Actually it just very badly written. It sounds like they want two tiered
pricing which they can legally enforce, but only if they are VERY clear and
have some kind of "I have read and agreed to these conditions' button. It is
within their rights by CONTRACT to limit use or charge higher prices to
institutions, but  they would need make sure this was spelled out and
accepted.
As I have said before, if a company is the sole source of a title, they can
pretty much determine the terms of sale and can easily restrict uses that
would otherwise be available under copyright law, but once a film is
available on Amazon, Netflix,
MIdwest tape etc you can buy it  and use it in any legal way.

Sounds like you wouldn't be using these for "institutional usage" as defined in 
the "license" so I would say you are ok.  The additional money seems to be for 
face to face public performance rights.

Here was my original response to the individual quoted below regarding 
the scenario, which stemmed out of a broader discussion on ILL practices:


"There are major copyright concerns with this scenario -- although I 
agree there is value in pushing the envelope in certain areas (fair use 
pertaining to media, for example), there are others where the law is 
quite clear and I'm not quite sure how one could justify that "copyright 
issues were not involved" in duplicating copyrighted, non-public domain 
materials.  Even if a VHS was out of print, the DVD copy could only be 
used on-site, as a 'preservation copy'.

So we're definitely thinking along the same lines and I don't plan on

circumvention prohibitions...unlikely LC is gonna go to the mat for such

Well per Mr.Smith Goes to Washington "Lost causes are the only ones worth
fighting for", but alas I think this is a lost cause.
You have librarians, academics, archivists, independent filmmakers etc. Vs
studios and multi -national corporations to sway a Congress that can't pass
health care reform. My money is on the corporations.

[Videolib] Looking for Case Example

Anyone out there on Collib-l?  If so, you might want to tune into a 
conversation going on over there re: converting VHS to DVD without 
adherence to copyright.  Here's the last bit I received from someone who 
appears to be advocating flouting copyright law just because it is 
inconvenient / expensive -- just curious if anyone has any case law 
examples I could toss back off the top of their heads:


"Many educational tapes cost $100 -$300 - some sets are in the thousands 
- and buying a reformatted copy of the same title is wasteful and 
absurd.  I don't know if any library has actually done such transfers, 
or would admit it if they did, but I wonder: has anyone has ever heard 
of a legal challenge to a library by a copyright holder for its changing 
a VHS to a DVD for use in classroom instruction? (Actually,this is done 
occasionally by instructors themselves, who are much more cavalier about 
Big Brother copyright.)  I'd be satisfied to hear of a single case. The 
real problem in making transfer copies is getting good quality, same as 
with any other digitized media."

The film is about a camp in Argeles at the French border where 80.000 
Spanish republicans where arrested by the French government. A camera 
was smuggled into the camp and Jean Paul Le Chanois succeeded to edit 
the material. The authorities forbid the film and the original version 
was lost but a shorter version of 30 minutes made for the US could be 
saved (title: A people is waiting).

If this might be the same version you have mentioned is not quite clear, 
but perhaps it is:

"At any rate, regardless of whatever the real co-
llaboration of Jean-Paul Le Chanois (whose true
name was Jean-Paul Dreyfus) was in Espana
1936, it was not the only documentary on whi-
ch he worked which had the Spanish Civil War
as the main theme. The other ��lms were ABC
de la liberte, in 1937, about the troops�’ �’cultural
apprenticeship�’; S.O.S. Espagne, in 1938, whi-
ch tried to impress on international public opi-
nion that help was needed for republican Spain
to be able to win the war; and Un peuple attend,
in 1939. Issue 138 of the Spanish journal Diri-
gido por, published in August 1986, contains an
interview given by Jean-Paul Le Chanois to Es-
teve Riambau and Mirito Torreiro in which the
French ��lmmaker states that the documentary
Un peuple attend contained images of the exi-
led Spanish republicans who lived in really dif��-
cult conditions in the refugee camps in Argeles.

The editing of Un peuple attend was banned by
the French authorities and the negative was des-
troyed, but a copy remains which was intended
to be shown in the United States �—entitled Peo-
ple Is (sic) Waiting �— recovered, according to Le
Chanois, by former members of the Internatio-
nal Brigades. One part of the material ��lmed by
Jean-Paul Le Chanois is contained in Refuge,
��lmed in 1939, a documentary edited by Irving
Lerner in which Cine-Liberte and the American
Medical Bureau participated."

The results of the 108 Study group (and orphan works legislation) have 
convinced me that working with what we have may be our best option. It seems to 
me like any copyright "reform" is likely to result in gains for corporate 
copyright holders and losses for users.

already weighed in on our side.

Hello Gary,

I receive news from the listserve but for some reason I can't be part  
of the conversation. Everytime I try to reply, no one gets my reply.  
Can you please look into that for me. Right now there is are  
interesting film suggestions for Haiti film series that Blain wants to  
do in SF as Haitin-American filmmaker I would love to jump into the  
conversation but I can't.  I see that peole are coming up with titles  
but non of them beside Man by the Shore is made by a Haitian or

Formerly a thriving, prosperous French possession inhabited by descendants of 
African slaves, Haiti is now one of the poorest countries in the world, while

This powerful documentary takes us into the hidden world of voodoo 
practitioners and offers unique insight into a frequently misunderstood

Children of Shadows

In Haiti, some destitute families give up young children to work as unpaid 
domestics in other households. The film reveals this exploitation.

Dreamers: The Painters of Haiti

The artwork of unschooled Haitian artists, painting with riotous color and

There's /The Price of Sugar/, which won a spot on our Notables list last 
year (2009).  Great film, though controversial to the point of 
litigation.  From the website's 'About' section:


"In the Dominican Republic, a tropical island-nation, tourists flock to 
pristine beaches unaware that a few miles away thousands of dispossessed 
Haitians have toiled under armed-guard on plantations harvesting 
sugarcane, much of which ends up in U.S. kitchens. They work grueling 
hours and frequently lack decent housing, clean water, electricity, 
education or healthcare. Narrated by Paul Newman, "The Price of Sugar" 
follows Father Christopher Hartley, a charismatic Spanish priest, as he 
organizes some of this hemisphere's poorest people to fight for their 
basic human rights. This film raises key questions about where the 
products we consume originate and at what human cost they are

From what I understand, the legal issues have prevented the 
availability of the film for home video release, but it is available 
with PPR to institutions.
