on her second novel. She has lived in the U.S. as a child, and also
teaches Architectural History

Kanekar is currently researching material and travelling for her
second novel, on the rebellion of a little known peasant community in
the time of the Mughal ruler of India, Aurangzeb. Kanekar's first
novel about the Buddha, A Spoke in the Wheel, has earned favourable
reviews. Published in 2005 by Harper Collins India, the book went into
its second edition that year itself.

Kanekar was born in Madgaon (Margao) in Goa in 1965 and lived in
Navelim, a nearby village, till the age of two, before leaving for the
US and subsequently for Mumbai where she lives today, teaching
Architectural History at the Kamla Raheja Vidyanidhi Institute for
Architecture at Juhu, and Comparative Mythologies at the University of
Mumbai

Her father Suresh Kanekar was jailed three times by the then
Portuguese government for his participation in the movement against
colonial rule. Her maternal aunt was Mitra Bir, freedom fighter and
educationist, who was sentenced to twelve years in jail at the age of
22, and later went on to open schools for girls at Madgaon (Margao),
Verem, Kakora and other locations in Goa, as also centres for adult
and vocational education for women, before her death in 1978. Mitra
was married to the late Madhav Bir, former member of the Goa
legislative assembly and Gandhian. Kanekar's maternal uncle, the late
M. V. Kakodkar was also active in the campaign to open temples to all
in Goa the 1960s

The New Electronic Biometric Portuguese Passport 
by Paulo Colaco Dias - 31st August 2006.

On the 28th August 2006, Portugal joined Belgium, Sweden, Norway, Germany,
UK and few other countries and started issuing new electronic biometric
passports fully compliant with the standard recommended by the International
Civil Aviation Organization (ICAO). 

The previously issued normal passports remain valid until expiry date but
countries such as Portugal who participate on the USA Visa Waiver Program
must comply with new International Civil Aviation Organisation (ICAO)
standards and issue biometric passports incorporating a facial image to
remain in the scheme by 26th October 2006. The USA Visa Waiver Program (VWP)
enables citizens of 27 countries to travel to the United States of America
for tourism or business for stays of 90 days or less without the need of
obtaining a visa. The scheme was first established in 1986 with the
objective of promoting better relations with U.S. allies, eliminating
unnecessary barriers to travel and stimulating the tourism industry. As of
today, the 27 VWP countries are: Andorra, Austria, Australia, Belgium,
Brunei, Denmark, Finland, France, Germany, Iceland, Ireland, Italy, Japan,
Liechtenstein, Luxembourg, Monaco, Netherlands, New Zealand, Norway,
Portugal, San Marino, Singapore, Slovenia, Spain, Sweden, Switzerland and
the United Kingdom. All these 27 countries are required to issue new
electronic biometric passports to continue to remain it the USA Visa Waiver
Program.

Facial image recognition systems are built on software that analyzes human
faces' images in order to identify them. The software takes a digitised
facial image and automatically measures characteristics such as the distance
between the eyes, the length of the nose, the angle of the jaw, etc. and
creates a unique file commonly known as "template". Using templates, the
software then compares that image to other images and produces a score that
measures how similar the images are to each other. 

One of the main goals of the new electronic biometric passport is to combat
fraud and forgery through the use of facial image recognition technology and
of high-capacity, contactless integrated circuit chips. 

The new Portuguese electronic biometric passport also complies with the EU
Council Regulation on standards for security features and biometrics in
passports and travel documents issued by EU Member States. This Regulation,
adopted on 13 December 2004, mandates the inclusion of a digitised facial
image of the holder stored on a microchip in all EU passports issued at the
latest 18 months after the date of adoption of technical specifications for
the implementation of the Regulation, and of fingerprints after 36 months.
Since the European Commission adopted a Decision establishing these
technical specifications on 28 February 2005, the deadline for Member States
to implement the digitised facial image in their passports was 28 August
2006, and the deadline for the inclusion of fingerprints is 28 February
2008.  

Portugal is already fully implementing both digitised facial image and the
inclusion of fingerprints on Portuguese electronic biometric passports.
Portugal has therefore become one of the pioneer countries in having
biometric passports containing fingerprint information.  The UK and several
other countries that never had a culture of having their citizens
fingerprinted are still working towards the inclusion of fingerprints on
their new biometric passports pending revision and consultation of local
legislation concerning privacy and liberty of its citizens.

These technological advances are being adopted across the world to improve
the security of travel documents and border controls, with over 40 countries
in the process of introducing biometric electronic passports which are much
more difficult to forge (almost impossible).

Dear Fredrick,

Not to belabour the point but whenever someone mentions 'Science as a
religion' I take exception and wish to make it quite clear that until a few
hundred years ago, organized religion assumed dominion over every aspect of
life, including science and scientific discoveries.  We are lucky that that
is no longer the case.

It was the establishment of the Royal Society in England in the late 17th
century (in the shadows of the time that Galileo was being muzzled by the
Church) that gave scientists a break from the clutches of religious
domination of scientific thought.  The Society was funded independently of
the monarchy of the time but was created with their blessing to enhance the
navigation skills and efficacy of the Royal Navy.  The 12 original founding
members of the Society created a discussion group at Gresham College based
loosely on the principles of Freemasonry (divisive discussion of the topics
of religion and politics were prohibited) and levied a steep membership fee
to ensure self sufficiency.

Many of the original discoveries and inventions benefitted the spread of
the British Empire as well as the method of reporting scientific
discoveries that is the backbone of our technological advancement and that
are still in use today.  We need to understand that confidence in the
scientific establisment need not be on 'blind faith' as many have sought to
deceive using it's methods but any hypothesis put forth can be eventually
proven or disproved according to established protocols.

Giants of independent thought like Einstein and Hawking would never have
had a chance to expound on their views and leave us with their incredible
insights had we not got away from the clutches of the Church.

Hey, come on guys! World Goa Day approaches, and we fight over who
should get the credit (even before the project is adequately moving.)
Helga discusses the state of culture and a vision for the future (or
lack of it) in diasporic-Goa, and it results in a flame war over
Gonadians. Everyone is talking about their love for Konkani, but
nobody (or am I wrong) is willing to lift a finger and give it new
life in a way that makes a difference in a digital age -- by ensure it

How intellectually put.  You almost had me there.  I was well anchored on 
the shores of Calangute or was it Anjuna and I did almost climb aboard your 
boat...it was then I remembered I was equipped with sight, hearing and

Have you heard of corruption, influence and free for all high handedness of 
government that exists in Goa and India as a whole.  What one learns in the 
class room and how we as people put into practice are in India are two 
separate issues and its people have now fallen to the pits of 'if you can't 
beat them then join them'.
You are a criminal lawyer and must surely be good and won't doubt your work 
ethics.  Tell me Jos are you able to understand how these politicians are 
able to get away with amassing wealth that is over and above their known 
source of income or have they been constitutionally exempted from criminal 
proceedings for such acts.  Do you think the politicians are doing us a 
favour governing us that gives them the right to steal?  Have you heard of 
lawyers play with their opponents to extend their pay cheque or should I say 
double dipping.  I wonder why cases continue to pile up in courts.
You know what Jos you are a human being too and faced with such predicament 
you too would join hands with such people and take matters in their own 
hands.  But you and I are not in that situation so you and I can not 
understand the plight of such acts.  But lest we forget we the people pick 
from amongst ourselves a public member to represent us and it is only us the 
people that can take action if not properly represented.  Every action has

The ultimatum given by the activists for grant of
official recognition to Konkani in Roman script has
ended today 31st August, 2006.

Most of the 2.5% Hindu Saraswat Brahmin community have
folded up their "dhoties" under the leadership of
their frontsman Mr Uday Laximikant Bhembre Adv and ex
Independent MLA of Margao, who has  launched a babel
of tongues, (read vitriolic writings, spitting venom,
giving "dhamki" threats etc )   in Konkani in
Devanagari script in the world's only newspaper
"Sunaparant" (a daily with readership not exceeding
1500 as confessed by their own staff member, and
funded by the scion of the eminent late industrialist
V M Salgaocar, Mr Dattaraj Salgaocar)
 
But despite the tirade launched ever since the script
demand arose since July 2005 the proponents of Roman
script "Romi lipi" have been on the winning side.

It is quite obvious that many of the pro only
protogonists who depend on State and Central
Government funds are antagonised over the fact that
soon they will be losing their monopoly over Konkani
in Devanagari script, as it is they have started
reckoning the powerful might of the Romi lipi faction,
but shamelessly short of giving assistance they are
not ready to concede the demand of dual recognition to
both scripts in Goa Devanagari and Roman while Kannada
etc eleswhere.  

But during the over one year now the Romi lipi
proponents, have understood though belatedly that   
most of  the Hindu Saraswat Brahmin community  are
responsible for doing EXACTLY OPPOSITE OF WHAT THEY
PRACTICE AND PREACH  and this has been confirmed by
some of their own community members, notably Mr Ulhas
Buyao of Zambaulim who has been going hammer and tongs
against the fake (as he calls him) late Mr Vaman Varde
Valaulikar nee "Shenoi Goembab" propped up the Hindu
Saraswat Brahmins as the later day "Father of Modern
Konkani Movement" putting the works of the Jesuits and
Msgr S Dalgado into insignificance.

The next few months are extremely important on the
political front as the demand for amendment to the
official language act will have to be fulfilled by the
PRESENT  Indian National Congress  led coalition and
NOT  by those elected to the next Goa Legislative
Assembly post elections.

a) There was the Ponda municipal election scheduled to
be held in August, 2006 but the same was postponed.

b) The Zilla Parishad Chairperson is facing a turmoil
in South Goa and a new incumbent is expected shortly

c) The 190 Village Panchayats are due for elections
before term end in January 2007 

d) The State Assembly elections are due before May
2007

e) The opposition BJP is at its lowest ebb thanks to
the turmoil at their High Command 

f) The monsoons have recorded an appreciable
performance despite floods in some states (most of
which are not going to the Polls -- Mizoram Punjab UP
Uttaranchal are due for polls by February 2007 )

g) The Indian National Congress Party President, Ms
Sonia Gandhi MP is not too happy over the repeated
controversies in Goa. Be it 
i)  Mopa/Dabolim issue 
ii) setting up of Special Economic Zones, 
iii) the six lane Highways, 
iv)the OTS (one time settlement scheme of EDC amensty
to defaulters of loans - industrialists and big fry
not to CM read common man) whose patron Saint is Ravi
Sitaram Naik, MLA Ponda and President, 
v) Romi lipi and Devanagari lipi, 
vi)official language status to Marathi 
vii)withdrawal of teaching of English as one subject
in the Marathi  primary schools
viii) pending demand of "Don" Antanasio (Babush)
Monseratte the Minister for Town and Country Planning,
to take over the Goa Pradesh Congress Committee and 
ix) the open defiance threat of the South Goa MP Mr
Churchill Braz Alemao  (whose non induction in the
Union Cabinet is the root cause of all his pent up
frustration)to unseat the INC in Goa and take up the
reigns of the State administration with a regional
outfit
x) the nuisance value of all those ex-politicians who
wish to enter the fray 
xi) the systametic consolidation of the Nationalist
Congress Party and the equally systametic attempts of
the INC to eliminate the NCP at the next hustings or
before. 

Given this dilema facing the CM Mr Pratapsing Raoji
Rane, he has little choice but to concede the demand
of the proponents of Konkani in Roman script as
otherwise it will set at peril the stakes of the  
Catholic MLA's of  Goa

Goa government has decided to form an overseas recruitment agency to
streamline the process of employment abroad. Goa's Development Commissioner
J K Dadoo along with NRI Commissioner Eduardo Faleiro would be visiting
Delhi Sunday to complete the formalities in this regard, officials said.

"Such agencies already exist Kerala, Punjab and Haryana, which are providing

COMMENTS:
The petition is temporarily disposed for being transfered to the CRZ
Authorities for conducting the inquiry if the Salt Pan is infact within the
jurisdiction of the CRZ. In case the CRZ Authorities rule in favour of the
Developer (HARA), then the Petitioner will have two weeks to go back to the
High Court with his arguments why his is not satisfied with  the ruling by
the CRZ Authorities.  Otherwise HARA goes home empty handed and the Salt
pans remains to add more ecological balance to Goa's depleting environment,
and, also be around  to be harvested for natural salt to do away with the
new iodized salt culture which is generally believed to be  the cause of
generating more sick people in Goa through over-doze of 'iodine' in the
human system.

Kleptocracy (sometimes Cleptocracy) (root: Klepto+cracy = rule by thieves) 
is a pejorative, informal term for a government so corrupt that no pretense 
of honesty remains. In a kleptocracy the mechanisms of government are 
devoted to taxing the public at large, or using their control of government 
processes in order to amass substantial personal fortunes for the rulers 
and their cronies (collectively, kleptocrats), or to keep said rulers in 
power through redistribution schemes. Kleptocrats typically use money 
laundering and/or anonymous banking to protect and conceal their personal 
illegal gains.

Kleptocracies are by and large dictatorships or some other form of 
autocratic government, since democracy makes outright thievery for direct 
personal gain more difficult to sustain long term and still remain in 
power. States that operate consistently at the higher end of the 
kleptocratic scale tend to be politically and socially unstable, while 
being stably kleptocratic.

The economies of kleptocracies tend to perform badly, as the systematic 
corruption engendered by kleptocratic governance means that the economy is 
subordinated to the interests of the kleptocrats. Distributive states that 
derive their wealth from the extraction of natural resources (eg. diamonds 
and oil in a few prominent cases) can be particularly prone to kleptocracy, 
as the kleptocrats simply tax the Ricardian rent. Redistristributive 
economies that derive their wealth through taxation have a natural 
limitation on how far they can extend the kleptocratic policies on their 
population without destabilizing their government. Redistributive economies 
often display their kleptoctatic tendencies through using taxes collected 
from the general public to curry favor with their particular constituency 
and may be targeted on particular swing undecided voters in order to buy 
favor with other peoples money. These tax funded programs often come with 
known detrimental effects to the wider economy besides the obvious effect 
on the budget.

The creation of a kleptocracy typically results in many years of general 
hardship and suffering for the vast majority of citizens as civil society 
and the rule of law distintegrates. In addition, kleptocrats routinely 
ignore economic and social problems in their quest to amass ever more 
wealth and power. As kleptocrats do not attempt to build or maintain 
functioning states, or even maintain large security forces for fear of 
coups d'état, kleptocracies are generally incompetent in the face of social 
crises, and often collapse into prolonged civil war and anarchy.

It is observed that Goanet is rampant with unsavory diatribes, personal 
attacks and put-downs which tend to vitiate the quality of debates and deflect 
the focus from the real issues. If Goanet's "post" circle can be compared in 
hyperbole to the Knights of the Round Table we have way too many Modreds and 
not enough Lancelots and Galahads.

Dear Sir,

One of our Priests here in Pune wanted to know if there is any software
available for translating documents from Portuguese to
English.(Fr.Marian - the parish priest from Immaculate Conception Church
- City Church).

Would you have any idea about this ?

Goan Art Seeks A Future

Goan art is under attack. Sadly, not from a lack of creativity or potential - 
despite a need for control on mediocrity -- but on account of a lack of 
priority requiring a serious re-think to promote talented Goan artists on a 
wider, bigger, competitive, national and international platform.

Invited last month to open a young artists exhibition forum held at the Myriad 
Art Gallery in Panjim, I could not help but wonder aloud at the direction the 
art industry in Goa was heading towards. So much talent, so much promise, but 
where would it all lead? Would they be struggling for the next ten years to 
make a living off their talent, or forced to leave Goan shores to find their 
future? Despite concerted efforts by private individuals, art patrons, 
corporates and the Kala Academy to support the art movement in Goa and provide 
consistent platforms (and sales) for the development of the artist community, 
would it all come to nothing without a consolidated artist movement to support 
careers to reach full bloom? Goa abounds with many recognised art galleries. 
But, what is their role in working towards establishing a consolidated strong 
market to boost consistency, and in turn encourage more artists to embrace a 
life of art? Established Goan artists believe sustained support, long term 
planning, vision and marketing by the government could result in providing a 
lifeline for Goan art and in turn, help boost art tourism. "A need for good 
institutions, committed people passionate about art and seriousness in 
purpose," artists reckon, "is the need of the hour." That's where the Monsoon 
Art Festival (Aug 21-25) at the Kala Academy hoped to step in and make a 
contribution. Fuelled by the desire to get the talented art fraternity 
together (even if we had to begin small) supported by the largesse of art 
patrons in Goa, we hope this is the first of the many more to come. It is 
faith and sheer support which has resulted in bringing together the best Goa 
has to offer in terms of talent, potential, creativity and market. Artists 
like Antonio E Costa, Suhas Shilker, Anand Mohan Naik, Francis De Sousa, Mohan 
Naik, Hanuman Kambli, Vamona Anant Navelkar, Subodh Kerkar, Alexyz, Nirupama 
Naik, Yolanda De Souza, Apoorva Kulkarni, Sanjay Harmalkar, Harshada Kerkar, 
Tanya Mendonca, Viraj Naik, Pradeep Naik, Vitesh Naik, Rajendra Usapkar, 
Santosh Morajkar, Chaitali Morajkar, Shilpa Mayekar Naik, Siddharth Gosavi, 
Hitesh Pankar, N Kanhaiya and S Chewandkar do us proud, making the sweat worth 
it. The exhibition was also a rare occasion for the people of Goa to witness 
the mastery of works created by nationally and internationally acclaimed and 
practicing artists living in Goa. The art works represent a wide variety of 
techniques and subjects demonstrating the depth of creative resource which 
exists in Goa and which deserves the full support of the Govt.

Fortunately, good news seems to loom large with a change of guard at the Adil 
Shah's Palace and the government's decision to give the Old Secretariat a 
change of role. However, artist Yolanda de Souza says, "A call for discussion 
and debate in deciding the future course of the art community, vis-à-vis the 
revamping of the Secretariat as the Art & Culture Centre, is imperative. We 
need more private participation and less government interference in it's 
functioning," she emphasises. "We perceive a centre for Art & Culture, the 
kind of which is not seen anywhere in India. If given proper thought and 
conceived well, it can definitely be unique even in the whole of Asia. The 
possibilities to create an Art & Culture Centre of substance is not 
impossibility. Yes, it needs a Herculean effort. The hugeness of the task can 
be made effortless if the right criteria is followed. The right people 
appointed to the right post. In other words, a team of qualified personnel 
with a passion for art, to exclusively run a project of this magnitude is a 
must, if we want to meet our goal of creating a space that would be unique in 
India, and perhaps even in Asia. We must believe in perfection. In what is the 
right thing to do," Yolanda states.

This is not more fodder for the great language debate
in Goa. I don't want to comment on the sentimental
loyalties of the Marathiwaddas or on the virtues of
Devanagari versus Romani script. I am ill equipped to
do so.

Language has always been of interest to me. It is the
very foundation of all our thought processes. To quote
Karl Kerenyi:

"The interdependence of thought and speech makes it
clear that languages are not so much a means of
expressing truth that has already been established,
but are a means of discovering truth that was
previously unknown."

It is precisely because language is so fundamental to
the development of a society, that we as Goans are
doing ourselves a great dis-service by speaking
English. The vast majority of Goans, including a great
many teachers, have a very poor grasp of the English
language both in terms of grammar and vocabulary. 

At the lowest end of the socio-economic strata,
vocabulary may be limited to as little as 100 words in
English. Yet, grandmothers, nannies, virtually
everybody involved in the rearing of children will
insist on speaking English. 

This impoverished form of English that is beginning to
be passed down from generation to generation, is
negatively impacting our society. By the time, a child
is 6 to 8 years old, his vocabulary should be
extensive enough for him to recognise puns, form
sentences to express emotion and verbalise abstract
thinking. If he is not equipped with a language that
enables him to do so, he is unable to develop the
mental templates that lead to higher order thinking.

Doubtless, there will be a section of our society who
is able to expose their children to books, theater,
cinema and other mediums that increase a child's
linguistic prowess, but the vast majority is
disenfranchised from such opportunities and suffer
from a paucity of a strong linguistic system.

It is far better to speak to children in the
vernacular then it is to speak to them in broken and
vocabulary impoverished English. "Speaking English in
the house" should not be a badge of honour and not
speaking English should not be a source of
embarrassment.

To my teachers, with love.

Education, like charity, begins at home. So it was in my case. The 
relationship between my father and me was more of a 'guru-shishya' parmapara 
than that of a child awed and constantly corrected by the parent. His life, 
words and works are what have shaped my life more than anything else. I salute 
him this week in which we also celebrate "Teacher's Day" in India. I also 
salute my teachers in school and University. It is not everyone who is blessed 
with teachers like Pandurang M.Naik, known simply as "Guruji" by the thousands 
of students he taught, Theresa D'Souza, Ivan Rocha, Edwin Saldanha, Shrikant 
Hegde, Fr. Vivian Lobo, Fr. Theo de Sales, James Fernandes, Queenie Saldanha, 
Fr. Nicolau Pereira, Dr. K.R.Melanta and Dr. Lamon Brown. Surely, I have had 
many more good teachers, but these are the ones who have influenced my life 
the most.

teacher teaches as how much one learns from the teacher. Whether it is in the 
examination at the end of the term or during the many tests during one's life, 
what the teacher has taught is not as critical as what one has imbibed from 
the teaching and the teacher's life. That teacher is best who creates the 
proper environment for learning to take place. Teaching is not the continuous 
process of life, learning is!

My greatest 'guru' outside home is Edwin Saldanha. He taught us art 
[or 'drawing' as it was known when I was in school] and I must admit that, in 
spite of his best efforts, I still have not learnt to draw. I did 
learn 'colouring' and how to use contrasts and harmony of colours. This is 
useful in my professions of landscaping and publication. His greatest 
contribution to my life is the introduction to "Boy Scouts" and the constant 
goading to excel. He was never my 'Scout Master' in school. This role was 
played by Shrikant Hegde to perfection. Mr. Hegde and I learnt how to tie the 
standard scouting knots from the book because he did not want his student to 
look like a fool at the training camp held a few days after I was 'invested' 
as a Boy Scout in school. With Hegde as my Scout Master, Fredrico de Ataide as 
the trainer and Edwin Saldanha as the pace setter, I had the distinction of 
being the first Boy Scout from Goa to receive the President's Medal from the 
President of India. Remove Edwin Saldanha from this stage of my life and I 
might have been just another mediocre student with poor self esteem and then 
employed in some nondescript job.

A teacher who has shaped the lives of many students, including me, in St. 
Britto High School is Ivan Rocha. He picked up boys and trained them for 
General Knowledge Quiz, elocution and debates. He invested his time in many 
generations of students. He would dip into his pockets to buy us snacks and 
tea, for growing-up boys are forever hungry. Quite a few of us have ventured 
into journalism, and are doing well in it, because of him. Team work, 
delegation of roles, quick thinking, the art of repartee all come from such 
events. We are richer for the experience and the guidance of teachers like 
these. They gave us the better perspective of life.

The difference between a rich person and a poor person is often determined by 
the person's perspective of life. A friend of mine forwarded this illustrative 
story to me just a few days back.

One day a wealthy man took his adolescent son on a trip to the country with 
the express purpose of showing him how poor people live. They spent a couple 
of days and nights on the farm of what would be considered a very poor family. 
On their return from their trip, the father asked his son, "How was the trip?" 
The son replied, "It was great, Dad." "Did you see how poor people live?" the 
father asked. "Oh yes," said the son. "So, tell me, what you learnt from the 
trip?" asked the father.
 
The son answered, "I saw that while we have only one dog and they had four. We 
have a pool that reaches to the middle of our garden and they have a creek 
that has no end. We have imported lanterns in our garden and they have the 
stars at night. Our patio reaches to the front yard and they have the whole 
horizon. We have a small plot of land around our house and they have fields 
that go beyond our sight. We have servants who serve us, but they serve 
others. We buy our food, but they grow theirs. We have walls around our

issue by now. Hopefully this will be my last post on this topic, so please 
bear with me!]

Sorry I took longer to reply to your post than intended. Out of curiosity, I 
got reading the full texts of many of Hitler's speeches and these took ages. 
They definitely confirm my contention that Hitler was a Catholic, 
irrespective of the general consensus that, he was a monster and an 
extremely obnoxious character responsible for WW2 and the murder of 
millions.

1. Although you did not explain why you found my original statement about 
Hitler as a Catholic to be a source of humour, you have basically agreed 
with me that Hitler was a Catholic. You called him a "cultural" Catholic. 
This is fine by me. Thank you. I had of course gone beyond your description.

So now, let's look at some differences in our interpretations about Hitler 
the Catholic! Conjectures and refutations, as in science, are the very stuff 
of the historical process. And as knowledge is provisional because it is 
continuously evolving and changing, (as distinct from useful and necessary, 
'Western' formulaic working facts like 2+2=4)  there is always room for much 
re-examination of  facts and interpretations to be able to have a fruitful 
discussion on any topic.

But before we do this, I'd like to clarify a misunderstanding from my 
earlier statement on Goanet (but not linked to you) that, all knowledge is 
provisional. This has been seemingly provocative to at least one 
particularly vociferous poster on Goanet. That all knowledge is provisional 
does not mean that it is not possible to arrive at a consensus about aspects 
of what is true and not true. Nor is there an acceptance that everything is 
relative, nor that consensual truth is provisional, or that historians 
merely re-define facts. Historians and all people in the knowledge industry, 
re-examine data continuously, not re-define it, except exceptionally. The 
recent example of Pluto, or about the contested view about who actually won 
in Lebanon, notwithstanding the cover page of the recent Economist that, 
Hizbullah did, illustrates my point about provisionality at any historical 
time. Above all, it is difficult to be dogmatic about most things outside 
the realm of belief. Healthy scepticism and criticality are most valued in 
our over-arching knowledge industry today. I therefore hope this provides 
some clarification to at least one poster who has been inclined to be rather 
over-reliant on commonsense instead of being better read and informed as I 
believe you definitely are!

2. To reiterate, I had said that:
a) Hitler was born and nurtured a Catholic, b) is on record in his own words 
and the words of his close associates that he was a Catholic, c) practised 
every public aspect of Catholicism such as church attendance, taking the 
sacraments, and faithfully paying his dues (taxes) to the Catholic Church, 
d) was never excommunicated, e) had a productive working relationship with 
the Vatican, minimally, through a Concordant, f) instituted  the Double 
Cross used in the Church which constituted the Swastika superimposed on the 
Crucifix, g) that there is a huge quantity of photographic evidence to 
confirm much of the above.

All such empirical evidence does make it much easier to 'prove' that Hitler 
was a Catholic rather than to 'prove' that he was not a Catholic which 
clearly requires an appeal to untestable faith issues.

3. In turn, whilst stating that Hitler was a "cultural" Catholic, you said 
that the word Christian meant different things in different parts of the 
world and illustrated this with reference to America, England, India and

The monsoons in Goa are a delight to behold and an excellent opportunity for 
photography. With a view to promoting this art form together with the monsoon 
season in Goa, GoaPhotogs is organizing the first annual ‘Goa Monsoon Photo 
Marathon’ - a day that promises to be filled with fun and exciting photography.

A photography marathon brings together the elements of a marathon – pace, 
stamina and a gritty determination - along with the creative aspects of a 
photography competition. Participants are required to be at their creative 
peak in the face of limited time at hand, battling the elements, heavy traffic 
and their own physical exertions in the 9-hour event. 

Categories:

There will be the following three categories:

Colour Film 

Black & White Film 

Digital 

How it Works:

The competition will run over a continuous period of 9 hours from 8am to 5pm. 
Those opting for the film category will bring one 35 mm film roll. Those 
opting for digital category will have to use one memory card (no internal 
camera memory will be permitted).

During this period, participants will be given one theme every 3 hours making 
up a total of 3 themes over the entire day. Participants will have to shoot 
and submit one image for each theme. Since a photo marathon is a test of 
stamina and skill, sticking to timing is very important. 3 hours are allotted 
for each theme. Those arriving later than the stipulated 3 hours for each 
theme will be disqualified for the theme for which they arrived late.

At the end of the day film participants will submit their roll containing 
images shot during the day to the organisers at the venue. The rolls will be 
processed by GoaPhotogs. Those shooting digital will have to download 3 images 
for each of the three themes announced during the day onto the computers 
provided at the venue. A time of 3 minutes will be allotted to each 
participant for this purpose. No manipulation etc will be permitted on the 
downloaded images.

During the time the rolls are being processed, we will have a group "evening 
out" at Ernesto's (Club Vasco da Gama, Panjim). Here the images shot in 
digital format will be projected for viewing by the entire group.

Later in the day, on receipt of the processed rolls, participants shooting 
film will be permitted to choose their three best shots to be submitted for 
judging.

Exhibition:

An exhibition of the best photographs will be held, the venue and dates of 
which will be announced.
