[QUAD-L] Re: broke both legs!

2007-08-06 Thread Quadskydiver
Thanks for all the replies,
Nearly everyone has advised getting an attorney. I have already talked
to numerous attorneys all of which said that I needed to prove negligence by
Levo. A few of them said if I could find a product recall, or warnings about
the use of their seat belts, for instances of others having this problem it
would help solidify a good case. Anybody know anyone else with this problem,
or about product recalls, warnings, or etc. or an expert about this type of
product liability would be greatly helpful.

Glory to God & Thanks, Jim

I truly wish you loads of luck. You will need more that you did when you
chose to use your
"old Levo" standing chair. As you know and your attorney will find out Levo
was a Swiss Based Company with a North American Office in Atlanta, Ga. In
2006, Levo was sold to Dane and the company has relocated to Minnesota. Was
this a most unique situation or is there a commonality of series of incidents.
Who built YOUR chair, the old company or the new company. An attorney will be
best to advise you in this matter and again, I wish you luck. And lots of it.
  Best Wishes

This caused both femurs to break just above the knees. I believe
this would be a product liability problem, if the chest belt had an electric

I'm sorry you've had so much problems. Their is a law to protect a
purchaser of large ticket items such as a home, car, & etc. As far as I
understand it, you have like 30 days to get a refund. You might check into this
and hopefully be able to wash your hands of that whole mess.

[QUAD-L] VOC REHAB class action lawsuit?

2007-07-28 Thread Quadskydiver
Anybody know how we can file a class action lawsuit for all the
problems we all have had with VOC. REHAB.? I have tape recordings of most of my
meetings (to meet my inability to take notes due to my Difability). VocRehab
furnished me a replacement standing wheelchair in 2000. Only to bring the old
Levo they declared a LEMON back 9 months later. It was supposed to have been
rebuilt with a 90 satisfaction guarantee, WHICH THEY WOULD'NT HONOR! I refused
to accept this old chair back, but my counselor, his suprvisor, and a DME I had
already written Voc. Rehab, that I didn't want to deal with. Which is written
in their handbook as a right we are supposed to have, to decide who we want to
furnish our equipment. Threatened me on recording that either I accept this old
chair back or they would take both chairs and load tem in their pickup and
leave me with nothing. It was a good thing I wasn't able to hold my pistol or
that outcome would have been different.
When I was first injured in a rehab. hospital. Voc. Rehab. furnished an
electric tilt and space chair. Voc. Rehab. informed my family they intended to
put me in a nursing home 20 miles away. To be bussed each day for 1 hour of
therapy. My mom decided to take me to their house to live, and when her husband
told the counselor. The conselor told him if they took me away, he would take
the new wheelchair out from under me. The conselor told Bob the REHAB., DME,
NURSING HOME all scratch each others backs. So either we play their game or I
lose that wheelchair. That was what happened and Mom & Bob bought a manual
chair for me to use.
Then 9 mnths later after moving to mom's Voc. Rehab. bought this old
Levo in 1997. Fortunately one of my good friends dad was the supervisor over
the Shawnee, OK. district. He conveniently owned a DME in a town over 60 miles
away. That was how I ended up with this old Levo standing heelchair to begin
with. Now most incredbly in 2004 I took Voc. Rehab. to a Fair Hearing (NOT).
Fortunately I won that Hearing and Voc. Rehab was ordered to replace this old
Levo. But they appealed that decision and it was overturned against me. I had
to represent myself because none of the Federally funded agencies, that are
supposed to help represent me would do so in a good way. They actually wanted
me to let them load 7 years of boxes of files from every agency since my crash.
So they could go through each box to find files dealing with the wheelchair.
Obviously I knew better and didn't want those records to end up in the landfill
dump.
Their have been too many of us done this way, surely somebody will help
all of us get a big settlement. To make up for the pain, torment, stress, and
everything else. Especially the life I have missed out on during the past 10
years. While trying to get services that have been promising repeatedly by Voc.
Rehab. on recordings.
Let's gather together and finally become a UNITED FORCE TO BE TAKEN
SERIOUSLY!

Glory to GOD & Sincerely, Jim Rice

Re: [QUAD-L] civilian's writing parking tickets

2007-07-24 Thread Quadskydiver
Luke,
Shawnee Oklahoma passed a law to allow civilian's to write tickets. I
helped get that law approved while living there. They required a class and a
down payment due so, the down payment provided a ticket book and a polaroid
camera to turn in with the copy officer's usually keep. Then as you used film
they replenished it from the money made from tickets you turned in. I don't
live their anymore, but when I moved we were trying to get paid for every
ticket they collect from each person. But I got a lot of satisfaction writing
the tickets to people that obviously didn't have disabilities. Especially smart
ass kids that jump out of their vehicle and run into places. It was better than
pay to me, especially some of their faces. I couldn't find their web page , but
my caregiver is here to put me to bed so I'm in a hurry now.

Hope this helps, Jim Rice C-4,5&6 10 yrs. post

[QUAD-L] RE: From my Redman wheelchair dealer

2007-07-21 Thread Quadskydiver

How does this reply sound?
Thanks for your replies, I just forwarded your complaints to my DME
Supplier that is trying to sell me this new Redman. Hopefully he will be
able to help both of you with your problems. Since they want to sell me and
many others on their new chair. I pray that this will be enough incentive to
get Redman to do what is right. I really appreciate your feedback, even
though it wasn't what I was hoping to hear. But the TRUTH hurts unless it
comes from the big book, and your on the right side. Does anyone have any
good reports?
Fortunately out of all the members you 2 are the only one's that
have replied with bad, but nobody has replied with good. This really leaves
me in a mess because, for the last 10 years the standing Levo I have been
using. Is not covered by medicare and the Permobil doesn't give me good
preassure relief. To get off the Sciatic nerve damaged by a Permobil in
2000. Standing also enables me to be much more independent. Such as being
able to reach upper cabinets, thermostat, bulletin boards on wall, plus it
really helps a lot with getting bowel movements more regular, and my legs
are still extremely muscular to enable me to walk when my miracle is
manifested. He brought the new Redman yesterday and my friend is a genius at
fixing anything. He is the only reason this old Levo can even still work.
His opinion was that the new Redman is built much better than the old Levo.
Which he has had completely apart numerous times for repairs. Does anybody
know of a better option?

redman chair would come through Medical Specialty. So in your case, you
would deal with me, not redman. i know how important this decision is

Here are a couple replies,
This sure doesn't sound good. Since you are a new dealer for
Redman I thought you might want to check this out. I pray this
could work out in all four parties favor if you were able to
help this lady get her refund. Medical Specialty could get
some great publicity, along with Redman.
If you were able to help Michelle get at least part of the
refund she is talking about. And possibly help Dave get his
chair repaired. It would probably help get a good word out
about your company and Redman. We are members of a worldwide
Quad-list that have many members looking for a reputable DME
Supplier.
That would be before adding me to the list of satisfied
customers. I am always looking for WIN, WIN situations for
everyone. Before moving to Tulsa I was Director of public
relations for the Oklahoma Spinal Cord Injury Association in
OKC, and I am still a member there also.

[QUAD-L] Convention on the Rights of Persons with Disabilities,

2007-07-20 Thread Quadskydiver
Anybody heard of this treaty?

I happened to find this while looking at U.S. demographics at
http://en.wikipedia.org/wiki/Disabled. Either I am in the dark or we all need
to get the Government here to become more active enforcing these Rights.
Especially over utilization of nursing homes to meet long term care needs.

On December 13, 2006, the United Nations formally agreed on the Convention on
the Rights of Persons with Disabilities, the first human rights treaty of the
21st century, to protect and enhance the rights and opportunities of the
world's estimated 650 million disabled people.[1] Countries that sign up to the
convention will be required to adopt national laws, and remove old ones, so
that persons with disabilities would, for example, have equal rights to
education, employment, and cultural life; the right to own and inherit
property; not be discriminated against in marriage, children, etc; not be
unwilling subjects in medical experiments.

Re: [QUAD-L] supur pubic tube HOW TO Guide

2007-07-19 Thread Quadskydiver
Hi W,
I didn't see the post from luke you responded to. I have had a supra
pubic 18 french size for over 10 years. I too am very active and live alone and
can't imagine any other way. I use a leg or belly bag (for shorts or
swimming). Then at night I use a 4000 ml bedside bag in order to prevent a
smaller bag from backing up and causing disreflexia.
A BIG ADVANTAGE to using the large bag at night is that I can drink as
much water or whatever during the night as I want. Also I can go to a sporting
event, concert, movie, church or drive a long way without stopping for a potty
break.
The only disadvantage is that I have my cathater changed at least once
each month. Also by having the cath in my bladder I contantly have a way for
bacteria to get in my system. I have found that rinsing the bags 1/3 full twice
with water and shaking them hard to clean all the corners and tube. Followed
buy 1/3 bag of water and I use a 60ml syringe to add vinegar 1 to small bags
and 2 to the bedside bag. Which I leave in the bag with the caps on the ends of
the tubing, hanging from the towel bar until ready to use again. This has
helped reduce UTI's to about one every 90 days. My cath does bleed
occasionally, but usually only a small amount, less than a golfball size spot
on a pad that I sleep on my belly on. Usually a day or two following the
change, and then if it gets pulled on hard by clothing or carelessness by
providers. Which doesn't happen very often. Another helper is an elastic leg
strap which holds the cathater in place at the connection of the bag and cath.
near my crotch, always leaving slack between the strap and belly. I change my
cath. once a month every month usually teachng someone ow to do it. I get my
supplies delivered every month through http://www.byramhealthcare.com/. Every
morning and night I have caregivers clean around the cathater site where it
enters my belly. 1st I have hem take 3 quares of toilet paper and roll it up
about the size of a cigarette to make a circle around the tube site on my belly
to stop liquids from spilling. Then we use a 1/3 cap of Hydrogen Peroxide
poured around the tube and then a q-tip to clean any mucous or blood. Then 2
drops of Betadine on the hole and triple antibiotic on a Q-tip to lubricate
around the tube and pull the cathater to stretch it slightly and lube around
the tube up about 1/2".
One last piece of advice is to learn how to change the cathater sterily
from the doctor. I would even suggest video taping the doctor changing it
properly. Then watch it over and over so you know how to explain to someone how
to do it if an emergency occurs. I have caught several nurses not making the
change properly while talking through every step before they did it.Twice I had
a careless caregiver pull it out of my belly accidentally. And a few times the
cathater has stopped up inside my bladder. Requiring me to teach anyone with
TWO HANDS to deflate the defective cath. bulb and replace it quick. As I said I
have had my super pubic in over 3,950 days so it is not a very common
occurance. Good Luck, Jim Rice

  Hiya Luke

Check out the term "Walnut Bladder."

Check out the Uro-cycler too. They are based in Florida or Texas.

  Best Wishes

hey everyone

i just got back from my urologist's office and I found out that because
I've had a foley cath in for the past three years my bladder has shrunk. i
have a lot of discomfort (pain) with the foley. he has told me my alternatives
to the foley and i believe my best option is a supur pubic tube. i'm really
active, i do all my own transfers, i live independently--will i still be able
to do these things with a supur pubic tube? i hear that they can bleed. what
y'alls experiences with the supur pubic tube?

Re: [QUAD-L] Redman wheelchair opinions please

Thanks Wheelchair and Tom,
Where do you find trouble with not enough torque. Can you give me an
example where I can test the new chair to see if their nw motors cured that
problem. This new Redman is supposed to have new motors and the DME supplier-
is bringing it tommorrow. The DME has just returned from Redman's training in
AZ. He started out attempting to get me to settle for a Permobil again. Even
though I told him about the previous problem I had with Permobil, but he had
been sold on the availability of parts. After finding the Permobil presentation
still didn't get my necessary preassure releif.
Then the DME had Redman send a sales rep. over with an older model
chair. And the backrest actually broke while he was trying to adjust it to fit
me during the demonstration. That salesman didn't impress me or the DME with
his lack of knowledge of his product. But he was supposed to be getting the new
model chair with new and improved motors. Then was supposed to return for
another presentation. Instead the DME imformed me he was going to Redman's
school to be able to sale and when necesary repair any product he sales. This
DME lives 120 miles from my home. After he returned from their school he says
that after getting to know more about these wheelchairs. He actually feels
better about selling these than the Permobil he as been selling. Not that I
expected him to come back dissappointed in the poor quality. One question I
seem to have heard bad about Redman, it seems like I remember hearing that they
had fragile electronics. Does anyone know about that or anything else?
I have been a year without a wheelchair and as mentioned earlier. My
doctor said his PT said I have been blackballed as a trouble maker here in
Oklahoma. After being successful getting 2 State Senate bills passed and signed
by 2 Governors. I am excited to have a light at the end of the tunnel to get
out of bed and get active again. But I am trying to be cautious and not jump
into something I would regret. So I am asking for all you experts to help me
make a good decision. I have attached the link for this whelchair if anyone is
interested. http://www.redmanpowerchair.com/ The website says the
wheerlchair is self diagnosing under the history link. Anybody know what that
means? Glory to GOD & Thanks, Jim Rice
PS. Does anybody know a lady I remember in Oklahoma that owns a Redman?

Like W always says repairs, adjustments and service are the most important
thing in deciding on our chairs. I live in WI and have a redman standing
powerchair for three years now. But only seen a tech 2 times at $500.00+ a
visit. If it breaks down they will send parts but YOU have to get them on. If
you live near Arazona service might be better. I have trouble with not enough
tourqe when needed. There answer is to turn up acceleration. The chair works
good but service sucks here again your location is everthing.

Anybody have experience with a new Redman standing wheelchair? I have
used a Levo over 10 years, but it is past shot, and hard to get parts for. A
Permobil doesn't fit worth crap, and in 2000 the State furnished a new Permobil
with the seat pan installed upside down leaving the 1" support ridge standing
up into my sciatic nerve causing damage and severe pain every since. Your
expert experiences would be much appreciated.

[QUAD-L] HELP! Wheelchair broke 11 months ago

2007-07-04 Thread Quadskydiver
Does anyone know who I can contact to get Oklahoma Dept. of Human Services
(ODHS) to get my old Medically Necessary standing wheelchair replaced.
Originally that standing w/c was bought by Dept. of Vocational Rehab. (DVR) in
1997. In 2004 I took DVR to a fair hearing to get this w/c replaced. I had to
represent myself which took forever to prepare for. Relying on others for
volunteer help getting prepared and to my amazement won that Hearing. Much to
my disappointment DVR appealed that decision and it was overturned against me
by the Director of Human Services. Based on false information which I could
prove.
Unfortunately a well known attorney approached me offering his services
pro-bono to help me meet the deadlines. He took my information and then let the
time run out before dumping me. And DVR then dropped me from their program
stating I was uncooperative. At that time my Advantage Program case manager
said they would get the new Medically Necessary standing wheelchair since I
didn't have any other pay source. Now 3 years later and countless promises made
by my case manager that a new w/c was ordered, have fallen through. But I have
received nothing but one excuse after another. I am being discriminated against
due to my disability. I am ignorant about where to go for help. The agencies in
Oklahoma that are supposed to help have not done so. I now realize how ignorant
I am letting that attorney take that documentation concerning the appeal. But I
have been on pain med's over 7 years which really impaired my judgement and I
really screwed up.
I am currently living in a home in my most integrated setting. Not
having a dependable wheelchair to use daily is making living here increasingly
difficult. Any advice on how to climb out of this hole would be much
appreciated. Glory to GOD & Sincerely, Jim Rice
