 at this point. Speaking from personal experience, and having been in
 your spot for an amount far less;  you can hire a NJ licensed 
 attorney, to remove the  judgement and ask for another trial date.
 this should cost a few hundred dollars, but again form experience-in
 the state of NJ, it is very easily done!  with a good attorney!  good

can ruin any perspective, but you prepared yourself well. I read your message

We have all had unfair things happen to us in our life and this happens to be

For what it's worth, (and that's admittedly very little) I decided when all 
this crap started that any future work needed would go to Studio C. Though to 
be honest collecting has really slowed down recently and it tends in the main 
just to the be larger paper I'd want backed.

Prior to all this I was really impressed by what I saw of Poster Mountain. 
Wouldn't go anywhere near them now.

all manner of difficult business situations with patience and absolute 
honestyhell, you saved Studio C when the business was in deep trouble, 
mired in a mess that was none of your doing. Your loveliness as a human being,

blatant, obscene miscarriage of justice this whole situation is.

 and in my opinion, not its finest moment!.

so you have a  default summery judgement against you!   not so bad at this 
point. Speaking from personal experience, and having been in your spot for an 
amount far less;  you can hire a NJ licensed  attorney, to remove the  
judgement and ask for another trial date. this should cost a few hundred 
dollars, but again form experience-in the state of NJ, it is very easily done!  
with a good attorney!  good luck let me/us know if we an help with an attorney.

[MOPO] As The Dracula Lawsuit Turns - Final Update

Hi All - I did not think that this would result in so much response both here 
and on other forums.  A few comments to address some of the questions that have 
come up:

When I received the initial complaint, I did not ignore it.  I retained an 
attorney in New Jersey to handle the response.  When it became apparent that I 
would not be able to keep counsel, I figured I would represent myself.  New 
Jersey court informed me that due to my company being a corporation, I was not 
allowed to.  At this point I knew the end result would be a Default Judgment. 
So it was no surprise to me.

On another forum there has been some discussion about restorers and their 
obligation to their clients vs moral obligation to the hobby.  In this case, I 
did the restoration, knowingly restored incorrect information at the bottom, 
setting up a red flag on this poster.  This poster was sent to John Davis for 
authenticity, my red flag was changed, obviously to further authenticate the 
poster.
I publically stated my concerns about the poster and, well, we all know what 
happened then.

I had planned, well in advance, for the potential ramifications of this case.  
This will not close Studio C, we are alive and well.  

We have all had unfair things happen to us in our life and this happens to be 
one of mine.  It is just money and thieves/crooks, not really important stuff. 
That being said, it has still been such a help receiving all the encouraging 
words from all of you and you will always have my very heartfelt appreciation.

Did I ever tell you all about the time that Joe H. overbilled my credit cards 
by almost $4000?  Because we were behind in Quick Books, I did not
find this out until about 6 months later.  In the meantime, Joe had run into 
difficulties and left the business.  Diane never missed a beat.  She absorbed 
the
charges and put us right.  She is one of the most stand-up people I know.

I wrote the Judge in this case and said so.

This is a miscarriage of justice.  Sometimes it just happens.  We all hope that 
it won't happen to us.  The idea that Diane would help to perpetrate a fraud is 
just
patently wrong.  

So I hope you feel good about yourself, Mr. Rega, wherever you are, whoever you 
think you are.  What goes around.

Diane, chin up.  We'll get you some business.

Diane - as we dont know all the facts what happened and you are
taking this is stride, one thing that could have been done was change
of Venue if you met certain state laws or if your health or ability
to get off work... also I hope that in the defauly you explored if
you could request a review or appeal.. make sure your limitations
didnt run out.. I would think to invest a few hundred bux for a legal
opinion may be well worth the cost vvs that judgement. Also you could
get a negocociator to discus the settlement and perhaps get a
reduction... as this will show up on all the credit reorts as a
judgement, Dunn and bradstreet and the like and could affet the
credit line of the business.  You have a good reputation amoung MOPO
people.,so the value of your Good will in your craft is important
also.. Perhaps draft up a form that people sign when they give you
art in the future that would hold harmless any intellectual property
issues related to the works and also put everyone on notice that you
are acting only as a restoration artist. You and John and others
could creat a standardized document that could cover all legal
aspects and considerations. this way you would be in fear each time
someone brings in a high end piece and the stigma and also trauma
wont haunt you.
We all make mistakes or may overlook potential issues.. its not the
end and It will also bring light to the subject in the future, I
would like you to explore every way to reduce the amount you need to
pay.. It also may be covered in your business policy under liability 
if not see if you can also ad a rider onto the excisting policy..

thats what I thought also.. but NJ law may be different then Cal and
Oh... wow if you could help her that would be great and if she could
get some MOPO councilors as we have soem to review the case and get a
retirial she could prepare and defence and perhaps get a dismissal or
at least a major reduction settlement... also the other firm may have
not represented her proper.. Its worth anther look.. that was kind to

obviously you'll have to see if New Jersey has reciprocity with California.
if so, before they cab get any liens in Cal, they'll have to go 
through the court system and you can plead your case in front of 
California jurists if you challenge the liens

years in time, today I received a Judgment against me in the amount of:

$263,312.50, plus attorney fees of $18,134.80.  That is our justice system,
and in my opinion, not its finest moment!.

 

Thank you to all that tried to help me, and to all the encouraging private
emails I received about this.

Diane I believe didn't have an attorney representing her in New 
Jersey. So Tom Riga got a default judgement.
it isn't just that easily collected however as the states have to

Diane - well I understand your durt and suffering...after 4 years of
attempting a home loan I had my councilor have a nervous breakdown,
the lender has kept failing to reduce my 8.9 interest and this am at
like 8 in the morning they called and said they didnt get all the
documents... my mind and heart weny numb as they woke me from sleep...
 several years ago.. I had to pay 100,000 chap 13 reorg.. which we
did then my ex wanted a divorce.. I lost my paid off home.. I was
debt free 834 fico.  then bought this house in 2997 113 K and at 8.9
did numerous stupid moves trying to help others and just silly
stuff.. then my health failed and I almost died last march... so I
understand.. I cryed, i yelled at God, i lost faith and was angry I
was ever born at times because the Vhristiand people I had
thought would help left, the friends left and my credibility went
down the sinkhole... and all of a sudden what took me 35 years to
build became a laugh. people ask me what do you do... what have
you done..?  like im a mirage... But Diane God didnt leave me..
and true friends didnt leave me... and they wont leave you... Its
when we become broken, and all our security is gone and we have no
where to turn.. that we find out what matters, and we can do things
we never could before. I kep saying God if you there what is the
deal.. how am I going to do this??? especially healing a foot that
wont coperate.. the pain alone makes me want to take pain pills...
But I know then Ill want more  so I just say OK foot lets
practice getting better..
So the test is when we want to not do what we know are Good
things.. or get bitter when we get treated unfair as we get treated
unfair in all things eventually,, But we also know what Kindness and
Love feel like when we get Grace from people that do very good
things. so Go take old ladys for a walk In spite of all the
injustice...Go feed the hungry that need food but may not really
deserve it because they earned it,,, because when they see and eel
charity they will see that You gave not for reward but because you
had mercy... when I thought of all my gripes and i doevery day... but
then I see that it doesnt matter what others do it matters what I do
as maybe i can help someone in a small way... also... like today.. I
just thought get my documents in order with details and data as if
they are wrong the paper trail does them in if based on lies..
suggestions to you... find some law students that would do a pro bono
case... learn the law yourself.. I bould lawbooks like the attys uses
and became a paralegal to my atty and learned  1000.00 worth or
trademark law books so i could fight fire with fire,, because its law
research that gets pushed back and 4th so my guy had a ADD man who
spent like 4-6 hrs rseaching law as I was obbsessed..
the good news is I read 3000 books on Movie memorabila so I also got
educated on my field.. so it was a blessing... and i was motivated by
adversity... same as now...when you get thrown in the deep end you
learn to swim or your drown so cry , have a fit, get depressed...
as thats what peopel tend to do... OR get proactive and love people
more and see that you recieved a Gift.. a Gift to understand what it
feels like to have that kind of pressure and so give even more as the
bad guys only win if the break your dignity and your ability to love
and help old ladys and little Kids... get some advocates to help you
and if you truly have a case..then plead it... If not reach a
settlement as they would like something rather then nothing...
propose a seettlement that could be realistic and im sure they would
consider that,,, otherwise what will they accompolish? God Bless and
hop it works out..

when I sued and recieved a judgement I was able to find law to Piece
the Corporate veil. Called the joint tortfeasor theory, it says that
Corporation officers  direct the corpoation to make torts so the Llc
or the corpare no protection against judgements, Howevere my
opponents tryed to hide behind a bankrucy stay but the judge found
them personally liable. piercing the Corp veil.. so until they
satisfied the Judgment they could not form any shell corps or other
business pursuits. reading the law is hard as it takes a blacks law
dictionaart to understand leagleses, and The US Code books, and the
various books in case law.. I bought and studied at home// In my city
we have several Law libraries I visiited,,, and talked to the federal
Judges office, FBI, and the USPTO In washington... plus I prayed and
learned my craft..and spoke to some very wize teachers
Like ED lowe who held many patents and invented KITTY litter..Bernie
cousino who inverted teddy ruxbin and ran the Edison institute in Ft
Meyeres FLA andalso invented the Black box frictionless tape among
others, these me called me on Christmas eave and told me not to give
up.. so fortify yourself with Good people there are many Mope
folks have been like my family... that helps alot when all seems

Diane its a real shame.  Obviously, the over whelming issue was your lack
of legal representation, as opposed to the actual facts.

I place Thomas Rega in the same low esteem that I have for Kerry Haggard.
 Frankly, I am not at all sure they didnt know each other and work together
in deceiving our hobby.  Both are no good crooks.

Does anyone on MOPO actually know Rega?
