I wrote too fast.  Chapter 1 paragraph 108 does give permission under 
some circumstances to libraries to copy  complete works or transfer 
from another media.  This is not permission to systematically copy an 
entire collection.

[ha-Safran]: Library Snapshot Day at Congregation Beth Am

Congregation Beth Am, Los Altos Hills, California had a very 
successful Library Snapshot Day on Sunday, November 7.  It was held 
during our regular Sunday Program hours from 9:00-11:30 a.m.
104 people came into the library.

We  had refreshments on a table outside the library.
5 classes came in for stories.
There was a table with supplies for making bookmarks.  The 
pre-kindergarten class participated in that activity.
Photo albums were on display highlighting our AJL Accreditation 
documents, pictures of our Mother Goose Program and misc. library photos.
One table had a library survey for patrons to fill out.  six people 
participated.  Two people expressed an interest in volunteering in the library.
A display of children's favorite books was set up.
We began our annual reading game.  This year's theme is "Kids Love 
Jewish Books."
We recorded circulation statistics for the day:
4 adult books
5 juvenile books
35 picture books
1 video
1 DVD

We offered tours of the library.
4 library committee members helped with the various activities, our 
two teen Madrichim took photos and counted patrons, and the librarian 
told stories and took photos.  Selected photos will be used in the synagogue.

This event, as well as three other events the library will be 
sponsoring for Jewish Book Month, were highlighted in the local 
Jewish News.  Friday, November 5 we had a book display before and 
after services.  Next Friday, November 12 will be library 
Shabbat.  Two local cookbook authors will be feature speakers during 
services.  The service will be followed by a potluck 
dinner.  Saturday, November 20 the library will feature a book 
display during Torah Study.  Torah study is usually attended by 150 people.

Given the complexity of the issue, I asked the Copyright Office here 
at Michigan State University to comment. With their permission, I am 
posting their reply so as to go into the "mix" for the discussion at 
the next meeting.




Generally speaking there are a number of ways to look at these 
preservation situations.



It has been interpreted as acceptable practice to migrate if the item 
could not be acquired in the current format or in an updated format, 
i.e. if you had a VHS tape, you could digitize it, if you could not 
acquire the item as another VHS tape or in any other format such as DVD.



With unique items in a collection, you have more leeway if you are 
the only library holding a legal copy of an item.



There's also a school of thought that it should be acceptable to make 
a digital use copy of anything legally held as long as you did not 
net two copies for use.



Copyright practice for library preservation purposes is open to 
interpretation and there really aren't any hard and fast rules as 
supported by case law on the topic. I think it's important to be 
consistent and think carefully about your practices and policies in 
light of fair use interpretations

I agree with Toby that copyright issues affect all of us, including 
school libraries, synagogues and centers. In addition to photocopying 
and distributing photocopied material, I'm particularly interested in 
the public showing of copyrighted films.
This is definitely a broader issue that pertains to others in 
addition to RAS libraries.

I haven't kept up with this whole thread, but I read Steven Bergson's 
post about the online newsletter being available to a wider audience. 
Has it been decided that the online newsletter will be available to 
anyone, and not password-protected (and thus only available to paid 
subscribers or members)?

Another library organization to which I belong moved their newsletter 
online while raising their dues at the same time!  I would read the 
paper copies when I used to get them, but never go looking for it 
anymore.  (Initially, they would send email out when a new issue was 
available, but they haven't done that for years.)

These questions bother librarians and scholars, but the lawmakers did 
not fully address all of these issues.  In my next blog on copyright 
I will deal with the questions concerning who does the copyright law 
really protect?  The British law, Statue of Anne (Copyright Act 
1709), the first copyright legislation, seems to protect the printers 
and publishers because only publishers could own a 
copyright.  Napoleonic Code was more concerned about the intellectual 
property rights of the creator; copyright was automatic upon 
creation.  American law seems to favor the authors and creators over 
the publishers.  The Berne Convention combines these protections and 
guess who loses -- scholars, librarians, and libraries.

If a DVD says "For Home Use Only"  it means that if can not be used 
any where else.  You can't borrow a DVD from the library and show it 
without securing another license.  Many people violate this provision 
of the law because the home use license is much less than a public 
performance license.

We have exactly the same issue here at Ramaz.  We have a large
collection of VHS tapes that we have been using for classroom
instruction.  Over the past few years, we have added projectors and
SmartBoards to every classroom so that it is quite easy to project a DVD
for class instruction.  This year, we got rid of most of the TV/VHS
setups that we had to show the VHS in our collection.  If we could
convert the VHS tapes to DVD it would be extremely helpful to us.  Many
of the VHS tapes are not available in DVD.  Occasionally the VHS breaks
in the player and we are left with nothing.  It would be extremely
helpful if we could find out what educational and fair use laws are
applicable to our situation.
