Kaltsi's comment is correct and helpful. I was able to install the current .20 driver from NVIDIA (linked in his comment) on 2.6.31-2-generic. This still happens with kernel 2.6.30.6 I have tried a few things including using jockey to install the nvidia-glx-173 re-installing drivers a few times. I am unable to run the command i had wanted to swince i cant get a terminal to stay open. I will try it in TTY later.
