Eric, I think we need to bring to the attention of the state that Internet 
Service Providers are seen as Essential services. If you consider all the other 
essential services, ISPs are some of the only services that MUST be in the 
individuals home or business.  Its not like you can install a new service and 
only be outside the home.  Other services may need in but many of those are 
handled by contractors that have already completed that service to the outside. 
 I think that additional considerations, testing's, and access to protective 
gear should be considered as we make working from home possible for thousands 
of Hoosiers.  I would expect IBTA, INECA, Cable, and even the REMCs could get 
behind that.

Yes, however now that it is shelter in place, we are limiting new installs.  We 
have new protocols we have put in place for any in-home work.  We have had a 
significant increase, yes...

Please be safe in your work going forward, even younger people can be 
significantly affected and this virus doesn't discriminate to only those that 
have a compromised immune systems or elderly.

The government did not say you must provide service with out payment. They just 
said that you cant shut them off if they are already customers and due to 
change in employment or covid infection. You keep billing and when its all over 
they still owe.  It all comes due. I know that does not pay the monthly bills. 
But they cant shut you off either.

I agree that Eric should broach this subject with the state.  But some of this 
directive is from the Federal government.

Thank you for taking on this role, and for participating in the daily 
conference call.  I feel a concern shared among small independent service 
providers is that the government is ordering our companies to continue to 
provide service to non-paying customers.  Small service providers may not 
be able to sustain the hit to cash flow while having the ability to keep 
services operational. Many consumers are in a cash flow crunch, so they 
will ask themselves what invoices do I have to pay and what invoices don't I 
have to pay at this time?The state of Indiana is telling them they don't 
have to pay our invoices, so we know the answer. Loans will not resolve the 
issue, because loans must be repaid and loans assume we will also eventually be 
paid by delinquent customers. So the question is,  given that the State has 
ordered us to provide critical services without expecting payment in return for 
the services, what is the State prepared to do to ensure that service providers 
can continue deliver these necessary services to the public?

Comcast and AT&T can survive something like this. Companies like ours will 
have a much harder time.

SBA loans are available but are not helpful because they have to be repaid and 
personally guaranteed by the business owner.  When the State permits 
customers to consume our services without paying for them,  personal guarantees 
do not seem appropriate.   A grant would be more appropriate in this 
situation.

Corona virus situation. How have you changed your normal operating procedures.

I know our company has signed on to the FCC keep America connected. We are not 
doing any kind of free upgrades at the current time or free installs. But are 
being very lenient to frustrated customers because we know they're stressed. We 
have also changed our install and repair procedures for entering people's 
houses. We make sure that there are no sicknesses in the home, techs where 
gloves and shoe covers while in the home, wash hands before and after, request 
that the customer keep social distance, and the text can leave at any time they 
don't feel comfortable. We have also stopped requiring customer to sign 
documentation if the customer is being a pain they can take a picture of the 
customer with a thumbs up in front of the paperwork.

That would be a question for Scott Rudd at the LG office or an OCRA staff 
person.  Most of the areas that show unserved in our area have no houses.  So 
those will be evaluated as to the number of locations that will be served as 
part of an application so an area that has one or no house “SHOULD NOT” get a 
grant.

Things are moving forward in the broadband grant program.  The Telcos are 
against the REMC's getting any money.  I don't think anyone is really against 
the WISPS.  After meeting with the LG and some of her staff and meeting with 
OCRA I think the main thing we need to push for is to renew an Indiana 
Broadband map as part of the Indiana GIS that all counties subscribe to.  It 
would be another layer accessible to the public wanting to know what broadband 
is available in an area. It would be just like the GIS online property 
assessment data layer.  The plan was to use the FCC 477 data which would be old 
data by the time they get it AND the data is misleading and not granular enough 
for seeing where and what speed is available.  Speaking with the LG and staff 
as well as Scott Rudd from OCRA, they are now talking about a GIS Map but 
budget concern is the issue.  (Drop in the bucket compared to what is going to 
be given out.)  If the map is done correctly, it would be a valuable tool for 
the IEDC when promoting to companies to move to Indiana.  Everyone would 
benefit including Indiana Wisps.

Things are moving forward in the broadband grant program.  The Telcos are 
against the REMC's getting any money.  I don't think anyone is really against 
the WISPS.  After meeting with the LG and some of her staff and meeting with

We are putting together an Indiana meeting again this year.  The tentative date 
is May 16th with an Indy 500 Track afternoon again. We need some committee 
members to help with topics and speakers.  A few things that have been tossed 
around:


-Location.  We are looking to expand to a bigger spade this year.  This will 
allow more vendors and conversations to carry on between folks. There are 
couple of venues being pursued. We are looking at a venue closer to the Track 
than last year.

-Since we are keeping with the track afternoon, a couple of ideas being tossed 
around in regards to sessions.  We want to shorten some of the sessions.  
Thoughts? One of the ideas was have several 15-20 minute sessions with a 10 
minute break between each for time to talk to each other. This allows for some 
question and answer after each session.

-Legislation and funding updates

Indiana WISPs,

I wanted to let you all know that I was asked to and met with Scott Rudd, the 
Indiana Director of Broadband Opportunities for the Lieutenant Governor as a 
representative for the Indiana WISPs. I was invited to be the WISPs voice and 
to bring our concerns to the state about things going forward.  This was an 
introductory meeting that established how the LG office would like to 
communicate to the Broadband providers in the future.  I sat at the same table 
with the Indiana Exchange Carrier Assoc. (INECA.org), Cable Association 
(broadbandig.org), Indiana Broadband Telecom Assoc. (IBTAinfo.org), and the 
Indiana Electric Cooperatives Assoc. (indianaec.org).

I feel this is a very good move for the LG office.  AT&T, Comcast, Frontier, 
etc. has only 1 voice the same as we do.  Each Organization has 1 voice.  They 
ask that if there are major issues that we contact Scott Rudd as an 
organization instead of every member calling Scott or the LG direct first and 
if that does not get their attention then the gloves come off.

At the first meeting to get things started we were asked what our starting 
concerns were in the way the state is doing things. Most of the concerns from 
the other organizations were consistent with issues that we have currently or 
may in the future.  The concerns generally involved Permitting and 
Right-of-ways. Those of you who do some fiber and have every requested being in 
the right-of-way next to a highway need to know that now as of Aug there is a 
bond for each permit to cross or run parallel to a state highway. As we connect 
towers with fiber backhauls that will become more and more an issue.  INDOT 
gave no reason for this change and now holds that Broadband is not a utility 
since Net Neutrality was overturned so Fiber and towers in a right of way is 
not a right no matter if you are an ILEC, CLEC, REMC, or WISP.

The first item I brought up was the inconsistent permitting process around the 
state for tower placements whether you are talking 200ft tower or 60ft. each 
county has its rule and permitting process.  A state level uniform process 
would benefit all providers.

The second and third revolved around the state and Governor plans for handing 
out grants.  The concerns that I have heard form most of you is that the state 
has no Idea on where Broadband is and is not as was evidenced by the CAF II 
maps.  I also questioned who will be able to get those funds and what the 
required speeds.  Currently House bill 1065 dictates that the speed be 10/1.  
The Governor Broadband Grant, (if they get to actually give those grants out as 
the money has not yet been allocated) is wanting 25/3 to receive the grants.  
But there is one other stipulation that may knock most WISPs out and that is a 
requirement for Audited Financials.  I have stated that is an issue for small 
businesses and stops Economic Development.  I dropped it very quickly as I was 
fighting an up-hill battle with the other associations in the room as the 
majority of their members are audited.  But I will be addressing this directly 
with Scott Rudd outside of the committee meetings.  But will have to figure out 
a way for the State to verify the stability of each company if they do not have 
Audited Financials.

What other issues do you see that is a state level issue?

I understand that several of you are 100% opposed to Government assistance. But 
the state has decided to go down this road, so I need ideas of how to keep 
other out of your backyard, paid for by your taxes.  Help me help our industry. 
I need your input.

CAF and CAF II was both dependent on providing voice.  The county that I 
started our WISP in just came out in a state report as the #1 county in Indiana 
for Fixed wireless coverage. #1 because how hard I worked.  But 2 years ago I 
did not offer Voice.  So in CAF II the FCC is going to pay a company to 
Overbuild 1/3 of the county that I have 90% coverage in.

In full disclosure I did bid in CAF II to over build that area with Fiber to 
the home.  But was underbid by another company to build what I have already 
built.

The other thing I have heard and have not been able to verify.  In the areas 
that a WISP won CAF II funding the local ILEC can petition the FCC and abandon 
their copper and no longer be the carrier of last resort.  That will make the 
federally funded WISP be the carrier of last resort.  Meaning to all those old 
customers who only want a phone line the WISP will have to provide free 
Internet to provide a VOIP line.  Can anyone verify this.

Brian,

For CAF Phase 1 you are correct.  477 is pointless (my words) if you don’t 
provide voice. Steve Coran said we could be overbuilt in that circumstance. It 
doesn’t mean you have to sell it to them as you posted. It just needs to be 
made available for purchase.

For CAF Phase 2 I don’t recall but I thought the voice requirement was removed. 
I may be wrong. Maybe Steve can jump in?

I DO and will continue to disagree with the use of 477 data.  I literally had a 
congressman in my office a couple weeks ago admit the FCC is handing money out 
based on worthless and inaccurate data.  If they were operating on real time 
data being turned in monthly that would be a game changer.

As far as the money Indiana is handing out (not caf 2), I feel like the state 
using the federal maps is an absolute joke and reminds me of the old saying 
“the blind leading the blind”. The state needs to stop immediately and fund the 
Indiana broadband map again. Indiana did it right when it was funded and Amanda 
had us all getting her data.  If not she was calling you.

I think some WISPs based CAF2 deployments on favorable 3.65 decisions.  Steve 
May be able to say if funding can be used to bid on spectrum in the future 
auction.

I for one have seen tons of competition move in based on tax money being handed 
out.  It has had zero affect on our growth or deployment plans.

In terms of the second item Justin  mentioned I haven’t heard anything like 
that yet but it wouldn’t surprise me.  If a winner is suddenly telling other 
WISPs, businesses or future customers they are the only option or now have 
rights to access certain things or to get the hell out altogether (Basically 
being a bully)... I would be curious to know who is doing this. Those are very 
dangerous claims to make that could result in legal action or having funding 
removed.

So, even if you're reporting broadband coverage, unless you offer voice, CAF 
may provide funding to your area.



I believe OOMA and some of the other VOIP services helps you to check the box 
that voice is available if you don't want to figure out how to do it on your 
own.



I don't know that you necessarily have to have any customers using voice, so 
you can be "comparably priced" to urban areas, but not necessarily cheap or 
actively trying to market to customers.

My Boss John Greene will be there representing NLBC.  FYI this is being put on 
by the REMCs in Indiana and this is basically them showing the state that they 
are the answer to all the rural broadband issues in the state.  They just want 
the state to help fund it.  2 weeks ago I represented WISPs at a Governor 
meeting about how to best spend his new broadband plan money.  There is a lot 
going on in the state right now and I am trying to keep WISPs involved.  
Frontier, Verizon and AT&T think all the money should go to them.  The REMCs 
(Rural Electric Member Coops) think they need it.  Small telcos and WISPs are 
saying we are the ones doing it where no one else has for years.

The big issue is the state is still looking at 2 year old 477 data that is not 
valid or even UpToDate.  Even then Wisps cover areas that are shown as not 
covered because they don’t do phone.  Other areas are show as covered but may 
only have one home in a whole Census Block by a cable or Frontier and that 
means it is covered.  So the state does not even know where service is needed.

I think the only thing that will save WISPs from being overbuilt on this is a 
challenge process that does not require phone.  Most small wisps are not going 
to have the audited financials needed to get funds.

The state is not even sure what the speed requirements are going to be: 10-2 or 
25-5.  It’s a mess but I am trying to keep my finger on the pulse.

Actually, that is the old Kendallville Internet support email, which was two

   Folks,
   Who would be interested in a WISP get together when the weather 
gets better? I know we have Alabama for the WISPA spring show coming up. I was 
wondering who would be interested in getting together for our group.

   There are a couple of things going on that might be of interest. 
 We are trying to get some interest going for an Indiana network operators 
group.  This is similar to the http://chinog.org/ group.  They have really 
grown into a good group for the techies among us.  Several of us would like to 
bring a similar setup to Indianapolis.  This way we can expand our group to 
some of the other non-wisp operators too.

   As I sit here I was thinking we might be able to have a one day 
get together. Maybe we have an Indiana WISP meeting first thing in the morning 
from say 8-10.  Then we can have an agenda that is half business and half 
technical for the rest of the day.   Cost wise It would be a very small fee 
just to cover meeting room, if any cost at all.

   Thoughts? Volunteers? Ideas?

Amanda O’Daniel reached out to me about a meeting with the Lt. Governor. She 
wanted to know who our WISPA leader is in the state. Below is my response.  
Toss your ideas and thoughts out.  Probably need a single point of contact we 
all agree on so we can find out what is needed. Sounds like the state is 
wanting to work with us.

When Rick Harnish was the WISPA director, he put together a few meetings.  Now 
that leadership has changed at WISPA, the local WISPs seem to be in charge of 
putting something together
on our own.

We really haven’t had much of a meeting since the last time we all got together 
to talk about mapping.  ( you included ). I can’t recall, but Eric may have put 
that together.

I know Steve Barnes, Eric Rogers, Scott LePere, Justin Wilson, Scott Reed, 
Brian Gray, Don Renner and myself all chat or see each other on a fairly 
regular basis.  There are others here in the state but I would say any of those 
mentioned above would be happy to sit down and chat.

Let me reach out to the group.  I would venture Steve Barnes would be a good 
initial contact since he sat on the board last. I wouldn’t count Rick out 
either but he doesn’t work for WISPA.

I’ll circle back soon!

BG Networking or Mainstream Fiber networks is a lot of talk.  But the seem to 
raise a lot of havoc in lots of areas. They announced they wanted to build in 
my area. Got all kinds of press and didn’t do a thing.  We however have built 
all kinds of fiber and several more projects planned.

I am out of my main office today and don’t have the time to call.  I only saw 
one hotel restaurant.  It’s a Sheraton so I bet it will be $20/person.  Someone 
may want to call and see what the cost would be and if there is the ability to 
set a meeting.  Since the Hotel is sold out and there is no other breakfast 
being provided that day by WISPA I bet it will be a long wait unless we can 
reserve 25 or so seats.  Last conference I went to in a big hotel in Indy that 
only had one place for breakfast had some that waited 2 hours.

Also according to Google Maps there is no other breakfast place in 5 blocks.

a good idea at Memphis.  I know everyone is busy so I am thinking an after 
dinner type of thing.  We are in the process of trying to find an informal 
place to have a round table discussion.  I have been to enough of these to know 
that everyone is going a mile a minute between clients, vendor dinners, etc. so 
meeting for an hour might be ideal.  If the discussion goes longer you can 
stick around.  I am thinking something like:



Roundtable Introudction.  Get to know your neighbors Indiana Specific 
legislation to be aware of resources available to all of us Maybe a raffle. 
MidWest-IX is thinking of throwing in a gift certificate to somewhere local. No 
sales pitch involved. Just an incentive to get folks to come.



Looking at the agenda on Wednesday the exhibit hall reception is over at 7:15.  
We could meet at 7:15 or 7:30 until 8:30.  That would still give time for 
dinner.  Or maybe earlier to still catch the vendor crowd?  I am not opposed to 
meeting at 6:30-7:30.  That would allow folks to still catch up with vendors at 
7:30.





Thoughts?

[Indiana] SB 213 - Siting of Small Cell Facilities for Wireless Communication

Indiana WISPs,

We have been working with the IBTA and the INECA group here in Indiana to get 
the bill amended.  I think we have come to the point that the bill is safe for 
WISPs.  The bill that originally had a broad statement of wireless internet 
services is now defined as Small Cell Facility.  Meaning that this bill really 
has nothing that applies to WISPs.  It is mostly to be a protection for small 
cell attachments on utility poles for larger carriers.  It may provide some of 
us additional protection if you are a CLEC and can get a pole attachment 
agreement to put a small cell up on a power/ telephone pole.  It sets some 
controls and permitting process.  Our concern was that if the definition was 
not corrected to be small cell that it could be applied to any broadcast device 
on any public owned structure.

We appreciate the work of Steve Rogers, Director-State Government Relations, 
AT&T Indiana. John Koppin of IBTA, Alan Terrell of INECA, and John Greene of 
NLTC for the work on this process.

of your Indiana Statehouse Senators.  This bill has had several amendments to 
it and the main one writing the amendments is the Lawyer for Indiana AT&T.  
They are looking to cover their butts and wanting all of us to have to play by 
their rules.  This will require us to get additional permits to add any 
broadcast device to any public owned vertical asset.  Water towers, broadcast 
towers, and even poles in public right of ways.   It wont matter if the towers 
are state county or city, if they are public owned we will have to apply for 
permits for all devices.

Again there is nothing to do yet but if you are talking to any State Senator 
you might bring up Senate Bill SB213 and we really want Unlicensed Devices that 
provide FIXED Wireless Broadband excluded from these permitting requirements.

I read the majority of this and I am concerned that this opens up a required 
permit process for all public tower locations.  Water towers included.  What do 
others think.

It is designed for small cell and communication to public personal mobile 
devices.  However, all the broadcast devices are what we use.

Guys I had a long conversation with Kyle today as well.

I think there is a lot that Agile could offer us.  I told him directly that I 
had no gripe with him or his company and given the opportunity that he got, I 
would have taken it as well.

The issue that I have is how the state of Indiana started this as an RFI for 
management of INDOT and State towers and it grew into control of those towers, 
Fiber conduits, and management of state right of ways that Agile is the whole 
seller for but is not limited to wholesale only.  They have the opportunity to 
utilize that infrastructure and compete with us not just be a managing company 
for the facilities.

Again I have no issue with Agile or Kyle Quillan just what the government has 
done to us again.  If this gets finalized through the state house I will likely 
work with Agile for some space.
