Police Reforms: Why needed urgently?

To make police function autonomous and eliminate undue political/bureaucratic 
interferences. Also to ensure that they are not able to misuse their powers and 
become citizen friendly.



Background

The Janata Party in 1977, to investigate the reasons of Police brutalities and 
to improve its working, appointed a National Police Commission to have a 
comprehensive review of the police system. The Commission examined all relevant 
issues in about three and a half years & submitted 8 reports from February 1979 
to May 1981. As the recommendations of National Police Commission were not 
implemented, 2 retired DGPs, Prakash Singh and N K Singh, filed a PIL in the 
Supreme Court in 1996. The Supreme Court delivered its judgement on 22nd 
September 2006 giving the following directions to the Central Government, State 
Governments and Union Territories for compliance.



The Supreme Court Directives:

1.Constitute a State Security Commission so that state government does not 
exercise unwarranted influence or pressure on the police, lay down broad policy 
guidelines 2. Director General of Police is appointed through a merit based, 
transparent process and enjoys a minimum tenure of two years 3. Police officers 
on operational duties a minimum tenure of two years; 4. Set up a Police 
Establishment Board, which will decide all transfers, postings, promotions and 
other service related matters of police officers; 5. Set up independent Police 
Complaints Authorities at the state and district levels to look into public 
complaints against police officers in cases of serious misconduct, including 
custodial death, grievous hurt or rape in police custody; 6. Separate the 
investigation and law and order functions of the police to ensure speedier 
investigation, better expertise



Recent Supreme Court Order

The Supreme Court in its recent order has issued strictures against four state 
governments viz. Karnataka, Maharashtra, Uttar Pradesh and West Bengal and 
asked their Chief Secretaries to remain present at the next hearing on the 
coming December 6th to explain non-compliance of the directives.



Conclusion

Overall the implementation of Police reforms is dismal except for a few states. 
The Maharashtra Government has failed to implement inspite of several promises.

February 27/28 mark ten years both of the tragic death of 57 persons due to 
fire in a compartment of the Sabarmati Express near Godhra station and the 
criminal manipulation of this tragic incident as a pretext for the Modi 
government sponsored anti-Muslim genocide throughout the state. 




On February 27, thousands of victim-survivors of the mass crime, lawyers, 
jurists, activists, artistes and intellectuals from all over the country will 
assemble at Gulberg Society, Ahmedabad for a commemoration. Through words and 
images, reminiscences and video-clips, photo exhibition, names of ‘Missing 
Persons’ enlisted on a ‘Wailing Wall’, honouring those who risked their lives 
to save neighbours who were the target, music and tears, the Crimes Against 
Humanity committed ten years ago will be recalled and the plight of the 
traumatised and the displaced highlighted. The survivors from Gulberg Society 
will lead the assembled people through the housing colony and recount the 
horrors of February 28, 2002. A collective resolve will be renewed to continue 
the struggle for justice to the victim-survivors and punishment to the 
perpetrators and masterminds of the carnage. 




The entire programme at Gulberg Society, symbolising the Holocaust in Gujarat 
will be webcast for viewing Live on the afternoon/evening of Feb 27 and posted 
on U-tube subsequently so that we remember, never forget. 




Simultaneous Commemoration Meetings are planned in several cities, including 
Mumbai and Delhi. For a part of the meeting on Feb 27, we hope to be able to 
view the programme webcast Live from Gulberg Society. The Mumbai meeting is 
being jointly organised by ALL justice and peace-promoting 
individuals/organisations and St Xaviers College. We urge you to be there and 
also publicise it widely within your circle of family, friends and colleagues 
urging them to be there too.

Among the Key note speakers for the event are : Super Cop , Mr. Julio Rebeiro 
and Mr. Rahul Bose, welcome address by Fr. Frazer Mascarenhas, Principal, St

Dear Fr. Frazer,

You are absolutely right in the stand that you  and St Xavier's College have 
taken on Arun Ferreira.

The might of the Government cannot browbeat and do whatever it wants to do 
under the guise of alleged Naxalism of which Arun Ferreira is accused of.

If Arun Ferreira is guilty than surely he must be punished but that needs to be 
proved in the court of law which in this case after fours years and nine trials 
the state has not been able to prove.

I too do not support violence of any kind. Because the vast  majority are 
silent that  state tramples on the human rights of individuals which probably 
has happened in this  case.

We would like to second Fr. Frazer that the Chief Minister, Home Minister and 
the Governor must intervene in such a situation and help find the truth.

A call to others not to  remain silent and atleast demand this intervention.

This is with reference to `Innocent or guilty? Let the courts decide' (October 
16, Page 15). Media reports of the re-arrest of Arun Ferreira on charges of 
being a Naxalite have served to spread awareness of the possible problems human 
rights workers can face.

Instances abound of activists being targeted and even killed for raising their 
voices against injustice. It is safer to stay silent and the vast majority do.
Should an educational institution teach the theory of anthropology or zoology 
in a sanitised, secluded atmosphere or should it encourage critical thinking in 
a real-world context? St Xavier's attempts to conscientise its students by 
involving itself in social and political issues, especially concerning the 
disadvantaged. Our students have recently hosted meaningful discussions on 
campus with Aruna Roy, Prashant Bhushan and others trying to make a difference 
in our country. While the college has supported the anti-corruption movement, 
we have cautioned that democratic processes need to be respected, given that 
they have borne good fruit like the RTI Act.

Earlier this year, we hosted a public hearing on the Jaitapur issue, with 
academicians, activists and affected people bearing testimony. Last year we 
hosted a public hearing on the effects of global warming on the livelihood of 
the marginalised. And we have supported justice for Binayak Sen, who has 
devoted his life to tribals but is also accused of waging war on the State. 
SHOULD WE TEACH THEORY IN A SANITISED ATMOSPHERE OR ENCOURAGE CRITICAL .

THINKING IN A REALWORLD CONTEXT? Arun Ferreira may be guilty of what he is 
being charged with. But four years of jail, interrogation, narcoanalysis and 
trials in nine cases have not been able to prove the charge. Is a 10th case 
needed, with continuing denial of bail?

As principal of St Xavier's College, I have encouraged our students and alumni 
to petition the highest democratically elected officials of our state -the 
Chief Minister and Home Minister -to enquire into and intervene in this case of 
an alumnus. There is not a hint of support to violence in this.

St Xavier's lives by Christian values that abhor violence and encourage 
self-sacrifice. Along with academic excellence, involvement in issues of social 
importance, critically analysing them and raising public consciousness, are 
what an educational institution of repute tries to distinguish itself in.

Families & colleagues of whistleblowers arrested



Today at 4 pm more than 100 relatives and colleagues of whistleblowers were 
arrested from outside the BJP office. The families, along with NCPRI activists, 
were demanding that the BJP clarify its stand on the grievance redress bill and 
whistleblowers protection bill and assure them that the BJP will support the 
bills in Parliament.

The protestors sat outside the BJP office for more than 4 hours demanding that 
the BJP make a statement. No one from the BJP office spoke to the protestors. 
The protestors, mostly women, were arrested by the Police. A meeting of Mr. 
Modi with the BJP MPs was to start at 4:30 pm. The protestors were relatives 
and colleagues of slain whistleblowers Satyendra Dubey, Shimbu Bishnoi, Ram 
Thakur and were peacefully sitting outside the BJP office.

Activists Anjali Bhardwaj, Amrita Johri & Praavita Kashyap of the NCPRI were 
arrested along with the families of whistleblowers. 

The families were also simultaneously protesting outside the Congress office. 
B. K. Hariprasad, MP, addressed the protestors who said that Congress will make 
every effort to push these bills in Parliament. 

Aruna Roy, Nikhil Dey and Shekhar Singh of the NCPRI strongly condemned the 
arrest of the families and activists. They said that people protesting 
peacefully should not have been removed using force. People have been promised 
by all political parties that these 2 critical bills will be passed in the 
ongoing session of Parliament. It is a shame that Parliament is not functioning 
and that people who are demanding answers from political parties are being 
ill-treated. All political parties need to answer why critical bills are being 
made scapegoats in the political stand-off in Parliament.

Samhita Social Ventures, the UK Government's Department for International

aims to shed light on some of the pressing issues in the education sector while 
offering approaches and models on how the private sector can intervene. 





The involvement of the private sector is crucial as we approach a watershed 
moment in the Indian education sector. The recently passed Companies Act 
mandates companies to spend 2% of their profits on CSR. At the same time, the 
Right To Education Act seeks to ensure quality education for all. Strategic 
private sector involvement will not only address funding issues in the 
implementation of the RTE but will also identify and address structural gaps 
thus ensuring sustainable and quality education for the intended beneficiaries. 





The keynote speech highlighting some of the major issues in education in India 
will be delivered by Luis Miranda, Chairman, Board of Advisors, Centre For 
Civil Society (Founder and ex-President, IDFC Private Equity). The 3 panel 
discussions that follow are focused on specific issues in the education sector 
namely remedial education initiatives, school transformational models and 
models addressing critical gaps. The panel of speakers will have renowned 
experts such as Elizabeth Mehta from Muktangan, Usha Rane from Pratham, 
Vrishali Pispati from Mumbai Mobile Creches and professionals from the 
corporate world such as M.N. Sanyal from Thermax, Puja Dave from L&T Finance 
Holdings and Siddharth Ramalingam from IDFC.





The event will bring together various stakeholders such as companies, 
foundations, experts, NGOs, social enterprises, beneficiaries and the 
government offering insights on developing actionable ideas for CSR 
initiatives. The audience will consist of senior management from companies such 
as ICICI Securities, the Tata Group, Accenture, and Deloitte, representatives 
from corporate foundations such as Essar and Swades, leaders of NGOs such as 
Magic Bus India, Make A Difference, Educate Girls and Prerana and other experts

Police Reforms Watch is an Umbrella for the movement of various volutary groups 
and activists committed to monitoring the implementation of Police Reform. 
Towards this objective it will facilitate advocacy and interactive engagement 
at the level of the Government, Police, Media  and Citizens.
 

 The Police Reforms Watch is extremely dismayed at the order dated April 30 by 
the Home Minister /  Government of Maharashtra on the issue of transfers and 
promotion even as junior as a Sub-Inspector.

 

In a telling comment, the former Mumbai Police Commissioner Julio Rebeiro said" 
This new order - putting, as it does, all control of police careers in the 
hands of the politicians- effectively demolishes command responsibility for 
poor performance or criminal misbehavior. He has warned that  Maharashtra will 
now have a police force that is headed by an emasculated leadership and ruled 
and run by the political executive". 

 

Such an order will sound the death knell of operational- command - 
responsibility as the police will not be answerable to its Senior Officers but 
to the political class. This is bound to result in a less effective police 
performance to maintain law and order which is the need of the hour.

 

It is unfortunate that a progressive State like Maharashtra has hesitated till 
date  to implement the Supreme Court's  Directives on Police Reforms  in the 
Prakash Singh case of 2006. In bits and pieces a few of the said Directives 
have been implemented in a  purely cosmetic way and in no way it will enhance 
the impactful policing which is urgently needed.

 

The  very essence of a  healthy democracy is to provide functional autonomy to 
the Police  Institution whereby it could function efficaciously otherwise 
unwanted intrusion is a bane which helps in the subversion of the said 
institution. 

 

Police Reforms Watch therefore demands that the Supreme  Court Directives are 
fully implemented and urges the Home Minister /Government of Maharashtra to 
withdraw this unwarranted order. We do not want the political class to meddle 
with the running and functioning of the Police Force in Maharashtra.

 

In the meantime, we appeal to DGP Sanjeev Dayal not to resign and  that the 
public are with him and will support  him  in this campaign.

 

Police Reforms Watch will keep its options open for a public agitation if the 
occasion demands.

 

We will  also make the implementation of the Police Reforms  an election issue 
for the forthcoming 2014 elections.

  Police Reforms Watch and the Commonwealth Human Rights Initiative condemn the 
brazen and unlawful actions of BJP Member of Parliament (MP) from Mumbai Kirit 
Somaiya against the Navghar police, and demand swift action in this clear case 
of political intimidation and assault.  It is commendable that the police 
withstood the reported pressure in this matter and filed an FIR under IPC 
sections 332 (voluntarily causing hurt to deter a public servant from doing his 
duty), 353 (assault or criminal force to deter a public servant from his duty) 
and 506 (criminal intimidation).  It is imperative that the police continue to 
follow through, making sure this case is swiftly and properly investigated.  

  Mr Somaiya allegedly entered Mulund (East) police station in response to his 
BJP party workers, Parikshit Dhume and Vinod Khedekar, being summoned by the 
police in connection with a case of unlawful assembly registered in April.  
According to press reports, Somaiya confronted Inspector Sampat Munde alleging 
that his party workers were summoned without his being informed, threatened and 
assaulted him, and then left with his party workers in tow.  

  Any attempt to prevent or deter a public servant from doing his/her duty 
including use of criminal force and assault is an offence under the law and 
punishable up to three years of imprisonment. As part of investigative powers, 
the police have the authority to require someone to appear before them if they 
have reasonable grounds to believe the person has committed a cognizable 
offence. In this case, the police were simply doing their duty by summoning the 
BJP (and NCP) workers to question them in connection with the case at hand. Mr 
Somaiya’s actions are a blatant disregard of police’s lawful authority. 

  Dolphy D’Souza, Convenor, Police Reforms Watch, says, “There is a vital 
principle in law that no one can interfere with police investigation. This 
principle cannot have exceptions based on favouritism or power.  Obstructing 
investigation is a crime and must be treated as such in all cases, whether it 
is by an MP or a common citizen. The police will not be able to do a 
professional job and serve the people if they are intimidated by their local 
politicians”.

  This incident speaks of blatant political interference in policing. In bad 
tidings for Maharashtra, the recently passed Maharashtra Police (Amendment and 
Continuance) Act 2014 entrenches near total political control over the police. 
This law leaves the police at the mercy of politicians, and fails to put in 
place the police-politician relationship fit for a democracy.

  This case must be dealt with by effective investigation which is by the book. 
Any delay will indicate the weakness of the police and the abuse of position of 
the legislator. As concerned groups, we stress that this is not an issue of one 
institution against another or the supremacy of one over the other, but 
singularly about the primacy of law over all who live in India.

CHURCH OF OUR LADY OF ASSUMPTION

At the well attended Rally held on Sunday Oct. 21, Parishioners  of O.L. of 
Assumption Church, Dhanurkar Wadi, Kandivli west, staunchly opposed and 
demanded the withdrawal of  the land acquisition notice served on them for 
widening the Poisar Nalla/ River adjoining their premises.  Parents of children 
studying at St. Joseph's High School, and people from the region showed their 
support by applauding speaker after speaker who spoke on how injustice is being 
done to the more than 150 year old institution which is a heritage precinct. 

Mr. Lennon Miranda a local youth leader  gave a power point presentation of the 
chronology of the issue prepared by the Committee formed to deal with the 
situation.  Mr. Gordon D'Souza President of the Bombay Catholic Sabha projected 
how gross injustice was being done as there was a demand to take .5 m to 4 m of 
land from the premises right from the cemetery and playground and the space 
behind the church. Not only that but the plan prepared by the  Executive 
Engineer SWD includes an access road of 6 m within the premises for access the 
cleaning and maintaining of the nallah. This would take away some portion of 
the church and school building and take away the privacy of the institution. He 
demanded why the access road to the nallah was not planned from the other side 
where presently new constructions are coming up. 

Mr. Dolphy D'Souza immediate past president of the Bombay Catholic Sabha said 
that the community is always considered a soft target but in this case we will 
not take this lying down and we will  mobilise people from all Mumbai to  see 
that injustice is not done to the institution.

Fr. Gerald Fernandes parish priest expressed concern at the situation and was 
worried at the turn of events. He said that the church has already given land 
in the past without claiming any compensation but giving away land from the 
already depleted premises would affect the people very badly as the cemetery, 
the school playground and place behind the church was involved which would 
compromise the security of the institution.  Surrendering of the burial place 
would grievously hurt the sentiments of the parishioners as they contain the 
relics of their ancestors. He appealed to the elected representatives and the 
concerned  BMC officials who were present at the meeting to  withdraw the 
acquisition notice. 

Mr. Sanjay Nirupam the local M P assured the gathering that the more than 150 
year old institution  was a heritage precinct  and he would see that not even 
an inch of land would be taken away.

Sr. Fatima Fernandes Head Teacher of the Secondary Section of the St. Joseph's 
High School which  is on the premises said that the authorities should explore 
the option of cleaning and deepening the nallah which is badly littered and the 
main cause of the clogging.  

Mrs. Fatima Pereira Head Teacher of the Primary Section lamented that the 
school ground was already small and if it was further reduced in size, it would 
leave not enough space for children to play. 

Dr. Mrs. Geeta Yadav Corporator and Chairperson of the R South Ward Committee 
assured that she would take up the matter with the concerned authorities and do 
her best to prevent any space being taken from the institution.  

Mrs Parul Mehta Nominated Corporator to the MCGM said what has happened is 
unfortunate and she would see  that no injustice is done to the institution. 

Mr. Sanjay Nirupam announced that there would be a site inspection by the 
Deputy Municipal Commissioner on Monday Oct. 22, 2012 at 3 pm and he would also 
be present to see how the issue could be sorted out. 

The Parishioners of O.L. of Assumption Church will work in collaboration with 
the Bombay Catholic Sabha will work on the next course of agitation if the 
matter is not resolved soon.

The Christian community is truly a soft target as is evident from the following 
happenings and it is time for us to wake up and take a stand.

 

1.  Our Lady of Assumption Church and St Joseph's School- Kandivali West

 

The BMC issued an acquisition notice to the Church / School to surrender  parts 
of the Cemetery, School Ground and Church for widening of the famously  Poisar 
River which has now become a stinking Nullah [Gutter]  all because of the 
callousness of the BMC authorities.

 

The core of the Brimstowad Project is that the flow of the river [now a 
gutter]should be cleared so that the storm water flows clearly in the sea 
without any blockages or impediments which will cause flooding.  

 

Also the point to be noted is that this project was studied and a plan 
constructed in 2008, despite this  the  BMC and other authorities have approved 
constructions, just at the border of the nullah in numerous sites. The  amazing 
fact is that a bridge at Dahanukar wadi near the Church   recently constructed 
has a width which  is less than 38 feet besides it being low that will act as 
an impediment for the free flow of water. When questioned  why this factors 
were not taken into consideration, the BMC cited lack of funds , so the 
question is who are we fooling here ?. 

 

Hence there is no logic in widening the Nullah near the Cemetry /School / 
Church  side. 

And instead of addressing this issue the BMC wants to waste the tax payers 
money by demolishing existing structures and reconstructing at their cost what 
they can easily achieve by de-silting the nullah and preventing garbage/ debris 
 from being dumped as  now it has turned into a stinking nullah. 

 

Have the BMC understood the objective of the project or are they interpreting 
the same blindly, whereby a huge amount of money which can be used for needed 
projects is being wasted, just because someone cannot think clearly or do not 
want to?.

 

We stand to lose 100's of our graves of our ancestors, the Children numbering 
over 1700 lose a playground and the BMC cannot provide open spaces [ whatever 
empty spaces are left are usurped by unscrupulous builders in connivance with 
the politicians and authorities]. 

 

Also when the new church was constructed couple of years ago the BMC insisted 
that certain areas be demarcated and kept free for fire control and other 
regulations, now the same BMC is stating that they can over look the same in 
the name of progress. which means that in the name of progress all rules and 
regulations which are by the book can be  erased.so then why make such rules?

 

What purpose this widening will help for the smooth flow of water is a mystery 
because at Mith-chowky (Malad) a major chunk of the nullah space has been 
encroached under the very nose of the various authorities.

 

On two occasions the said church had given land in front of the church for road 
widening without asking / claiming for any compensation. Tomorrow they might 
ask the premises of the whole church including the grounds for other purposes 
which we can never foretell. BMC works in strange ways.

This church is an heritage precinct with a history of over 400 years.

 

2.  St Anthonys Church at Malawani, Malad West.

 

A similar notice of acquisition for road widening was issued by the BMC 
authorities. This is also an heritage precinct. 

 

While they want the church land for road widening,  exactly opposite the Church 
premises  they have  allowed constructions of residential / commercial premises 
for which permissions were given  as late as 2001.  

 

While the church authorities have made several representations they have fallen 
on deaf ears.

 

3.  Cemetery on the East side of the Western Suburbs..

 

On October 14, 2012 there was a massive rally at Kandivali East of over 4000 
Christians demanding their cemetery.

In 1996, land was allotted for a composite cemetery. But owing to the alleged 
negligence/ lapses of the BMC in not constructing the designated boundaries,  
this land was encroached upon. While the Muslim and the Hindu community got 
their burial grounds, the Christians had no place to bury their dead as it was 
encroached upon. The whole belt from Khar to  Dahisar  does not have a 
Christian burial ground. There are over 3 lakh Christians  and they dread death 
 because the cost of burying their  dear ones is expensive as the nearest 
Cemeteries at Charkop ,Malad West or Oshiwara,  Goregaon West which are  at a 
distances of   more than 5-15 kms. 

 

>From 2003 the United Christian Community Centre  has been agitating on this 
>issue.Everyone including  politicians promise. But when it comes to

Announcing a peace rally on December 01 at Kandivali to demand redressal of our 
grievances.

Re: 1. Withdraw acquisition notices against Our Lady of Assumption Church and 
St Joseph's High School, M.G. Road, Kandivali West.
  2. Withdraw acquisition notice   against St Anthony's Church, Malawni, 
Malad West.
  3. Implement the setting up of the Cemetry on the Eastern Side of the 
Western Suburbs without any further delay.

There was a special meeting convened on October 28 at Kandivali to discuss the 
following above three important issues and urging the concerned authorities to 
immediately sort out these vextious issues in favour of the  community.

The following was the resolution passed at the meeting " Resolved that the 
concerned BMC and other authorities must  withdraw the acquisition notices 
issued to Our Lady of Assumption Church and St Josephs' School, [these are also 
heritage precincts] for acquiring parts of the Cemetry, School and Church 
premises and work  for alternate methods for smooth flow of water in the so 
called 'Poisar River' which is now a stinking Nullah.

The said Church had also given land willingly for the road widening project in 
front of the church on  the past two occasions.

Besides, the notice issued to St Anthony' Church, Malawni, Malad West for 
acquiring parts of the land which includes heritage precints and the residence 
of the Priests and School Grounds  for road widening should also be withdrawn. 

The BMC must explore other means rather than the soft options of acquiring 
church land for their  faulty planning in allowing constructions to come up 
opposite the church for which permissions  were given as late as 2001.

On the Cemetry issue, in 1996 the BMC had alloted land for a composite cemetry 
at Kandivali East. However because of the lapses of the BMC in not building the 
boundary walls,  the land meant for the Christian cemetry was encroached.  
While the Muslim and the Hindu community have got their burial grounds, the 
Christian community had no cemetry build for them. Under the leadership of the 
United Christian Cemetry Committee has been vigorously pursuing the 
implementation of the Christian cemetry since then. The community has to bear 
the enormous costs of burial for the loved ones  as the nearest cemetries are 
located at Charkop, Malad West, and Oshiwara, Goregaon West a distance of 
atleast 10-22 kms. While promises were given nothing concrete was done. Why is 
this step motherly treatment to the Christians from the authorities?. Hence the 
authorties must implement the setting up of the Cemetry without any further 
delay.

We have already launched a signature campaign and the Youth of Kandivali and 
ably supported by the various Units of the Sabha in the different parishes  
have already collected more than 10,000 signatures till date which will be 
submitted to the Chief Minister of Maharashtra, Municipal Commissioner, Prime 
Minister and Smt. Sonial Gandhi, Chairperson of  the NAC besides several other 
authorities urging them to intervene to sort out  these issues.

It was also unanimously decided that we would organise a massive peace  rally 
on 01 December 2012   to demand the fullfillment of our just demands.

The meeting was attended by Shri Gordon Dsouza President, The Bombay Catholic 
Sabha and his team, Prashanth Pereira, the Youth Co-ordinator, Lennon Miranda, 
the Youth Activist, Youth and  Parishioners of Our Lady of Assumption Church, 
Representatives from St Anthony's Church, Malawani, Mr. Simon Serrao, Secretary 
of the United Christian Cemetry Community and his team and various other NGO's 
and  Activists .

DELEGATION MEETS MR. JULIO REBEIRO, FORMER AMBASSADOR AND POLICE COMMISSIONER 
OF MUMBAI WHO HAS PROMISED TO TAKE UP THE FOLLOWING ISSUES WITH THE CHIEF 
MINISTER, MAHARASTHRA AND THE MUNICIPAL COMMISSIONER, MUMBAI

 

1.Acquisition notice for Church lands/school ground/cemetery of Our Lady of 
Assumption Church, Kandivali West

2. Acquisition notice for Church lands/school ground of St. Anthony's 
Church, Malvani, Malad West

3.Cemetry on the East side of the Western Surburbs

 

A delegation met with Mr. Julio Rebeiro today, November 5, to discuss the three 
important issues listed above. 

 

Among the members of the delegation were Fr. Gerald Fernandes, Parish Priest & 
Fr. Byron Mendonca, Asst. Parish Priest of Our Lady of Assumption Church, M.G. 
Road, Kandivali West, Mr. Prashanth Pereira and Mr. Lennon  Miranda, Youth 
Co-ordinators, Kandivali Parish, Fr. Austin Norris, Parish Priest  and Adv. 
Ralston Fernandes,  St Anthony's Church, Malad West , Mr. Gordon Dsouza, 
President- The Bombay Catholic Sabha and Mr. Dolphy D'souza, Spokesperson- Save 
our Land- Committee, [SOUL]

 

Mr. Julio Rebeiro gave the delegation a patient hearing and has promised that 
he would take up the matters both with the Chief Minister of Maharashtra and 
the Municipal Commissioner.

 

The issues are listed below:

 

1. Our Lady of Assumption Church and St Joseph's School, Kandivali West

 

The 450 year old Church and its premises of Our Lady of the Assumption, M.G. 
Road, and St. Joseph's School [having a history exceeding 110 years] have been 
issued an acquisition notice to surrender parts of the cemetery, school ground 
and the Church for the purpose of widening the Poisar River which has now 
become a stinking gutter.

 

The core of the Brimstowad Project is that the storm water flows clearly in the 
sea. And instead of addressing this issue the BMC wants to waste the tax payers 
money by demolishing structures to widen the passage of the nulla.  Instead, 
they can save the money of the common man by de-silting the nulla, deepening  
and preventing garbage/ debris from being dumped, a much easier task. 

 

A plan was drawn up in 2008 to prevent flooding in Mumbai. Despite that BMC has 
approved constructions at the border of the nulla at numerous sites only 
recently. 

We stand to lose hundreds of the graves of our ancestors. The Children 
numbering over 1700 lose a playground. 

 

Also when the new church was constructed couple of years ago the BMC insisted 
that certain areas be kept free for fire brigade movement and other 
regulations. Now the BMC is stating that they can over look the same. 

 

2.  St Anthonys Church at Malvani, Malad West.

 

The BMC authorities issued notice of acquisition of parts of St. Anthony's 
Church, Malvani, Malad West, for road widening.

 

 

The Mumbai Municipal Corporation has itself approved the proposal for listing 
and including St. Anthony's Church with a grading of Grade II (A) in the 
recently published proposed heritage list. However they are bent on acquiring a 
structure built in 1872.

 

The BMC has called upon the Church to hand over its alleged open plot which is 
not at all open as the same consists of: 

a) The compound wall 

b) The structure in existence from 1872 which houses the blessed sacrament, the 
priests associated with the Parish, the Church Office and meeting place for 
parishioners c) Grotto of St. Anthony, the Patron Saint of the Church  

 

Here are the questions we have posed to the BMC:

 

a)   Is the Corporation entitled in Law to widen the road, whereby Grade II (A) 
heritage structures are bound to be destroyed permanently?

 

b)  Is the Corporation working for the benefit of the common citizens or is it 
colluding  with builders for the future development of the area, even when the 
entire area beyond Malvani Church is a 'No Development Zone' and is a sparsely 
populated area? 

 

 c)  INS HAMLA, a highly protected training base for the Indian Navy, has 
always objected to the development of the area from the national security 
perspective. Is the Corporation trying to jeopardize the security of the nation 
in any manner by the proposed development?

 

 3) We state that wherever the roads have been widened by the Corporation, the 
said roads have been usurped by illegal parking, hawkers, and commercial 
establishment like in the case of Kharodi slope, location much before the 
Church. 

 

4) It is our humble request that you do not destroy the structures itself  
proposed and notified by you in the List of Heritage structures until an unless 
our objections both to the listing of Heritage structure be heard and dealt 
with by the concerned authority  and until  our  objections pertaining to the 
issue of road widening and re-alignment h  are heard and dealt with in positive 
direction and in  the right perspective.

The Mumbai Marathon was  held on Sunday 20th January 2013. 

 

We the members of Christian Organisations joined in large numbers to cheer up 
the runners as well as highlight the issues being faced by the Christian 
Community in Mumbai. ( The issues which the community is facing are a) 
demolition notices for Holy Crosses for the 3rd time in 10years, proposed 
declaration of Gaothans as Slums, denial of access to SEEPZ Church, acquisition 
notices to Our Lad y of Assumption Church, Kandivali, Road widening affecting 
St. Anthony's Church Malavani, Road widening affecting 100 graves at Our Lady 
of Fatima Church Kirol, Non- alloting of land for cemetery at eastern side of 
the western suburbs, denial of 4 FSI for Gaothans, non renewal of Lease of 
Cross Maidan Holy Cross and the list goes on.

  

To highlight the injustices  caused to the Christians in Mumbai on various 
fronts, we stood with our banners highlighting our grievances and also cheering 
the participants of the Marathon . near Jazz by the Bay Restaurant, opp, 
Ambassador Hotel, Churchgate begining from 8.00 a.m. 

Photographs  are enclosed.  A brass  band was  also be in session to cheer the 
Runners and the spectators.
