Now , Mr. Felix Dsouza, brother of Slyvia and John Fernandes [brother-in-law]  
died yesterday and the body is right now in the JJ Morgue.

The family suspects foul play and are demanding a Post Mortem/ Investigation  
as the issue we understand is property related.

Mr. John Fernandes who is based in Goa and right now in Mumbai  can be

They are also seeking the help of the Mumbai Police to look into this matter. 
We have also addressed a communication to the Office of the Mumbai Police 
Commissioner seeking his help.

Felix's sister Audrey died when was 06 months.
My wife raised them up eversince.a few years back allwyn got married and kept 
his wife in the house,saying they would move out to their flat in borivli,as he 
was working in dubai.
My wife lived there all the while and moved to goa in 2008.allwyn lost his job 
and returned to india in 2008.
He has been harassing felix eversince.no neighbor is allowed to visit him as he 
said he would put a theft case on them.if anyone sends him food,he throws it 
out.he threw out expensive medecines that my daughter sent from Singapore.my 
wife has arranged for a tiffin to be sent to him daily.all his medical bills my 
wife pays.my wife cut short her trip and came from Singapore to Bombay,as felix 
was put in Bombay hospitalfor a week.she stayed in andheri and travelled to 
dhobi talao daily for the last 4 months,as she could not stay in her own 
house,to look after felix.allwyn uses abusive language,and his wife threatened 
my wife.she kept a maid to look after felix the whole day.she has been to azad 
maidan police station,but no luck,nobody is willing to help.I came to Bombay 
and sent my wife back to goa.
This allwyn beats felix,and he even told my wife he feels like committing 
suicide.sometimes he is not in his senses,and is too frightened to speak,as he 
may be beaten by allwyn.
My wife pays the rent and allwyn has no business to be there.he has his flat in 
borivli,and goes there every weekend.he is trying to put felix in an old age 
home,so he can have the house to himself.on weekends,he locks the house and 
felix is kept in the kitchen.a few weeks back,on a weekend,felix collapsed and 
was lying on the floor for 2 days.the neighbours had to break open the back 
door to get in.
This allwyn has told my wife he will break my legs.he abuses my wife in filthy 
language.he holds his private part and says he will rape her.he even said since 
I am old,he will come to goa and rape her in my house.
I would be very grateful if you can help us.

I didn't set out to be a children's writer. I had other
things on my mind in my teens and twenties. I had to grow up,
go out, compete in the academic or business world, embark on
a career, climb the organizational ladder, etc.

 And I did--working first as a lecturer and then in
 a bank. But then something happened that changed my
 life completely and turned everything I believed
 in, career-wise, upside down. It's been happening
 to women from the beginning of Time but somehow,
 for me, it was the greatest miracle possible: I
 became a mother.

And everything else now came second.

(In later years I read a lot about post-partum depression and
how protracted it can be00and there I was with an prolonged
attack of extreme post-partum euphoria, and I must admit that
over two-and-a-half decades down the line, it still persists.)

So, I resigned from the bank and set off on this great
adventure of bringing up a child. I was told I was being
ridiculous. I could take a year off and then get back to
work, like most others did. I was warned that I'd soon get
tired of 'sitting at home' and would seek the workplace again.

 But somehow that didn't happen. Because, late at
 night when the baby was asleep, I started writing:
 slice-of-life articles and short stories for
 adults. I wrote in longhand, in pencil, so that I
 could erase and re-word and polish my prose until
 it was time to pull out that old Royal portable
 typewriter and hammer at the keys.

In those days, everything went by post. We lived in military
cantonments with Army Post Office (APO) addresses, so
replies, acceptances, or rejections took a long time to reach
me--as did the cheques that came my way for these articles
and stories. Everything was addressed care of my husband and
went to his office--and it annoyed me no end that he got to
know the fate of my work before I did!

Meanwhile, my son passed infancy and became a delightful
toddler. We spent his waking hours haunting the small parks
nearby with our stately German shepherd--and we talked.

It was a never-failing source of delight to find that my son
actually hung on to my words and clamoured for my stories...
and soon became insatiable for them. Naturally, we soon
exhausted the stocks in the Army library, the books in my
collection, and the fund of tales that my mother had told me
of her childhood in Hubli with a large family and a close
knit community. So what choice did I have but to start
creating stories for him?

My son was not a hard taskmaster. I used settings he was
familiar with and characters he could identify with. If he
didn't like something in the story we would change it around,
if he disapproved of the ending we would work it out to suit
his tastes.

"If he likes my stories," I thought, "why not try a larger
audience?" So, I took the next logical step and wrote a few
stories and sent them to *Children's World* (the monthly
magazine of the Children's Book Trust) for consideration--and
that's when the going got tough.

 The stories were not snapped up. I was not told
 that I was an indigenous Enid Blyton or a Roald
 Dahl in the making. (This was the early 1990s,
 before J.K. Rowling conquered the world...)

But, instead of a simple rejection, one of those that say
'No' very politely, I got a long letter from the editor at
that time, Ms Vaijayanti Tonpe. She went over all the aspects
of the stories I had submitted: subject, characters, events,
language, etc., gave me detailed feedback on what could work
and what wouldn't and asked me to try again.

That letter was the best thing that happened to me in terms
of my first steps in children's writing.

I went back to those first two stories but realized that they
were pretty much beyond retrieval, so they were tossed out
and I wrote another short story, this time going for a topic
that was close to my heart--our German shepherd--and
imagining the rest.

It worked. The story was accepted. (It took a long time,
however--not because of the publisher, but because we had
shifted from one end of the country to somewhere midway--
where

CHRI and PRW question the need for new proposed security legislation 

Press Statement, 26 August 2016 



The Commonwealth Human Rights Initiative (CHRI) and Police Reforms Watch 
seriously question both the necessity and the justification for another new 
internal security law as proposed by the Maharashtra government’s Protection of 
Internal Security Bill 2016. We are particularly concerned with the wide scope 
of the Bill.  Created purportedly to deal with multiple security challenges, 
the State once again bestows more and more sweeping powers on the executive and 
the police, all without the requisite accountability. 



The omnibus Bill tries to deal with challenges of “terrorism, insurgency, 
communalism, caste violence, etc” all in one legislation and does not 
differentiate between the nature of the threats from each. Specific laws are 
already in place to deal with many of these matters. In order to bring every 
kind of threat under one law, the Bill relies on dangerously vague catch-all 
definitions, which are totally insufficient to further justify criminalisation 
or prohibition. It is equally alarming that the Bill gives the state government 
and police sweeping discretionary powers in the absence of sufficient checks or 
accountability for abuse of power.



Maja Daruwala, the Director of CHRI, states, “This Bill is ill-considered both 
in its intent and content. Every citizen should be alarmed at the sweep of laws 
like this which are designed for abuse. The greatest security the state can 
provide all of us is to make sure we have an honest efficient and law upholding 
police and a court system geared to give us speedy and fair justice. Certainly 
more and more laws only go to muddying the waters and reducing people’s power 
to face up to oppression”.  



The Bill has been released into the public domain ahead of the next Assembly 
session. This provides an opportunity for an exhaustive debate to discuss the 
necessity of any new law as well as the state of policing and security in 
Maharashtra.

On July 14,  2015, the Central Bureau of Investigation raided the home
of anti-communalism activist Teesta Setalvad, a week after the Union
Home Ministry transferred an ongoing investigation into her finances
to the elite agency.

The CBI filed a case against her last week for criminal conspiracy and
illegally receiving foreign funds, charges Setalvad denies. Though she
wrote to the CBI saying she was willing to cooperate with them in
every way, the CBI decided to raid her premises.

Setalvad’s organisation, Citizens for Justice and Peace, has canvassed
and litigated for the prosecution of cases stemming from the 2002
anti-Muslim massacres in Gujarat, especially the Gulberg Society and
Naroda Patiya killings.

The latter case led to the conviction of prominent BJP leader and
former minister Maya Kodnani.

The CBI raid on Teesta came barely a day before the appeals by those
convicted for the Naroda Patia massacre case were to be heard in the
Gujarat High Court, and just two weeks before the final hearing of
Zakia Jafri’s petition against the closure report of the Supreme
Court-appointed SIT, which cleared Narendra Modi of criminal liability
for the Gujarat riots. Setalvad has been closely assisting Zakia Jafri
with her petition and appeal.

The Wire asked a few prominent individuals for their views on the
matter. Is the CBI raid an attempt by the BJP-led government at the
Centre to intimidate activists opposed to it? Or is the agency merely
doing its job, investigating charges against Setalvad just as it would
in any other case?

know her and I know she will fight and we must help her. This just
shows that there is no difference between the old government and the
new one. The old one was trying to keep the guilty out and the new one
is putting the innocent in. If they say they are different from the
last one then I don’t know what is worse, keeping the guilty out or
putting the innocent in. This government will lose out on public
perception through this. Under no stretch will Teesta do something
illegal. If she has contravened a rule, then many such rules are
contravened and why aren’t they targeting everybody like this. I’m
sure she had no intention to take money without clearance and now they
have accused her of using it for personal purposes. Teesta has only
ensured justice be done. They have chosen Teesta specifically because
she has confronted them.

young woman goes to a police station in Hong Kong. She is the mistress
of a man who is a shipping tycoon and has gone to the police to

packet of cocaine is found in the woman’s purse.

I’m telling you this story because, of course, it doesn’t happen only
in India. But, as a phrase dear to the liberal section of our society
would have it, the brazenness is shocking. I’m talking now of the CBI
raid on Teesta Setalvad’s home. It is an instance of the ways in which
our prime institutions collude with power. I don’t, of course, have
proof. But proof of what really? As in the with the deaths of
witnesses in the Vyapam and Asaram Bapu cases, the needle of suspicion
points in only one direction.

Dear Madam/ Sir,

Today, Sunday, July 05 at Dharavi we organised the Police -Citizen interactive 
programme  in association with the All India Thowheed Jamaath for their womens 
wing. 

There were more than 200 women present for this meeting.

We had requested the Mumbai Police Commissioner to depute a Senior Woman Police 
Officer. The  Police Commissioner of Mumbai, Shri Rakesh Maria deputed Smt. 
Sujata Patil, Sr.  Inspector of  Police- Kherwadi Police Station for this 
meeting.  

Sr. Police Inspector, Smt Sujata Patil in her opening remarks said, the Mumbai 
Police is here to serve you and we definately pay more attention to the issues 
and problems of the children and women in particular.

In her lucid style she  also advised them and guided them that in case of 
difficulties, you need not go to the Police Station but  dial 100 so that the 
police could help those women who are in problems. One of the good ideas she 
shared is to always keep the telephone number of your local police station and 
the Beat Chowky so that prompt and quick action could be taken.

Dont be afraid to share your problems and the Police Commissioner Shri 
Rakesh Maria has given us instructions to attend to children and women's 
problems promptly. Mumbai Police are your friends, she remarked.

If there are concerns of any illegal things happening in your areas do bring it 
to our notice for prompt help.  Please support us in our work so that the area 
is crime free.

This was followed by an interactive session where some of the women raised 
various concerns and issues. One of the question raised was  Do you have to 
pay money  when we visit the police station to file a complain? That's the 
reason why many of us do not go to a police station when we have a problem . 
In reply, Sr. Inspector of Police Sujata Patil said the Government pays us our 
salary and you do not have to pay anything while filing your complaints. If 
such a thing happens please go to the Senior Police Officers in the police 
station and inform them.When we dial the police helpline 100 number, they ask 
us to identify ourselves, was another question raised by one of the 
participants. Smt Patil explained that when you call the number 100,  your 
number gets logged into the system and than it is accordingly passed on to the 
respective police station where the problem has happened. But she said there is 
nothing to get worried. Smt. Sujata Patil encouraged the participants to raise 
their various questions and were answered by her.

Overall this meeting  was an excellent method to build confidence in the 
citizens about the police and explain to them about their rights. The talk 
would also  help them to approach the police in the event of any problems. 

Mr. Mouddin , Trustee of All India Thowheed Jamath spoke about Islam being a 
religion of peace. Also he said we are safe because the Mumbai Police work hard 
to protect all citizens. We must seek their help when we have problems . He 
thanked the Mumbai Police for all its good work. 

In his concluding remarks, Shri Dolphy Dsouza urged the women not to be afraid 
but approach their respective police stations in case of difficulties and 
problems. Police are meant to attend and solve our problems. We also have to 
work in colloboration with the Mumbai Police in ensuring that we have  Better 
Policing for all of us. 

Dolphy also handed over the the Commonwealth Human Rights Initiative [CHRI] 
Police Handbook:  101 Things You Wanted To Know About The Police But Were Too 
Afraid To Ask to Sr. Inspector of Police, Smt Sujata Patil. Also  the 
participants  got a copy each of the Handbook. He said if there are specific 
problems that they must contact the Trustees of their Organisation for help and 
redressal with the concerned Police Station.

Among the other notable Police Officials were Smt, Gosavi, and Police 
Constables Ms Banu Tadavi and Ms Jayshri Dhoble from the local Dharavi Police 
Station. 

Sreeniwas one of our team members helped arrange this programme. The other team 
members who attended were, Bhavesh Pandya, Salil Rameshchandra and Stanley 
Dsouza.

We intend to organise many such Police -Citizen partnership meetings in 
different parts of Mumbai.

of Police -Smt. Sujata Patil for this programme.

URGENT PRESS STATEMENT


Malwani Police Station's notoriety for alleged torture and custodial deaths 
might cease to shock any more. Hari Chavan's death yesterday is yet another 
unfortunate addition to the list of deaths in a police station already facing 
Crime Branch probes for 2 similar incidents, one in 2011 and the other in 2013. 

Although the Crime Branch has initiated an investigation, it is imperative to 
keep the Sr. Inspector and other responsible personnel away from the police 
station, in the interests of a free and fair probe. 

DCP (Zone -II) B. Rajput's statement to Mumbai Mirror- that Chavan wasn't 
tortured and hanged himself by the sleeve of his shirt tied to a window grill 
because he was fearing arrest, beggars disbelief. 

With Maharashtra Police having  a record of having 23 percent of India's 
custodial deaths (333 instances between 1999 and 2013) but only 45 FIRs, 19 
charge sheets and ZERO convictions, the police can ill afford to let more of 
such incidents happen under its watch. 

NAGAR/POLICE REFORMS WATCH stongly condemns this latest incident.

 

Given the unimpeachable evidence of a ten year pattern of deaths in custody we 
urge an independent inquiry to probe not only this death but into the  pattern 
of deaths in Malwani and across Maharashtra that plague policing. 

 

We are indeed surprised that their frequency and numbers do not  appear to be a 
matter of concern to the police or to the government that is responsible for 
their performance. Deaths in custody in such numbers and  over such long 
periods cannot be explained away as aberrations or natural occurances. The 
public does not come to police stations to suddenly become terminally ill or 
commit suicide as their place of choice  This is precisely the reason that 
since 2006. the Supreme Court has insisted that Maharashtra set up a credible, 
independent and effective Police Complaints Authority to look into patterns of 
malpractice within the police.In response Maharashtra has still not instituted  
a Police Complaints Authority which the Chief Minister must do so  immediately  
now. The National Human Rights Commission must also  suo moto look into such 
cases. Slow or opaque measures in individual cases and lack of will to look 
into patterns of behaviour by existing oversight bodies such as the State Human 
Rights Commission amounts to condoning this pattern and consequent impunity.  

 

In January 2015 ,the Maharashtra Government  gave an undertaking to the Bombay 
High Court that it would install CCTV cameras in  all cells across all   police 
stations in Maharashtra . This has not been  done . We believe that unless this 
is done at the earliest the police/s impunity for custodial deaths would 
continue.

Moneylife Foundation's Samir Zaveri Railway Helpline on Saturday felicitated 
Constable Azim K Shaikh from Thane Police for preventing a catastrophic 
accident and disruption of railway service on 11 November 2014. After spotting 
a detached iron plate on the railway track near Parsik Tunnel, Constable 
Sheikh, using a red coloured bag rushed and stopped an upcoming local train in 
the nick of time. 

 

After presenting a plaque on behalf of commuters of Mumbai, Samir Zaveri, who 
has made it his mission to ensure that railway accident victims get swift 
attention, so that many lives are saved during the first ‘golden hour’, said, 
We salute Constable Azim K Shaikh for displaying rare courage and 
spontaneously responding to the dire situation, going beyond the call of duty, 
thereby averting a major disaster that has probably saved hundreds of lives and 
a massive disruption of the railways services.

 

Several prominent citizens and activists were present during the felicitation 
and lauded the bravery shown by Constable Shaikh. Some NGOs like Commonwealth 
Human Rights Initiative (CHRI) and Police Reforms Watch also sent an 
appreciation letter for Constable Shaikh. The appreciation letter sent by Maja 
Daruwala, Director of CHRI and Dolphy D’souza, Convenor for PRW was read out by 
Mr D’souza. (Mumbai’s former Commissioner of Police JF Ribeiro, who is also 
Chairman of Public Concern for Governance Trust (PCGT), also commended 
Constable Azim Shaikh for his alertness in the call of his duty in averting a 
train accident.)

 

Indian Railways, especially the Mumbai suburban railway network does a 
phenomenal job in transporting over 75 lakh people back and forth every day in 
an extremely timely manner. However, everyday 25-30 rail commuters meet with an 
accident and 10-12 of them lose their lives. This highlights why a large 
organisation like Indian Railways, with enormous pressure to maintain timing 
and schedules needs strong additional support from citizens and brave hearts 
like Samir Zaveri and Constable Shaikh.

 

Keeping this in mind, Moneylife Foundation set up the Samir Zaveri Railway 
Helpline (http://foundation.moneylife.in/?page_id=6196) to help railway 
commuters in distress. 

 

Earlier this year, the Samir Zaveri Railway Helpline sought urgent intervention 
from Mallikarjun Kharge, the then Railway Minister through former MP Milind 
Deora for reducing the gap between platforms and trains and for making 
available ambulances at all suburban railway stations.

discussion on good policing in the run up to the Assembly elections. This is 
despite the fact that good policing is an indispensable part of good governance 
which every contestant of every political party, and even Independent 
candidates, has been promising to the electorate.


  On its part, PRW has been undertaking persistent efforts to get the 
good policing manifesto across to candidates and political parties, and has got 
quite a positive response. In fact, some of them have unequivocally endorsed it 
and pledged their support 

  PRW / CHRI have already met with Ms Poonam Mahajan- BJP, Mr. Asif 
Bhamla -NCP, Adv. Godfrey Pimenta - Maharashtra Swarajya Party, Mr. Sandeep 
Desphande-MNS.

  At the Election Special by Headlines on October 07 at Dadar, when PRW 
team raised the issue, Ms Shweta Parulkar -Shiv Sena publicly confirmed that 
Shiv Sena was committed to implementing police reforms. At the Doordarshan 
Janvani on October 10 when PRW team raised the issue of Better Policing, Mr. 
Madhav Bhandari, Spokesperson-BJP Maharashtra said it emphatically that if they 
come to power, they would implement Police Reforms. Mr. P.K.Jain, IPS Retd and 
Vice-President-RPI also supported on following through on the Reforms and work 
with PRW .

  We have attached the copy of the Memorandum, manifesto to the 
political parties on Good Policing and the critique against the new law, 
Maharashtra Police Amendment and Continuance Act, 2014 and how it deviates from 
the Supreme Court directives. . These were handed to the concerned persons at

  Poonam Mahajan, Member of Parliament from Mumbai and General Secretary of 
the Bhartiya Janata Party [BJP] has assured Police Reforms Watch, Mumbai that 
she and her party is fully committed to the cause of police reforms as per the 
letter and spirit of the Supreme Court's directives. 

  In the course of her meeting  with members of Police Reforms Watch today, 
September 24 and some other citizens committed to good governance, Ms. Mahajan 
said that the Union Home Minister is very enthusiastic about police reforms, 
and so are the BJP governments in the States. 

   Police Reforms Watch handed over a memorandum listing a charter of 
demands for good policing and Ms. Mahajan took particular interest in CHRI's 
critique of the amended Maharashtra Police Act which the government has 
bulldozed through.  A copy of the memorandum ,  copy of the CHRI  critique, 
Actionable points for good policing and photographs of the meeting are attached.

  The very fact that the Bill, in gross contravention of the Supreme 
Court's directives, was passed in the Assembly without a debate or a 
consultation with the public and civil society shows the insincerity towards 
police reforms and accountability. Ms. Mahajan was in full agreement with this 
assertion of Mr. Dolphy D'Souza. Convenor of PRW, and reaffirmed her commitment 
to a joint endeavour. 

  Dolphy D’souza remark to her was “BJP , must  give us a clear picture of 
how they are going to give Maharashtra good policing. Police Reforms Watch and 
Commonwealth Human Right Initiative [CHRI]urge that a plan for better policing 
is in their BJP manifesto for the forthcoming Maharashtra Assembly Elections, 
2014.

  RE: Recent Molestation case  at Bandra and the harrowing experience of the 
Victim at 3 police stations:
Police Reforms Watch and Commonwealth Human Rights Inititiative [CHRI] 
demands stern action by the Police Commissioner by the erring Police Officers.
Just an apology and ordering a departmental enquiry will not do, we 
demand that the Police Commissioner orders to  file a case against the erring 
officers under Sec 166A  
[IPC]. An example should be made to send the message to the Police 
Force  that this sort of lapse and apathetic handling will not be tolerated.

  While it is encouraging that the Mumbai Police Commissioner Shri Rakesh Maria 
 is taking a special interest, apologising, and ordering departmental inquiry - 
if the Mumbai Police are truly sincere in taking the strictest action, FIRs 
under Section 166A (IPC) should be registered against the concerned duty 
officers of Dharavi and Shahu Nagar police stations for refusing to register 
her complaint.  She was complaining of molestation so it falls squarely as 
refusal to register complaints of gender-based offences and is a punishable 
offence.  An example should be made, by taking punitive action.  

  The police force is embarrassing its leadership: but its hard to blame the 
Police Chief when in the recent Maharashtra Police Amendment Law -2014, all his 
powers to command and discipline , transfers and postings are now vested with 
the Political Executive and Outsiders.

  But our appeal to the Police Commissioner in this case which is a clear 
violation of the law , that he should flex his muscles and file a case against 
the erring officers under Sec 166 A of the IPC or forever accept that he is 
acquiescing.

  We now await   action from you, Mumbai Police  Commissioner, Shri Rakesh 
Maria.

  Re: We welcome the decision by the Mumbai Police Commissioner to decline the  
former Police Commissioner's request for  extension to stay in the  quarters 
which he has been staying for over 22 years.

  It is also surprising that there are 20 or more serving officers who are 
holding on to quarters although posted outside. PRW demands that these officers 
 also vacate their quarters promptly  otherwise Police Reforms Watch will send 
them Get Well Cards

  Police Reforms Watch urges Police Officers to hold the highest standards and 
not take advantage of their position and be a role model for younger officers 
and the public.

  Why should the Home Ministery be involved in  case of Satyapal Singh. This is 
 purely an administrative issue ty which the Mumbai Police Commissioner should 
be taking care off. Police Reforms Watch demands that Operational 
Independence and Administrative  Responsibilities are handled by the Police 
which should be their domain. 

  The former Police Commissioner has reported to have said I will abide by 
whatever decision the government takes on this issue You have no choice Sir. 
You should have vacated the quarters long time ago. 

  The Mumbai Police must ensure that the Quarters is vacated immediately as due 
notice was given to the concerned officer earlier as otherwise he will get  the 
6 months time as requested because of red- tapism.

  Police Reforms Watch had in its press release of August 04 [Copy enclosed] 
urged the  Government  not to extend the use of the premises anymore .

POLICE REFORMS WATCH is dismayed at shocked at some of the unsavoury 
happenings about Policing in Mumbai
The new Law -Maharashtra Police Amendment Act-2014 is not the answer 
for Better Policing. 
A public meeting to discuss and chalk out citizen's  plan of action on 
August 12 at 5.30 p.m at Indian Merchant Chambers Hall, opp. Churchgate Station.
VOTE FOR POLICE REFORMS.

Police Reforms Watch is dismayed and shocked at some of the unsavoury 
happenings about  policing in Mumbai in the last two weeks. This has not  only 
resulted in a negative image of the Mumbai but also has affected the  comfort 
level of the citizens and more specifically women to approach the police 
authorities to redress their grievances.

On one side we have had the incident of the extortion bids by two of 
the Khar Police Officers . Have our police stations become extortionist dens? 
In the Khar episode, goondas were also part of this racket with the said police 
 officers in this alleged crime. 

On the other hand have our Police Stations become settlement courtsas 
was reported in one of the newspapers. There should be more Citizen-Policing 
initiatives to stem this rot.

We commend the Mumbai Police Commissioner in promptly suspending the  
Khar Police Officers and transferring the Sr. Inspector besides sending a terse 
message to all the police stations . Also another Officer from Bandra was also 
promptly suspended for his alleged romance fling with an accused, but are 
surprised why different standards have been applied to the DIG accused of rape? 

Are there two separate laws of enforcement one for the small fry and 
another one for the big  one?

The New Police Amendment Act 2014 is not really an answer to Better 
Policing.

Re: The former Mumbai Police Commissioner must vacate his official residence 
without any further delay  and set a good example to the Police Force in Mumbai.

 Follow the example of the former Union Home Minister, Shri Sushil Kumar Shinde 
who handed over the possesion of his Bungalow in Delhi within three days of his 
losing the parliamentary elections.

It is rather unfortunate that the former Mumbai Police Commissioner has clung 
to his official residence since the last 22 years thus depriving other Police 
Officers posted in that region the use of the premises.

We do not know why the Home Minister and Home Department of Maharashtra allowed 
such state of affairs when the former Police Commissioner for some years was 
not even posted in Mumbai.

What is disgusting is and we understand  that he has asked for an extension 
giving reasons for his children when he has another apartment in Mumbai which 
has been rented out. 

Moreso, he has resigned from the Police force to pursue his political career 
and currently elected as an MP.

The former Police Commissioner must learn from the example of the former Union 
Home Minister Shri Sushil Kumar Shinde also from Maharashtra. Setting a public 
example within three days of his losing the  lost the parliamentary elections 
in Solapur, he handed over the possession of his sprawling bungalow.

While we wish him all good luck in his new career , Shri  Satyapal Singh should 
 follow the example of Shri  Sushil Kumar Shinde and vacate the premises 
without any delay.

The Government should not extend the use of the premises anymore.

  Re: We condemn the despicable act of force feeding a Muslim Staffer of 
the Maharashtra Sadan Canteen by  the Shiv Sena M.P's .

  Will the BJP government have the courage to act against such 
disgusting behaviour? 

  It is terrible to contemplate how very few politicians are punished in 
India. 

  In this case the law makers have become law breakers. What example are 
they setting? Criminal proceedings must be initiated against them.

  Earlier there was a hue and cry by the BJP that UPA dispensation was weak 
and indecisive.

  Is the BJP government coward not to act against such bullying of a common 
hardworking employee irrespective of which religion he belongs?

  If an ordinary citizen had to indulge in such behaviour he would have 
been arrested by now. Is there a different law for Members of Parliament?

Dolphy Dsouza, Convenor Police Reforms Watch- Mumbai reactions:  POLICE 
REFORMS WATCH-Mumbai condemns the Governor of Maharashtra's decision to give 
his assent to the regressive Maharashtra Police Amendment Bill, 2014. It has 
been confirmed that the Governor has signed the Bill which was passed by both 
Houses of the Legislature on 14th June 2014, with no changes. The Governor has 
given assent even after meeting a civil society delegation led by Shri Julio 
Rebeiro, accompanied by Mr. Satish Sahney, Ms Maja Daruwala of the Commonwealth 
Human Rights Initiative (CHRI) and Mr. Dolphy Dsouza -Police Reforms Watch, 
which met him on June 30 to express how brazenly the Bill denigrates police 
reform. The delegation had urged the Governor to invoke his powers under 
Article 200 of the Constitution to send recommended changes for the 
consideration of both houses of the State Legislature.

This Bill, now set to become law, is not in the interest of the state. It 
is anti-police and anti-people. The political class has had its way. The right 
thing would have been for the Bill to amend the Maharashtra Police Act 1951 to 
incorporate the directives of the Supreme Court in the Prakash Singh case. But 
the Bill is brazenly designed to defy every single one of the Court's 
directives. Besides the stakeholders in this case, the Citizens were totally 
ignored before this Bill was passed. 

The public are going to bear the brunt of such a bad law which will lead to 
policing completely captured by political compulsions. 

PRW Mumbai expresses its grave disappointment at the failure of the 
Governor to use his high constitutional authority to prevent this Bill in its 
current form from becoming law. 

Our next course of action:

We will now take the campaign against the Bill in the people's court. We 
will organise meetings with citizens, various womens groups and ngo's to raise 
their voices against such a regressive Bill. We will also be interacting with 
the different political parties and their leadership demanding that they 
include a better law for policing in their manfesto. And if they come to power 
they will amend this bill which is not in the interest of the public for better 
policing for a safer mumbai/maharashtra.

We want to make this a poll issue and demand ABKI BAAR SACCHA POLICE 
SUDHAR.

Maja Daruwala Director of CHRI which closely monitors police reform said in 
reaction to the news that the Governor had signed the 2014 Maharashtra Police 
Amendment Act.  


 To say that the Governor has signed a law that goes completely contrary 
to the Supreme Court directions while pretending to comply with it is to say 
too little. This law is a disaster for the police and the public. It has never 
been discussed in public and is to my mind a fraud on the public.  It reduces 
the possibility of good policing to zero and in the end endangers everyone's 
security. All this pious stuff about ensuring better safety for women is an eye 
wash when you look at the brazen way the new law politicises the police. All 
the bad practice of interfering with the everyday functioning and management of 
the police has now been enacted into law. The Governor was wrong not to advise 
caution and reconsideration. It is an extremely sorry situation for a fine 
State like Maharashtra.

URGENT PRESS STATEMENT 

 

Latest National Crime Records Bureau [NCRB] data says Maharashtra tops 2013 
Crime Chart.

The response to rising crime has to be better policing. But the recently passed 
Maharashtra Police (Amendment) Bill2014 will lead to policing run by 
politicians. The Bill has to be overhauled completely through a participatory 
process. 

The latest crime figures released by the NCRB have Mumbai and Maharashtra at 
the top for 2013:  

· Highest number of custodial deaths in Maharashtra

· Mumbai ranks second in crimes against minors, while Maharashtra has 
most minors who fall foul of the law

· Highest number of railways crimes in Maharashtra

· Highest number of crimes against women in Maharashtra tops in crimes

· Mumbai is the second most unsafe city in India for women. 

To meet these challenges, the state's response must be better policing - 
policing which is unbiased, responsive and lawful. The state government will 
meet this by saying we are working towards this by pushing through the 
Maharashtra Police (Amendment) Bill 2014 to bring in long awaited changes.  The 
Bill was passed by both Houses of the legislature in the last session, and is 
now with the Governor for his assent.  

Police Reforms Watch Mumbai and the Commonwealth Human Rights Initiative (CHRI) 
forcefully state that this Bill is a fraud on the people and the process of 
police reform. The objective of the Bill is to amend the Maharashtra Police 
Act, 1951 to incorporate six directives on police reform laid down by the 
Supreme Court in 2006. But every directive has been systematically diluted or 
subverted in the Bill which formalizes excessive political interference in the 
day to day management of the police.

The Bill was passed with hardly any discussion both in the Assembly and the 
Council. There was zero consultation with the people of Maharashtra, and all 
indications are that the police leadership was either not consulted or ignored. 
The police rank and file across the state do not figure at all in the reform of 
their organization.  

Dolphy D' Souza, Convenor of Police Reforms Watch Mumbai, states, While the 
blame for this Bill stops at the ruling party dispensation of [Congress and 
NCP], we fail to understand why the Opposition did not put a spirited fight 
against such an obnoxious Bill. While the State and the City President of the 
BJP including the Leader of the Opposition [BJP] did raise some objections, 
they failed to build pressure to defeat the Bill's passage or have it referred 
to a Select Committee.  

Maja Daruwala, Director of CHRI, says, Police reform in the public interest 
cannot happen in isolation or haste. Maharashtra is in serious need of police 
reform, but reform which is done in consultation with both the police and the 
public.The process of drafting a new law must be given the widest publicity. It 
is our hope the Governor returns the Bill to the legislature and it is then 
referred to a Select Committee that can facilitate a consultation process.  

A citizen's campaign, led by PRW and CHRI, has been launched to urge the 
Governor to invoke his powers under Article 200 of the Constitution of India to 
withhold his assent to the Bill and send it back to the State Legislature for 
reconsideration and send recommended changes for both Houses to consider. We 
appeal to the people of the state to support our campaign for better policing 
for a safer Maharashtra.

  Mumbai:  

  It is indeed unfortunate that the government of Maharashtra has last week 
pushed through the Maharashtra Police (Amendment) Bill 2014 in both Houses of 
the Legislature. This hugely important law will decide the directions of 
policing in the state for future decades, yet the government has seen fit to 
pass it in haste without public consultation, and even at this date it is still 
to be seen on official websites.



  Under the guise of complying with the Supreme Court’s directives on police 
reform in the Prakash Singh case, the new Bill has been deliberately designed 
to defeat its intentions of giving the public a capable,well-managed and 
accountable police.  By diluting and subverting each one of the 6 directives, 
the Bill in fact formalises the very practices of unwarranted political 
interference with every day police management that the Court had sought to 
reduce. The Bill must be overhauled to be made fit for purpose.  



  The Bill presently awaits the Governor’s assent. We strongly urge the 
Governor to invoke his powers under Article 200 of the Constitution of India to 
withhold his assent to the Bill, send the Bill back to the State Legislature 
for reconsideration, and send recommended changes for both Houses to consider.  



  Speaking on the subject, Mrs. Maja Daruwala, Director of CHRI, says, “The 
Maharashtra Police (Amendment) Bill 2014 is totally unacceptable. We urge the 
Governor of Maharashtra to send the Bill back to the state Legislature for 
reconsideration. Policing is a serious business that affects the safety and 
security of all citizens. This Bill requires fundamental changes if it is to be 
in compliance with the Supreme Court's directives and have the possibility of 
reforming the police in the public interest”.

SO NO OPTION BUT TO SEND THE COMPLAIN BY  EMAIL TO YOU:

1) Taximen fleecing the customers at Dadar(E) station and also park the taxi at 
Dadar(E) station and play cards. When this was brought to the notice of the 
traffic constable at site, he first refused to take note of the drivers playing 
cards and after much insistence he was taken near the Maruti Eco taxi in which 
the drivers were playing cards. He refused to call law and order police nor did 
he take the number of the taxi,  inspite of the chowky being just on the 
opposite side. He told me to complain but he refused to accompany me to the 
police chowky.  

2) Though there is metered taxi lane in addition to pre-paid taxi lane, the 
metered taxi lane entrance and outlet  is blocked by parked taxis whose drivers 
take advantage to corner passengers by soliciting and charging or demandign  
exorbitant lump-sum amounts. It is very clear that the constables have a nexus 
with the taxi drivers. In today’s time through various citizens empowerment 
laws we can prove that there is a “corrupt practice” . There are many such 
customer soliciting drivers who park their taxis and go inside the railway 
station to catch hold of innocent outstation (including local passengers) and 
charge them a  lumpsum. This practice is prevalent both outside the passenger 
outflow from platform number 6 and also at the Dadar Terminus Juction area. At 
the Dadar Terminus Junction area the taxis are parked there just to get their 
turn to get such passengers. The taxis that are parked can easily be directed 
towards metered taxi lane which is outside platform number 6.

3) The constable to whom I complained his name plate was not visible as it was 
facing down and he refused to give his name. He said the name plate expense is 
done by him and it is not given by department. 

4) One of the taxi drivers shouted at me   “how to pass the  time when we are 
waiting, that is why we play cards” and “shall we come to your place to play 
cards” this all happened in front of constable, this statement gives clear 
message that the traffic police and law  order police know of this nuisance, 
which cannot continue with out abetment by stationed traffic policeman and law 
order police. What was of  further utter disregard is that the constable said 
go where you want to - whether Sr. Police inspector or to CM

5) Whenever the outstation trains arrive the constabulary stationed just sneak 
in the chowky giving a free hand to taxi drivers to go all out and fleece the 
passengers.

This is a daily affair at the Dadar station, we don’t have any option but go on 
complaining to various authorities. This seems to be a modus operandi of 
administration to frustrate the complainers. We immediately expect you to take 
action on the constable, we are ready to come to identify  the constable if 
need be. 



THIS ABOVE MATTER IS COMMONLY NOTICED AT ALL MAJOR RAILWAY JUNCTIONS IN MUMBAI

Police Reforms Watch, Mumbai and Commonwealth Human Rights Initiative , New 
Delhi are  saddened to learn reports that as many as 20 young men  have been 
admitted to various hospitals in Mumbai. Several others collapsed from 
exhaustion during a 5 km physical endurance run  for getting into the police. 
Tragically Three have already died. This brings into question the ethos of the 
service they are joining. 


Yes a certain height and physic is necessary  But anyone who has ever dealt at 
policy level about improving the police agrees that physical tests cannot be a  
priority for modern day policing. The British were looking for tough young men 
to beat up the natives, what are we looking for? The same thing? Modern 
policemen and women above all need to be educated, psychologically tested for 
being law upholding and committed to public service. These people, often from 
poor families desperate for employment need to come into an enabling 
environment that nurtures their best talents and creates friends and protectors 
for the people.

Mahararastra State must all compensate those who lost their lives and 
hospitalised for treatment without much delay.

We urge radical changes in the way police are recruited. We have to fix 
policing now.

URGENT PRESS STATEMENT: 

Re: Commonwealth Human Rights Initiaitive [CHRI ], New Delhi  Police Reforms 
Watch [PRW], Mumbai demand that better policing for a safer Maharashtra is not 
an option anymore. Citizens of Maharashtra will judge  the Government and the 
Politicians on this when they vote in this State elections.

.The UN recommends one police officer for every 450 citizens.  Maharashtra has 
a shortfall of 23,776 officers. Even if every sanctioned post were filled there 
would still be only one officer for every 618 citizens.  By contrast Delhi has 
one officer for every 251 citizens.

 Now we hear authoritatively that there   that there are 10 police personnel 
for each person designated a VIP in Maharashtra.  812 police personnel guard 84 
VIPs. No doubt the orderly system of having subordinate policemen in the 
exclusive service of seniors eats up another significant number. Can this be an 
acceptable level of police planning? 

Maharashtra has undertaken recruitment drives to add up to 14,000 officers  but 
if they are  to join the  bodyguards or the cadre of poorly trained Jeeves's, 
additional man power may change very little.  

 Governments have a  fundamental duty to keep people safe.  But the crime graph 
is growing all the while. Atrocities against Dalits are on the rise, with over 
two thousand cases registered in 2013.  Women are the victims of crime - 
endlessly. The police are blamed but the distortions in recruitment manpower 
and deployment mean that  policemen on operational duties do double and triple 
shifts without the necessary forensic or legal knowledge to win the war on the 
streets. This is a unfair on both to the police and the public. 

 

If, as the Supreme Court required,   Maharashtra had a bipartisan independent 
state security commission  that made sure that  police performed better and had 
 solid long and short term plans to make them fit for purpose with adequate 
money, equipment, manpower, techniques, reasonable conditions of work all this 
could be cured. The police deserve this. 

 Better policing for a safer Maharashtra is not an option any more. It is a 
necessity. A beginning must be made. Politicians must show the political will 
to create positive changes and not resist ideas that will make policing better 
and more accountable.  The people will judge them on this when they vote this 
election.

Police Reforms Watch [PRW] invites you to listen to the interesting findings by 
mass communications students of Xaviers Institute of Communication following a 
learning visit to four Mumbai police stations: Azad Maidan / Gamdevi / Colaba/ 
Chembur 

Recently, PRW addressed around 45 students on the subject of Police Reforms, 
accountability and functioning of the Police at a session. 
Many of these students had never visited a police station before. As part of 
the follow-up to the session, the students volunteered to divide themselves 
into groups and visit the following police stations and meet police officials 
to discuss various concerns. 



They came up with some very interesting findings: 




1. Many of the Police personnel are often not aware which IPC sections to be 
applied to the type of crimes/. offences committed . Police also say that now 
there are more white collar crimes  and therefore many of them are not 
conversant with laws pertaining to such crimes.

2. Very few police stations personnel have had re- fresher courses. They are 
also not aware of  changes like the Maharashtra Police Ordinance or any other 
developments.

3. They also suggested it would be useful if the Government or Social Sector 
sets up a Helpline which could be used by the police and citizens to discuss 
application of law for crimes etc.

Police Reforms Watch [PRW] and Commonwealth Human Rights Initiative 
[CHRI] are  extremely dismayed at the delay in appointing the Police 
Commissioner for Mumbai. The city's police force has been headless for the last 
5 days.This opens the city to security risks and makes it  more vulnerable to 
crime and public order problems. Better policing, with the best leadership in 
place, is the need of the hour every hour. 



 We demand that the Government of Maharashtra appoint a police 
chief for the city  immediately and in accordance with the Supreme Court's 
orders in thePrakash Singh case. We point out once again that  the state 
government has not complied fully with the 2006 Supreme Court directives on 
police reform. It requires the state to appoint the  police chief in a more 
transparent manner on the basis of objective criteria. This has not been 
followed at all. 



Police Reforms Watch and Commonwealth Human Rights Initiative also 
urge the Maharashtra  State government to sincerely comply with the letter and 
spirit of the now 7 year old directives of the Supreme Court.

The increasing public discontent with policing reflects on the 
political executive governing the State.  We point out that  neglect for 
people's safety and security, especially the safety of women,  is going to be 
an issue. We therefore strongly urge  the state government to institute a 
public review of the working of the police and undertake an area by area survey 
of public satisfaction with the police upon which to base future policing. This 
policing must be law upholding,  responsive, efficient and unbiased. The need 
for police reform is too important to ignore and too urgent to delay.

been complied with at all.  

 

Police Reforms Watch and Commonwealth Human Rights Initiative  therefore urges 
the state government to comply fully with the Supreme Court directives.  We 
also urge that the Police Commissioner is appointed with no more delay and at 
least on the basis of objective criteria in the absence of a process for 
selection. 



The need for police reform is very urgent for our city and our state. But this 
can only be police reform which is worthy of a democracy and speaks to the 
needs of the public. We will make this an election issue for the forthcoming 
2014 elections.

WOMEN'S COMMISSION. DEMANDS THAT ALL POLITICAL APPOINTEES TO COMMISSIONS IN THE 
STATE MUST BE STOPPED FORTHWITH  AND EMINENT CITIZENS SHOULD BE APPOINTED 
INSTEAD FOR EFFECTIVE AND SENSITIVE FUNCTIONING TOWARDS THE CONCERNS OF THE AAM 
ADMI. 



It is unfortunate that a Member of Maharastra Women's Commission makes sexist 
remarks against Women and we condemn it.  Such comments are insensitive and its 
shameful that it should emanate from a woman,  Dr. Asha Mirge. The Womens 
Commission including Dr. Asha Mirge is supposed to uphold the dignity of women 
and work towards justice for them.

We demand that the Government dismiss such a  member.

The sham of appointing political appointees to all Commissions must be stopped 
forthwith by the Maharashtra Government.

We also demand that members of all Commissions which represents the interests 
of the aam admi should not be political appointees but noted social activists 
and eminent citizens who can articulate the issues and the problems of the 
concerned segments that the Commission represents.

We also  demand  that POLICE REFORMS need to be implemented by Maharashtra 
State without any further delay.

We thank Shri Ratnakar Gaikwad, Chief Information Commissioner for immediately 
intervening with the Chief Secretary of Maharashtra. We also thank Shri.  
J.K.Banthia, the Chief Secretary for acting promptly on the issue of security 
to the RTI activists. This has been widely reported in the news media today, 
October 13, 2013.

We also thank Mr. Julio Rebeiro, former Mumbai Police Commissioner and Trustee 
of PCGT who had also taken up the issue wih the Police and concerned officials.

Dear Shri Banthia,

Of late,there has been sharp increase in number of assaults on RTI activists. 
The recent assault on Ms Deepti Ghosal, RTI Activist and  Student  of Mira Road 
is a cause for serious concern. As you are aware, the effective implementation 
of RTI Act depends among other things on giving adequate protection to whistle 
blowers/ RTI activists who expose the vested interests and corruption in Public 
Authorities. Unfortunately, Govt has so far not taken effective and adequate 
steps in the matter.

I would like to bring to your notice , a resolution passed in the meeting of 
the Central Information Commission held on 13.9.2011 chaired by the then Chief 
Information Commissioner, Shri Satyananda Mishra
The Central Information Commission expresses regret and takes note of the 
reported killings of and assault on the RTI users across the country. The 
Commission underlines the need to take urgent steps by the respective 
Governments for the safety and protection of the RTI users. The Commission 
strongly believes that it is the duty and responsibility of the respective 
Governments to safeguard the life and liberty of the RTI users for which 
purpose they should invoke the relevant penal provisions for the prevention and 
detection of such heinous crimes..
This commission therefore requests the state govt to take urgent steps in the 
matter by issuing suitable instructions to Director General of Police, 
Maharashtra as well as to all Commissioners of Police to take proactive and 
effective steps to give protection to RTI Activists in the state.

RE: Activists wait from 7.30 a.m today, October 05 to meet with Dr. Satyapal 
Singh, Mumbai Police Commissioner outside his residence to discuss some 
contentious issues. Activists told to meet him at the Grievance Day being held 
at V.P. Police Station which they did today, October 05 at 11.00 a.m.

Police Commissioner says, Natural justice must be done and documents including 
status and compliances as requested should be given without any delay. Will 
speak with the Addl. Commissioner, Western Zone, Shri Vishwas Nangre-Patil to 
do the needful. [Tried to call in our presence but Mr. Nangre-Patil's line was 
busy]. Police Commissioner requested us to meet with the Add;. Commissioner. We 
waited the whole day but there was no call from his office for this meeting.
Addl. Commissioner Nangre-Patil says Activists should be helped and protected 
but unfortunately, Local Bandra and Khar Police Station differ from their 
Superiors and refuse to follow instructions.

If this is how the Police treat Activists what must be  happening to the common

There was some excitement when three activists, Ms Aftab Siddiqui, Chairperson, 
ALM 144, Ms Roshni Shaikh  and Mr. Dolphy Dsouza, Convenor -Police Reforms 
Watch were at the gate of the residence of Shri Satyapal Singh, Police 
Commissioner of Mumbai today, October 05 at 7.30 a.m.

The previous day, Ms Siddiqui had handed over  a personal note to the Security 
of the Police Commissioner at his residence that we would like to meet with him 
tommorrow, October 05 to discuss the contentious issues.   

We were told that we could meet him at the Grievance Day which is being held at 
V.P.Police Station, Charni Road, October 05 which the activists did. The Police 
Commissioner gave a patient hearing and said that Natural Justice should be 
given and relevant complaince reports should be given without any further 
delay. He said that he would speak with Mr.Vishwas Nangre-Patil, Addl. 
Commissioner, Western Zone, which he tried in our presence but the line was 
busy. He asked us to meet with Mr. Nangre- Patil so that the needful could be 
done. But there has been no call for this meeting from his office till now.

Ms Aftab Siddiqui explained the sequence of events to the Police Commissioner 
and why finally we had to meet with him to seek his intervention.. 

If the concerned police stations do not follow instructions of two of the 
finest officers namely, Addl.Commissioner Vishwas Nangre Patil and DCP Cherring 
Dorje with whom  she was following regularly what hope is there to resolve such 
contenious issues some of which are pending since the last 3 years. 

In reference to Bandra West Police Station, Item  no 02 of 11/08/13, the Adddl. 
Commissioner Vishwas Nangre-Patil during the meeting on 16/09/13 issued a Memo 
to ACP Mr. Suresh Marathe and has also re-opened the Enquiry to give full 
fledged justice. The Enquiry no is 352/13. We thank him for his intervention.

ALM 144, 33rd Road, Khar  and Police Reforms Watch  demands that information 
pertaining to the status, compliance reports of these cases as earmarked in the 
detailed note should be  given without any further delay. The said Memorandum 
has also been  given to the relevant police stations as also Add.Commissioner, 
Shri Vishwas Nangre Patil and DCP Shri Cherring Dorje. 

We also need to put on notice that if this is not done, we will have no choice 
but to escalate the protests outside the DGP's  and Home Minister's residences. 

Is this too much to expect from the Police Stations. If from a data from one 
complainant, who has been following since the last 3 years,   so many cases are 
un-resolved, what about the others??

The Home Minister the other day remarked Let every citizen give one minute to 
the City but here 3 years have passed by yet no resolution to the issues.

  180. Though, the matters are closed in consonance with the directions as 
above issued in public interest, there will be liberty of seeking further 
directions as and when required and, in particular, in the event of any 
difficulty arising in implementing the directions.

  The MMRDA is in the active process of preparing the Development Control Map 
and Rules for Mumbai. Noise pollution is an important factor while determining 
placement of various infrastructure and establishments and it would be 
appropriate to take noise into account while permitting any change in Rules 
which would affect noise pollution levels in Mumbai (already the noisiest city 
in the world). Therefore, any decision to allow them longer hours for certain 
establishments can only be determined after a thorough planning exercise 
including a noise map.


  It has been proved beyond any reasonable doubt that the presence of an 
establishment such as a restaurant or pub in a Silence or Residential Zone 
would lead to increased use of horns and consequent noise pollution. Citizens 
and citizens’ groups have actively represented against such noise pollution. In 
addition the issue is of law and order and safety of the Citzens needs to be 
looked into. Is the Police geared up for maintaining law and order in such 
situations?
  We  request that the decision to allow restaurants and pubs to remain open 
all night, which presently rests with you, should be taken in accordance with 
the direction of the the Hon’ble Supreme Court of India. No restaurnats/pubs 
should be permitted to remain open all night in any Silence or Residential Zone 
of Mumbai. In this case also the RTI Act Section 41(c), 4(1)d, 4(2), 4(3), 4(4) 
provision is applicable before taking any decisions for applicability of law)
  The Mahiti Adhikar Manch, NCPRI (National Campaign for People's Right to 
Information, Maharashtra RTI Council, Police Reform Watch, Watch Dog 
Foundation,Sahar Citizens Forum and SOUL( Save Our Land) believes that in a 
democracy all laws must be made or amended with the consent of the people after

It was heartening to observe that alteast the Chief Minister finally decided to 
reduce the neta cover so that those cops would be  available for ordinary 
citizens.

We compliment the Chief Minister for this right decision although delayed but 
never late.. 

We want to remind the Chief Minister the shortfall of 7403 police personnel 
should be filled up as soon as possible.  To add to this is in 2012,  28420 
police personnel were deputed for VIP security. Chief Minister Sir, this 
deployment of VIP security should also be looked into.

We urge the Chief Minister to finalise the transfers of Sr. IPS Police 
Officials  and not to leave it to politicking and unnecessary speculations.

As citizen's we are shocked at the complete callousness of the administration 
in looking after our safety. At any given time only 20% of the police force is 
available to ordinary citizens.  This means that the effective cover for one 
person is .021policemen per person( or 21 policemen per lac population). The UN 
recommended minimum is 220 per lac population. The VIPs on the  other hand has 
1 policeman or more  for every one VIPS. 

Providing policemen for unnecessary security to a few very privileged people is 
costing us our lives. This has to stop.   

The city of 1.3 crores deserves to have well trained law abiding boots on the 
ground available on call for everyone going about their daily business not to 
create spurious special cases. Rather than making urgent changes in policing so 
that it can be an effective service for the public the primary concern of every 
government in power has been to make sure that the police keep doing their 
bidding. 

For 7 years Maharashtra government has resisted the Supreme Court's police 
reforms package as well as the recommendations made by former police 
commissioner Mr Julio  Rebeiro and others.  We as people of Mumbai demand that 
police reforms NOW! When you fool around with Police Reforms, you are fooling 
around with Women's lives.We want better policing. No Police Reforms No Safety 
for Women. No safety for you and me. 

 The lack of Political will is not only obvious, but also suspicious. It 
therefore becomes more imperative and we demand  that POLICE REFORMS need to be 
implemented by Maharashtra State without any further delay.

We are surprised and dismayed  by the statement  of the Chief Minister 
Prithviraj Chavan  widely reported in the press , August 29, 2013 where the  
CM says absolute implementation of police  reforms is not possible



It appears that the Maharashtra Government either does not have the political 
will or does not want to lose the control of the management or resultant  
mismanagement of  police affairs of the State.



A day before the Prakash Singh case on Police Reforms came up for hearing in 
the Supreme Court on July 17, 2013, the Maharashtra State Government on July 
15th promulgated the order for setting up of a Police Establishment Board and 
delegated powers of the transfer of the police personnel to the said Board. 
This was as it should be.



In addition a week before, the Maharashtra Government had already set up the 
Security Commission headed by the Chief Minister. Further, the State announced 
the setting up of the Police Complaints Authority . 

All this was on paper to appear compliant before the court.  Please see the 
relevant GR's attached.

  Now suddenly there is a volte face by the Chief Minister,  who now asserts 
that  the absolute implementation of the police reforms is not possible.



  The Chief Minister is misinterpreting what being 'responsible' as a 
government means. It does not mean direct control over the management of every 
agency created by the State. The cabinet does not try to  manage thousands of 
government services it is responsible for  through managing postings transfers 
and other employment matters directly. So why  the police? 



  The  CM and the cabinet must  lay down general policing policy;  provide 
support to make the police fit for purpose and monitor its performance. One 
part of doing this is to choose a fine police chief out of a panel made up of 
the most meritorious people; and then let him choose his own officers through a 
transparent process based on clear guidelines and criteria that looks fair to 
his own men. Then let him get on with making Mumbai a safer city through 
upholding the law and by lawful means. 



  If the CM and the cabinet feel they are 'responsible' for administering and 
managing the police and so must take away the powers of the chief then  we have 
two questions: Will they all resign when there is a gangrape or a terrible 
murder or crime statistics go up and up as they are doing now? Second question; 
why have a police chief at all if he can't be trusted to run his own 
organisation, choose his team or do the job you have chosen him for. 



  It would be pertinent to quote the former Police Commissioner Julio Rebeiro , 
Bombay was safe. Is Mumbai safe? Where I disagree with him[ Home Minister 
Mr. R.R.Patil] is about Police Reforms. If introduced in spirit these should 
help him to have a more professional police force. Corruption will decline by 
more than fifty percent overnight and the quality of policing will improve if 
the reforms go through. His colleagues in his own party, however are not 
interested. They want to control postings and transfers. And they do not care 
if the current dispensation does not induce fear of law in the minds of rapists 
like the boys involved in the Shakti Mill episode[ DNA-Aug29,2013]



  Chief Minister Sir, we do not want lamentations but Action Now to implement

its citizens.

Once again in light of the sickening gang rape of the photo journalist, Police 
Reforms Watch, CHRI, Watchdog Foundation, [SOUL], Mahiti AdhikarManch demand a 
full overhauling of policing in Mumbai NOW!   We condemn all such  heinous 
crimes against women and humanity. 

In response to this unfortunate crime, the Hon'ble Home Minister spoke that he 
would  ensure to provide security to the journalists. We want to remind the 
Home Minister that against the sanctioned strength of 41,401 police force of 
the Department, there are only 33,998 police men. A clear shortfall of 7403 
personnel. To add to this is in 2012,  28420 police personnel were deputed for 
VIP security. . In addition  more than 2000 police personnel are deployed for 
providing security to VIP /VVIPS.

Over 80% is deputed to providing unnecessary security to VIPs.  As it is the 
total number of 33,998 is already 20% less than the sanctioned strength. This

has taken 3 years for the government to sanction Rs 15 crores into the 
investigation budget after bitter complaints from police personnel that they 
have to spend from their own pockets when travelling in connection with cases 
under investigation.

is costing us our lives. This has to stop.   Knee Jerk reactions such as hence 
forth providing police cover to journalists on assignment is a completely ill 
thought out and inadequate cure for the much larger problem of deteriorating 
safety of women in particular. We ask, will the Home Minister provide a 
policeman for every child that goes to school,  or every housewife that goes 
marketing, or every lawyer, doctor, mill and construction worker ?

 There was a  news items in one of the publication recently  that the 
Maharashtra govt. has filed a reply in the Supreme Court against this Judgement 
on Police Reforms  which states: 
All the directions contained in Prakash Singh's case relate to the executive 
powers and functions of the state government and they can only be exercised by 
the governor on the aid and advice of council of ministers. This is basic 
constitutional scheme and, therefore, recommendation of any authority can never 
be binding on the state government,

  And did this wisdom dawn on the Maharashtra Government after 7 years, what a 
shame.



Supreme Court Judgement on Prakash Singh has come in the year 2006. The 
Maharashtra Government  had not done anything on this till the recent ultimatum 
given by Supreme Court. But what is important is that National Police [NPC] 
commission's report was  submitted in 1980.  There are many other reports on 
Police Reforms after that. The Government . has  done very little on this till 
the SC prodding. So after 33 years of NPC report, if the govt. has to do 
something on this then it should be ashamed for taking such a stand.  And mind 
you this not the end of Police reforms since many more things can be done based 
on these reports.

 The lack of Political will is not only obvious, but also suspicious. 

Supreme Court has to uphold the constitution whose preamble states that 

WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a 
SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its

RE: Delegation meets with Ms Priya Dutt, Member of Parliament to seek her 
support to NO TO RTI AMENDMENT today, August 16.
Citizens have condemned  the move by the Government to immunise 
political parties outside the purview  of the RTI by amending the RTI Act. 
Ms Priya Dutt assured the delegation  that she would address these 
issues with the Government, Party and Smt. Sonia Gandhi, Chairperson of NAC.

A delegation comprising of : Mr. Narayan Varma, Jt. Managing Trustee, Public 
Concern for Governance and Trust [PCGT], Ms Shyama Kulkarni [ Trustee - AGNI],
Mr. Mohammed Afzal, RTI Activist and Member of Police Reforms Watch, Mr. Sunil 
Ahya, RTI Activist, Mr. P.K. Mukerjee, Citizen Activist and Dolphy D'souza, 
Convenor, Police Reforms Watch met with Ms Priya Dutt.

The delegation apprised her on the following:

1. In the Parliament in 2009, the Concerned Minister on the Floor of the house 
had  assured that no amendments would be carried out without  consulting the 
Stake Holders i.e. Citizens and Civil Society. In 2012, the Cabinet also 
assured that there would be  no further amendments to the RTI. 
We emphasised that Promises need to be kept and not brushed under.

2. The delegation impressed upon her that the Order of the CIC to include 
political parties in the ambit of the RTI in the long run would benefit the 
political parties as it would rid them of all vested interests. It would add to 
the transparency and accountability in strengthening democracy. Hence there was 
no need to pursue such an amendment.  It appears the Political parties are 
frightened by this order which is misplaced and they are rushing to amend the 
sunshine law.

3. In the current situation no consultation has been carried out with the Stake 
holders hence we suggested that this legislation should be referred to the 
Standing Committee of Parliament   to enable the civil society to also react 
and be part of this process as is the normal thing done for better democracy.

4. The whole process of such a legislation / Amendment is violative of the RTI 
Act , Sec 4 [i] [b] [vii] which inter alia states:
The particulars of any arrangement that exists for consultation with, or 
representation by the members of the public in relation to the formulation of 
its policy or implementation thereof:  {This has not been done thus far}.

In conclusion we emphasised the point that there was no need to amend the RTI 
act, as the CIC order on Political parties would encourage deep participation 
of the citizens and strengthen democracy.

While the UPA Government has been heralding that RTI has been one of their 
biggest achievement in Governance, on the other side the same UPA is trying to 
muzzle the Act.  This is rather sad and dissapointing and does not augur well 
for the UPA. 

Ms Priya Dutt assured the delegation that she will take this issue up with the 
Government, Party Leadership  and Smt Sonia Gandhi the Chairperson of NAC.

In October 2012, the Government gave an assurance to the people of India in a 
Cabinet meeting that it would not amend the RTI Act. 

This very Cabinet has now gone back on that commitment and is preparing to 
amend the most popular Act which it has enacted. 



Various political parties have ganged up to curtail the Citizen’s RTI, since 
they are unhappy about the Central Information Commissions decision requiring 
them to provide information to citizens under RTI, which they are bound to, as 
they are answerable to their electorate and citizens. 



Citizens feel betrayed and are agitated at this assault on their fundamental 
right and have decided to organize various protests across the country against 
this on 6 August. Mumbaikars have decided to hold a public meeting on

My Dear Member of Parliament,

I am writing this piece to you to voice my concern about a 
matter which is very important to me. There are reports in the media, that a 
bill is likely to be presented in Parliament to amend the RTI Act. The reasons 
being given publicly are that the CIC order declaring political parties as 
Public authorities, subject to RTI is bad in law. My understanding is that if 
an order which is bad in law is issued by any statutory authority, the correct 
process is to challenge it at an appropriate forum. The CIC order can be 
challenged in a writ in the High Court, and there are many instances of these 
orders having been quashed in Courts.  None of the political parties has filed 
for a stay of this order, and now expect to amend the law in Parliament to 
justify and legitimize their defiance of a statutory order. With folded hands I 
plead with you not to vote for this. Parliament makes the law. Once it is made, 
it has to be adjudicated by the appropriate statutory authorities.  This is the 
Constitutional process. Defying a statutory order by anyone sets a wrong 
example, and leads to breakdown of the rule of law. After considerable 
discussion spread over months, and reference to a Parliamentary Committee this 
law was passed. It has been rated as the second best law in the World. Citizens 
cherish and value it immensely, since it codifies a very important fundamental 
right of ours.

The law has been used fairly extensively and has uncovered certain 
arbitrariness and corruption. More importantly, it has empowered the individual 
sovereign citizen, who is today getting greater respect from many entities. The 
key principle in defining the bodies to be covered by the RTI Act was based on 
the movement’s slogan, “Hamara Paisa, Hamara Hisab.” Hence all Government 
bodies were covered by the RTI Act and also other Institutions which may be 
‘substantially funded’ by Government were covered. This was the Act passed by 
Parliament, based on which the CIC has passed an order. I do concede that there 
is some reasonable scope for a different opinion on what constitutes 
‘substantial funding’ and if the political parties feel that the CIC decision 
is flawed, they could challenge it in Court.  Parties have said that they are 
being monitored by the Election Commission and the Income Tax department, and 
hence they need not provide information to Citizens. All Institutions including 
Parliament are legitimized to be intermediaries on behalf of ‘We the People’. 
None of these can replace the people of India. 
Some worries have been voiced about how the political parties will be able to 
cope with the RTI queries. I might point out that many small NGOs and aided 
schools are complying with RTI without a major stress.

Subjecting themselves to Right to Information by citizens has not damaged any 
Institution in the Country. Some political representatives have claimed that 
they would not like to be questioned about their processes of decision making. 
RTI only gives access to citizens to the records of a Public authority, and 
does not entitle the citizen to question the merits of the decisions.  Besides 
there are ten exemptions in Section 8 (1) for information which need not be 
disclosed and these exemptions passed by Parliament have worked well, and not 
resulted in damaging any Institution since 2005. There is some recognition

POLICE REFORMS WATCH WILL TAKE UP THE ISSUE OF BURKING WHICH HAS BECOME 
ENDEMIC  WITH THE DGP, MAHARASHTRA AND 

MUMBAI POLICE   COMMISSIONER .



 

 The Police Reforms Watch welcomes the formation of THE POLICE COMPLAINTS 
AUTHORITY which was long overdue in the light of the Supreme Court directives 
issued in 2006.



The Police Reforms Watch is however dismayed with the issue of Burking which 
has become endemic in Mumbai Police Stations.



Police Reforms Watch will address the Burking issue with both the Director 
General of Police, Maharashtra as also the Mumbai Police Commissioner.  

 


We will  also make the implementation of the Police Reforms  an election issue 
for the forthcoming 2014 elections.



Police Reforms Watch is an Umbrella for the movement of various voluntary 
groups and activists committed to monitoring the implementation of Police 
Reform. Towards this objective it will facilitate advocacy and interactive 
engagement at the level of the Government, Police, Media and Citizens.
