I had other things on my mind in my teens and twenties. I had to grow up, go out, compete in the academic or business world, embark on a career, climb the organizational ladder, etc. And I did--working first as a lecturer and then in a bank. But then something happened that changed my life completely and turned everything I believed in, career-wise, upside down. It's been happening to women from the beginning of Time but somehow, for me, it was the greatest miracle possible: I became a mother. And everything else now came second. (In later years I read a lot about post-partum depression and how protracted it can be00and there I was with an prolonged attack of extreme post-partum euphoria, and I must admit that over two-and-a-half decades down the line, it still persists.) So, I resigned from the bank and set off on this great adventure of bringing up a child. I was told I was being ridiculous. I could take a year off and then get back to work, like most others did. I was warned that I'd soon get tired of 'sitting at home' and would seek the workplace again. But somehow that didn't happen. Because, late at night when the baby was asleep, I started writing: slice-of-life articles and short stories for adults. I wrote in longhand, in pencil, so that I could erase and re-word and polish my prose until it was time to pull out that old Royal portable typewriter and hammer at the keys. In those days, everything went by post. We lived in military cantonments with Army Post Office (APO) addresses, so replies, acceptances, or rejections took a long time to reach me--as did the cheques that came my way for these articles and stories. Everything was addressed care of my husband and went to his office--and it annoyed me no end that he got to know the fate of my work before I did! Meanwhile, my son passed infancy and became a delightful toddler. We spent his waking hours haunting the small parks nearby with our stately German shepherd--and we talked. It was a never-failing source of delight to find that my son actually hung on to my words and clamoured for my stories... and soon became insatiable for them. Naturally, we soon exhausted the stocks in the Army library, the books in my collection, and the fund of tales that my mother had told me of her childhood in Hubli with a large family and a close knit community. So what choice did I have but to start creating stories for him? My son was not a hard taskmaster. I used settings he was familiar with and characters he could identify with. If he didn't like something in the story we would change it around, if he disapproved of the ending we would work it out to suit his tastes. "If he likes my stories," I thought, "why not try a larger audience?" So, I took the next logical step and wrote a few stories and sent them to *Children's World* (the monthly magazine of the Children's Book Trust) for consideration--and that's when the going got tough. The stories were not snapped up. I was not told that I was an indigenous Enid Blyton or a Roald Dahl in the making. (This was the early 1990s, before J.K. Rowling conquered the world...) But, instead of a simple rejection, one of those that say 'No' very politely, I got a long letter from the editor at that time, Ms Vaijayanti Tonpe. She went over all the aspects of the stories I had submitted: subject, characters, events, language, etc., gave me detailed feedback on what could work and what wouldn't and asked me to try again. That letter was the best thing that happened to me in terms of my first steps in children's writing. I went back to those first two stories but realized that they were pretty much beyond retrieval, so they were tossed out and I wrote another short story, this time going for a topic that was close to my heart--our German shepherd--and imagining the rest. It worked. The story was accepted. (It took a long time, however--not because of the publisher, but because we had shifted from one end of the country to somewhere midway-- where

CHRI and PRW question the need for new proposed security legislation Press Statement, 26 August 2016 The Commonwealth Human Rights Initiative (CHRI) and Police Reforms Watch seriously question both the necessity and the justification for another new internal security law as proposed by the Maharashtra government’s Protection of Internal Security Bill 2016. We are particularly concerned with the wide scope of the Bill. Created purportedly to deal with multiple security challenges, the State once again bestows more and more sweeping powers on the executive and the police, all without the requisite accountability. The omnibus Bill tries to deal with challenges of “terrorism, insurgency, communalism, caste violence, etc” all in one legislation and does not differentiate between the nature of the threats from each. Specific laws are already in place to deal with many of these matters. In order to bring every kind of threat under one law, the Bill relies on dangerously vague catch-all definitions, which are totally insufficient to further justify criminalisation or prohibition. It is equally alarming that the Bill gives the state government and police sweeping discretionary powers in the absence of sufficient checks or accountability for abuse of power. Maja Daruwala, the Director of CHRI, states, “This Bill is ill-considered both in its intent and content. Every citizen should be alarmed at the sweep of laws like this which are designed for abuse. The greatest security the state can provide all of us is to make sure we have an honest efficient and law upholding police and a court system geared to give us speedy and fair justice. Certainly more and more laws only go to muddying the waters and reducing people’s power to face up to oppression”. The Bill has been released into the public domain ahead of the next Assembly session. This provides an opportunity for an exhaustive debate to discuss the necessity of any new law as well as the state of policing and security in Maharashtra. Though she wrote to the CBI saying she was willing to cooperate with them in every way, the CBI decided to raid her premises. Setalvad’s organisation, Citizens for Justice and Peace, has canvassed and litigated for the prosecution of cases stemming from the 2002 anti-Muslim massacres in Gujarat, especially the Gulberg Society and Naroda Patiya killings. The latter case led to the conviction of prominent BJP leader and former minister Maya Kodnani. The CBI raid on Teesta came barely a day before the appeals by those convicted for the Naroda Patia massacre case were to be heard in the Gujarat High Court, and just two weeks before the final hearing of Zakia Jafri’s petition against the closure report of the Supreme Court-appointed SIT, which cleared Narendra Modi of criminal liability for the Gujarat riots. Setalvad has been closely assisting Zakia Jafri with her petition and appeal. The Wire asked a few prominent individuals for their views on the matter. Is the CBI raid an attempt by the BJP-led government at the Centre to intimidate activists opposed to it? Or is the agency merely doing its job, investigating charges against Setalvad just as it would in any other case? They have chosen Teesta specifically because she has confronted them. URGENT PRESS RELEASE Join the campaign for Better Policing Dear Madam/ Sir, Today, Sunday, July 05 at Dharavi we organised the Police -Citizen interactive programme in association with the All India Thowheed Jamaath for their womens wing. There were more than 200 women present for this meeting. We had requested the Mumbai Police Commissioner to depute a Senior Woman Police Officer. The Police Commissioner of Mumbai, Shri Rakesh Maria deputed Smt. Sujata Patil, Sr. Inspector of Police- Kherwadi Police Station for this meeting. Sr. Police Inspector, Smt Sujata Patil in her opening remarks said, the Mumbai Police is here to serve you and we definately pay more attention to the issues and problems of the children and women in particular. In her lucid style she also advised them and guided them that in case of difficulties, you need not go to the Police Station but dial 100 so that the police could help those women who are in problems. One of the good ideas she shared is to always keep the telephone number of your local police station and the Beat Chowky so that prompt and quick action could be taken. Dont be afraid to share your problems and the Police Commissioner Shri Rakesh Maria has given us instructions to attend to children and women's problems promptly. Mumbai Police are your friends, she remarked. If there are concerns of any illegal things happening in your areas do bring it to our notice for prompt help. Please support us in our work so that the area is crime free. This was followed by an interactive session where some of the women raised various concerns and issues. One of the question raised was Do you have to pay money when we visit the police station to file a complain? That's the reason why many of us do not go to a police station when we have a problem . In reply, Sr. Inspector of Police Sujata Patil said the Government pays us our salary and you do not have to pay anything while filing your complaints. If such a thing happens please go to the Senior Police Officers in the police station and inform them.When we dial the police helpline 100 number, they ask us to identify ourselves, was another question raised by one of the participants. Smt Patil explained that when you call the number 100, your number gets logged into the system and than it is accordingly passed on to the respective police station where the problem has happened. But she said there is nothing to get worried. Smt. Sujata Patil encouraged the participants to raise their various questions and were answered by her. Overall this meeting was an excellent method to build confidence in the citizens about the police and explain to them about their rights. The talk would also help them to approach the police in the event of any problems. Mr. Mouddin , Trustee of All India Thowheed Jamath spoke about Islam being a religion of peace. Also he said we are safe because the Mumbai Police work hard to protect all citizens. We must seek their help when we have problems . He thanked the Mumbai Police for all its good work. Hari Chavan's death yesterday is yet another unfortunate addition to the list of deaths in a police station already facing Crime Branch probes for 2 similar incidents, one in 2011 and the other in 2013. Although the Crime Branch has initiated an investigation, it is imperative to keep the Sr. Inspector and other responsible personnel away from the police station, in the interests of a free and fair probe. DCP (Zone -II) B. Rajput's statement to Mumbai Mirror- that Chavan wasn't tortured and hanged himself by the sleeve of his shirt tied to a window grill because he was fearing arrest, beggars disbelief. With Maharashtra Police having a record of having 23 percent of India's custodial deaths (333 instances between 1999 and 2013) but only 45 FIRs, 19 charge sheets and ZERO convictions, the police can ill afford to let more of such incidents happen under its watch. NAGAR/POLICE REFORMS WATCH stongly condemns this latest incident. Given the unimpeachable evidence of a ten year pattern of deaths in custody we urge an independent inquiry to probe not only this death but into the pattern of deaths in Malwani and across Maharashtra that plague policing. We are indeed surprised that their frequency and numbers do not appear to be a matter of concern to the police or to the government that is responsible for their performance. Deaths in custody in such numbers and over such long periods cannot be explained away as aberrations or natural occurances. The public does not come to police stations to suddenly become terminally ill or commit suicide as their place of choice This is precisely the reason that since 2006. the Supreme Court has insisted that Maharashtra set up a credible, independent and effective Police Complaints Authority to look into patterns of malpractice within the police.In response Maharashtra has still not instituted a Police Complaints Authority which the Chief Minister must do so immediately now. The National Human Rights Commission must also suo moto look into such cases. Slow or opaque measures in individual cases and lack of will to look into patterns of behaviour by existing oversight bodies such as the State Human Rights Commission amounts to condoning this pattern and consequent impunity. In January 2015 ,the Maharashtra Government gave an undertaking to the Bombay High Court that it would install CCTV cameras in all cells across all police stations in Maharashtra . This has not been done . We believe that unless this is done at the earliest the police/s impunity for custodial deaths would continue. Police Reforms Watch is dismayed and shocked at some of the unsavoury happenings about policing in Mumbai in the last two weeks. This has not only resulted in a negative image of the Mumbai but also has affected the comfort level of the citizens and more specifically women to approach the police authorities to redress their grievances. On one side we have had the incident of the extortion bids by two of the Khar Police Officers . Have our police stations become extortionist dens? In the Khar episode, goondas were also part of this racket with the said police officers in this alleged crime. On the other hand have our Police Stations become settlement courtsas was reported in one of the newspapers. There should be more Citizen-Policing initiatives to stem this rot. We commend the Mumbai Police Commissioner in promptly suspending the Khar Police Officers and transferring the Sr. Inspector besides sending a terse message to all the police stations . Also another Officer from Bandra was also promptly suspended for his alleged romance fling with an accused, but are surprised why different standards have been applied to the DIG accused of rape? Are there two separate laws of enforcement one for the small fry and another one for the big one? The New Police Amendment Act 2014 is not really an answer to Better Policing. Maharashtra is among the worse in terms of its record on the Supreme Court 2006 directives on police reforms. Worse, inspite of our campaign, in February 2014, the state passed the Maharashtra Police (Amendment) Ordinance 2014 (now an Act) which too does not comply with the Court's scheme, dilutes accountability mechanisms and strengthens government / politicians’ control over appointments, postings and interferences. Our demand is that the state should go in for a comprehensive review of the police act and involve the public through consultations. Our campaign is now focusing on educating the public on key concerns of the Act as well as of bad legislative practice (no debate and public consultations were held before passing the Maharashtra Police (Amendment) Act 2014). The former Police Commissioner must learn from the example of the former Union Home Minister Shri Sushil Kumar Shinde also from Maharashtra. Setting a public example within three days of his losing the lost the parliamentary elections in Solapur, he handed over the possession of his sprawling bungalow. While we wish him all good luck in his new career , Shri Satyapal Singh should follow the example of Shri Sushil Kumar Shinde and vacate the premises without any delay. But the Bill is brazenly designed to defy every single one of the Court's directives. Besides the stakeholders in this case, the Citizens were totally ignored before this Bill was passed. The response to rising crime has to be better policing. But the recently passed Maharashtra Police (Amendment) Bill2014 will lead to policing run by politicians. The Bill has to be overhauled completely through a participatory process. The latest crime figures released by the NCRB have Mumbai and Maharashtra at the top for 2013: · Highest number of custodial deaths in Maharashtra · Mumbai ranks second in crimes against minors, while Maharashtra has most minors who fall foul of the law · Highest number of railways crimes in Maharashtra · Highest number of crimes against women in Maharashtra tops in crimes · Mumbai is the second most unsafe city in India for women. To meet these challenges, the state's response must be better policing - policing which is unbiased, responsive and lawful. The state government will meet this by saying we are working towards this by pushing through the Maharashtra Police (Amendment) Bill 2014 to bring in long awaited changes. The Bill was passed by both Houses of the legislature in the last session, and is now with the Governor for his assent. Police Reforms Watch Mumbai and the Commonwealth Human Rights Initiative (CHRI) forcefully state that this Bill is a fraud on the people and the process of police reform. The objective of the Bill is to amend the Maharashtra Police Act, 1951 to incorporate six directives on police reform laid down by the Supreme Court in 2006. But every directive has been systematically diluted or subverted in the Bill which formalizes excessive political interference in the day to day management of the police. The Bill was passed with hardly any discussion both in the Assembly and the Council. There was zero consultation with the people of Maharashtra, and all indications are that the police leadership was either not consulted or ignored. The police rank and file across the state do not figure at all in the reform of their organization. Dolphy D' Souza, Convenor of Police Reforms Watch Mumbai, states, While the blame for this Bill stops at the ruling party dispensation of [Congress and NCP], we fail to understand why the Opposition did not put a spirited fight against such an obnoxious Bill. While the State and the City President of the BJP including the Leader of the Opposition [BJP] did raise some objections, they failed to build pressure to defeat the Bill's passage or have it referred to a Select Committee. Maja Daruwala, Director of CHRI, says, Police reform in the public interest cannot happen in isolation or haste. Maharashtra is in serious need of police reform, but reform which is done in consultation with both the police and the public.The process of drafting a new law must be given the widest publicity. It is our hope the Governor returns the Bill to the legislature and it is then referred to a Select Committee that can facilitate a consultation process. A citizen's campaign, led by PRW and CHRI, has been launched to urge the Governor to invoke his powers under Article 200 of the Constitution of India to withhold his assent to the Bill and send it back to the State Legislature for reconsideration and send recommended changes for both Houses to consider. This hugely important law will decide the directions of policing in the state for future decades, yet the government has seen fit to pass it in haste without public consultation, and even at this date it is still to be seen on official websites. Under the guise of complying with the Supreme Court’s directives on police reform in the Prakash Singh case, the new Bill has been deliberately designed to defeat its intentions of giving the public a capable,well-managed and accountable police. By diluting and subverting each one of the 6 directives, the Bill in fact formalises the very practices of unwarranted political interference with every day police management that the Court had sought to reduce. He told me to complain but he refused to accompany me to the police chowky. 2) Though there is metered taxi lane in addition to pre-paid taxi lane, the metered taxi lane entrance and outlet is blocked by parked taxis whose drivers take advantage to corner passengers by soliciting and charging or demandign exorbitant lump-sum amounts. It is very clear that the constables have a nexus with the taxi drivers. In today’s time through various citizens empowerment laws we can prove that there is a “corrupt practice” . There are many such customer soliciting drivers who park their taxis and go inside the railway station to catch hold of innocent outstation (including local passengers) and charge them a lumpsum. This practice is prevalent both outside the passenger outflow from platform number 6 and also at the Dadar Terminus Juction area. At the Dadar Terminus Junction area the taxis are parked there just to get their turn to get such passengers. The taxis that are parked can easily be directed towards metered taxi lane which is outside platform number 6. 3) The constable to whom I complained his name plate was not visible as it was facing down and he refused to give his name. He said the name plate expense is done by him and it is not given by department. 4) One of the taxi drivers shouted at me “how to pass the time when we are waiting, that is why we play cards” and “shall we come to your place to play cards” this all happened in front of constable, this statement gives clear message that the traffic police and law order police know of this nuisance, which cannot continue with out abetment by stationed traffic policeman and law order police. What was of further utter disregard is that the constable said go where you want to - whether Sr. Police inspector or to CM 5) Whenever the outstation trains arrive the constabulary stationed just sneak in the chowky giving a free hand to taxi drivers to go all out and fleece the passengers. This is a daily affair at the Dadar station, we don’t have any option but go on complaining to various authorities. This seems to be a modus operandi of administration to frustrate the complainers. We immediately expect you to take action on the constable, we are ready to come to identify the constable if need be. Several others collapsed from exhaustion during a 5 km physical endurance run for getting into the police. Tragically Three have already died. This brings into question the ethos of the service they are joining. Yes a certain height and physic is necessary But anyone who has ever dealt at policy level about improving the police agrees that physical tests cannot be a priority for modern day policing. The British were looking for tough young men to beat up the natives, what are we looking for? The same thing? Modern policemen and women above all need to be educated, psychologically tested for being law upholding and committed to public service. These people, often from poor families desperate for employment need to come into an enabling environment that nurtures their best talents and creates friends and protectors for the people. Maharashtra has a shortfall of 23,776 officers. Even if every sanctioned post were filled there would still be only one officer for every 618 citizens. By contrast Delhi has one officer for every 251 citizens. Now we hear authoritatively that there that there are 10 police personnel for each person designated a VIP in Maharashtra. 812 police personnel guard 84 VIPs. No doubt the orderly system of having subordinate policemen in the exclusive service of seniors eats up another significant number. Can this be an acceptable level of police planning? Maharashtra has undertaken recruitment drives to add up to 14,000 officers but if they are to join the bodyguards or the cadre of poorly trained Jeeves's, additional man power may change very little. Governments have a fundamental duty to keep people safe. But the crime graph is growing all the while. Atrocities against Dalits are on the rise, with over two thousand cases registered in 2013. Women are the victims of crime - endlessly. The police are blamed but the distortions in recruitment manpower and deployment mean that policemen on operational duties do double and triple shifts without the necessary forensic or legal knowledge to win the war on the streets. This is a unfair on both to the police and the public. If, as the Supreme Court required, Maharashtra had a bipartisan independent state security commission that made sure that police performed better and had solid long and short term plans to make them fit for purpose with adequate money, equipment, manpower, techniques, reasonable conditions of work all this could be cured. The police deserve this. Better policing for a safer Maharashtra is not an option any more. It is a necessity. A beginning must be made. Politicians must show the political will to create positive changes and not resist ideas that will make policing better and more accountable. The people will judge them on this when they vote this election. Many of these students had never visited a police station before. They came up with some very interesting findings: 1. Many of the Police personnel are often not aware which IPC sections to be applied to the type of crimes/. offences committed . Police also say that now there are more white collar crimes and therefore many of them are not conversant with laws pertaining to such crimes. 2. Noise pollution is an important factor while determining placement of various infrastructure and establishments and it would be appropriate to take noise into account while permitting any change in Rules which would affect noise pollution levels in Mumbai (already the noisiest city in the world). Therefore, any decision to allow them longer hours for certain establishments can only be determined after a thorough planning exercise including a noise map. It has been proved beyond any reasonable doubt that the presence of an establishment such as a restaurant or pub in a Silence or Residential Zone would lead to increased use of horns and consequent noise pollution. Citizens and citizens’ groups have actively represented against such noise pollution. In addition the issue is of law and order and safety of the Citzens needs to be looked into. Is the Police geared up for maintaining law and order in such situations? We want to remind the Chief Minister the shortfall of 7403 police personnel should be filled up as soon as possible. To add to this is in 2012, 28420 police personnel were deputed for VIP security. Chief Minister Sir, this deployment of VIP security should also be looked into. We urge the Chief Minister to finalise the transfers of Sr. IPS Police Officials and not to leave it to politicking and unnecessary speculations. As citizen's we are shocked at the complete callousness of the administration in looking after our safety. At any given time only 20% of the police force is available to ordinary citizens. This means that the effective cover for one person is .021policemen per person( or 21 policemen per lac population). The UN recommended minimum is 220 per lac population. The VIPs on the other hand has 1 policeman or more for every one VIPS. Providing policemen for unnecessary security to a few very privileged people is costing us our lives. This has to stop. The city of 1.3 crores deserves to have well trained law abiding boots on the ground available on call for everyone going about their daily business not to create spurious special cases. Rather than making urgent changes in policing so that it can be an effective service for the public the primary concern of every government in power has been to make sure that the police keep doing their bidding. We are surprised and dismayed by the statement of the Chief Minister Prithviraj Chavan widely reported in the press , August 29, 2013 where the CM says absolute implementation of police reforms is not possible It appears that the Maharashtra Government either does not have the political will or does not want to lose the control of the management or resultant mismanagement of police affairs of the State. A day before the Prakash Singh case on Police Reforms came up for hearing in the Supreme Court on July 17, 2013, the Maharashtra State Government on July 15th promulgated the order for setting up of a Police Establishment Board and delegated powers of the transfer of the police personnel to the said Board. This was as it should be. In addition a week before, the Maharashtra Government had already set up the Security Commission headed by the Chief Minister. Further, the State announced the setting up of the Police Complaints Authority . All this was on paper to appear compliant before the court. Please see the relevant GR's attached. Now suddenly there is a volte face by the Chief Minister, who now asserts that the absolute implementation of the police reforms is not possible. The Chief Minister is misinterpreting what being 'responsible' as a government means. It does not mean direct control over the management of every agency created by the State. The cabinet does not try to manage thousands of government services it is responsible for through managing postings transfers and other employment matters directly. So why the police? The CM and the cabinet must lay down general policing policy; provide support to make the police fit for purpose and monitor its performance. One part of doing this is to choose a fine police chief out of a panel made up of the most meritorious people; and then let him choose his own officers through a transparent process based on clear guidelines and criteria that looks fair to his own men. Then let him get on with making Mumbai a safer city through upholding the law and by lawful means. If the CM and the cabinet feel they are 'responsible' for administering and managing the police and so must take away the powers of the chief then we have two questions: Will they all resign when there is a gangrape or a terrible murder or crime statistics go up and up as they are doing now? Second question; why have a police chief at all if he can't be trusted to run his own organisation, choose his team or do the job you have chosen him for. It would be pertinent to quote the former Police Commissioner Julio Rebeiro , Bombay was safe. Is Mumbai safe? Where I disagree with him[ Home Minister Mr. R.R.Patil] is about Police Reforms. If introduced in spirit these should help him to have a more professional police force. Corruption will decline by more than fifty percent overnight and the quality of policing will improve if the reforms go through. His colleagues in his own party, however are not interested. They want to control postings and transfers. There was a news items in one of the publication recently that the Maharashtra govt. has filed a reply in the Supreme Court against this Judgement on Police Reforms which states: All the directions contained in Prakash Singh's case relate to the executive powers and functions of the state government and they can only be exercised by the governor on the aid and advice of council of ministers. This is basic constitutional scheme and, therefore, recommendation of any authority can never be binding on the state government, And did this wisdom dawn on the Maharashtra Government after 7 years, what a shame. Supreme Court Judgement on Prakash Singh has come in the year 2006. The Maharashtra Government had not done anything on this till the recent ultimatum given by Supreme Court. But what is important is that National Police [NPC] commission's report was submitted in 1980. There are many other reports on Police Reforms after that. The Government . has done very little on this till the SC prodding. So after 33 years of NPC report, if the govt. has to do something on this then it should be ashamed for taking such a stand. Citizens have condemned the move by the Government to immunise political parties outside the purview of the RTI by amending the RTI Act. Ms Priya Dutt assured the delegation that she would address these issues with the Government, Party and Smt. Sonia Gandhi, Chairperson of NAC. A delegation comprising of : Mr. Narayan Varma, Jt. Managing Trustee, Public Concern for Governance and Trust [PCGT], Ms Shyama Kulkarni [ Trustee - AGNI], Mr. Mohammed Afzal, RTI Activist and Member of Police Reforms Watch, Mr. Sunil Ahya, RTI Activist, Mr. P.K. Mukerjee, Citizen Activist and Dolphy D'souza, Convenor, Police Reforms Watch met with Ms Priya Dutt. The delegation apprised her on the following: 1. In the Parliament in 2009, the Concerned Minister on the Floor of the house had assured that no amendments would be carried out without consulting the Stake Holders i.e. Citizens and Civil Society. In 2012, the Cabinet also assured that there would be no further amendments to the RTI. We emphasised that Promises need to be kept and not brushed under. 2. The delegation impressed upon her that the Order of the CIC to include political parties in the ambit of the RTI in the long run would benefit the political parties as it would rid them of all vested interests. It would add to the transparency and accountability in strengthening democracy. Hence there was no need to pursue such an amendment. It appears the Political parties are frightened by this order which is misplaced and they are rushing to amend the sunshine law. 3. In the current situation no consultation has been carried out with the Stake holders hence we suggested that this legislation should be referred to the Standing Committee of Parliament to enable the civil society to also react and be part of this process as is the normal thing done for better democracy. 4. The whole process of such a legislation / Amendment is violative of the RTI Act , Sec 4 [i] [b] [vii] which inter alia states: The particulars of any arrangement that exists for consultation with, or representation by the members of the public in relation to the formulation of its policy or implementation thereof: {This has not been done thus far}. In conclusion we emphasised the point that there was no need to amend the RTI act, as the CIC order on Political parties would encourage deep participation of the citizens and strengthen democracy. While the UPA Government has been heralding that RTI has been one of their biggest achievement in Governance, on the other side the same UPA is trying to muzzle the Act. This is rather sad and dissapointing and does not augur well for the UPA. There are reports in the media, that a bill is likely to be presented in Parliament to amend the RTI Act. The reasons being given publicly are that the CIC order declaring political parties as Public authorities, subject to RTI is bad in law. My understanding is that if an order which is bad in law is issued by any statutory authority, the correct process is to challenge it at an appropriate forum. The CIC order can be challenged in a writ in the High Court, and there are many instances of these orders having been quashed in Courts. None of the political parties has filed for a stay of this order, and now expect to amend the law in Parliament to justify and legitimize their defiance of a statutory order. With folded hands I plead with you not to vote for this. Parliament makes the law. Once it is made, it has to be adjudicated by the appropriate statutory authorities. This is the Constitutional process. Defying a statutory order by anyone sets a wrong example, and leads to breakdown of the rule of law. After considerable discussion spread over months, and reference to a Parliamentary Committee this law was passed. It has been rated as the second best law in the World. Citizens cherish and value it immensely, since it codifies a very important fundamental right of ours. The law has been used fairly extensively and has uncovered certain arbitrariness and corruption. More importantly, it has empowered the individual sovereign citizen, who is today getting greater respect from many entities. The key principle in defining the bodies to be covered by the RTI Act was based on the movement’s slogan, “Hamara Paisa, Hamara Hisab.” Hence all Government bodies were covered by the RTI Act and also other Institutions which may be ‘substantially funded’ by Government were covered. This was the Act passed by Parliament, based on which the CIC has passed an order. I do concede that there is some reasonable scope for a different opinion on what constitutes ‘substantial funding’ and if the political parties feel that the CIC decision is flawed, they could challenge it in Court. Parties have said that they are being monitored by the Election Commission and the Income Tax department, and hence they need not provide information to Citizens. All Institutions including Parliament are legitimized to be intermediaries on behalf of ‘We the People’. None of these can replace the people of India. Some worries have been voiced about how the political parties will be able to cope with the RTI queries. I might point out that many small NGOs and aided schools are complying with RTI without a major stress. Subjecting themselves to Right to Information by citizens has not damaged any Institution in the Country. Some political representatives have claimed that they would not like to be questioned about their processes of decision making. RTI only gives access to citizens to the records of a Public authority, and does not entitle the citizen to question the merits of the decisions. Besides there are ten exemptions in Section 8 (1) for information which need not be disclosed and these exemptions passed by Parliament have worked well, and not resulted in damaging any Institution since 2005. POLICE REFORMS WATCH WILL TAKE UP THE ISSUE OF BURKING WHICH HAS BECOME ENDEMIC WITH THE DGP, MAHARASHTRA AND MUMBAI POLICE COMMISSIONER . The Police Reforms Watch welcomes the formation of THE POLICE COMPLAINTS AUTHORITY which was long overdue in the light of the Supreme Court directives issued in 2006. The Police Reforms Watch is however dismayed with the issue of Burking which has become endemic in Mumbai Police Stations. Police Reforms Watch will address the Burking issue with both the Director General of Police, Maharashtra as also the Mumbai Police Commissioner. We will also make the implementation of the Police Reforms an election issue for the forthcoming 2014 elections.
