Does anyone have any 'go-to' articles on streaming video in academic libraries 
or any bibliographies they'd care to share? As an institution, we're beginning 
to discuss this more and more, so if anyone has any recommendations on any

[Videolib] So you want to track down rights to a film? A primer

Basically films come in two classes, 1. films ACTUALLY distributed/opened
in the US. This basically refers to films that opened in a theater in New
York. and 2. foreign films NOT distributed in the US.

For the first group find the New York Times review, it will list the
distributor , google them. If they still exist but say they no longer have
the rights, you must politely but firmly ask them to look in their records
for contact info. Trust me they have it in 99% of the cases. If the
original distributor no longer exists see if you can find what happened to
their assets and/or try the suggestion below for films not distributed in
the US.

OK for films NOT distributed in the US, go to the original VARIETY review,
it will list one or more production companies. Films never distributed in
the US are likely to be expensive and difficult and may simply not be
available.

Keep in mind that about 99% of US feature films are under copyright and
under the terms of GATT virtually 100% of non US films from countries who
are signatories ( most of Europe, Japan  Latin America as far as I know)
are protected. Just because you can not locate the rights holder does not
mean the film does not have one. Honestly if you want to spend the money
there are folks who can locate the rights holder for almost any film but
between their fee and what the rights holder might want it is rarely worth
the effort,however it is important to keep in mind that almost all films
made after 1923 are copyrighted in the US and have an owner.

We've had a request to purchase Battlefield: The Battle of Normandy: Prelude to 
Battle and ...The Battle in DVD. The original VHS were produced by La Mancha 
Productions; a co-production with PolyGram Video International and were 
originally distributed by Time Life Video. Does anyone know if these have been 
released on DVD? Or are they extinct?

Hi, all,

I'm going to be participating in a community Green Festival - many booths of 
vendors/organizations promoting Green Living.  Could I take a laptop and run a 
couple of subject oriented DVDs to show examples of what we have?  They would 
run for the whole program - about 5 hours.  I also have  a powerpoint 
presentation from last year that I can run on a continuous loop, but I thought 
the DVDs would create a little more interest in our booth.  If I need PPR, I 
just won't do it.  Thanks.

Well, maybe you could bring in a couple of table lamps, a nice area rug,
and comfy couch and call it home video viewing...

Strictly speaking, what you're proposing doing constitutes public
performance, and therefor requires rights. On the other hand, depends on
how risk-averse you are and what it is that you're thinking of screening. 
If it's Bullfrog or Video Project or another indie distributor, I'd bet a
nice courtesy call would get you an OK.  Again, if you're feeling frisky,
you might just go ahead and do it (unless it's a Disney film). Seems like
the risk of mad dog litigation is pretty small.

I don't think you need to show the entire of each program you have. I don't 
think you need PPR if you show a few minutes of each program, say 3 to 5 
minutes. You may even receive a thank you note from the publishers for the free 
advertisement of their products. Am I wrong?

It does not qualify for  classroom exemption but depending on what films
you wanted to show you might contact the rights holders and ask for their
permission.
Some may think it is good to spread the word and if the title is available
for individual purchase some might do in exchange for your providing
contact info for that.

I've received permission for public showings of copyrighted titles a few times 
in the past from folks I did not expect to say yes. I found it very helpful to 
volunteer to post Used by permission of... notices on site and to offer to 
disseminate to potential customers relevant fliers that the company might want 
to send.

Just wanted to reassure everyone that DVD titles purchased from Bullfrog Films 
include PPR.  A library may screen the program in public or in a community 
setting, so long as no admission is charged
for the film itself.  For the Green Festival, Bullfrog Films would be happy to

Strictly speaking, what you're proposing doing constitutes public performance, 
and therefor requires rights. On the other hand, depends on how risk-averse you 
are and what it is that you're thinking of screening. 
If it's Bullfrog or Video Project or another indie distributor, I'd bet a nice 
courtesy call would get you an OK.  Again, if you're feeling frisky, you might 
just go ahead and do it (unless it's a Disney film). Seems like the risk of mad 
dog litigation is pretty small.

Deg I don't want to shoot you but let's just say it would be Daffy to
take  a document endorsed by librarians that claims it is perfectly legal
to stream an entire film if the subject matter is the one being taught in
the course ( the absurd John Ford example) over literally a century of
court rulings including Friday's from a Federal Court which stated
unequally that 10% was the maximum that would qualify as fair use( and
don't get me started on how one can claim that the face to face exemption
which is one of few VERY detailed copyright exemptions can be used to claim
something it explicitly does not unless Starbucks is now a classroom and
your barista is your instructor).  I love librarians but on legal issues I
think I will go with the court rulings.

To be fair to one and all, I think that all prior studies and reports will
now have to be reconsidered or ammended to take in account the Georgia
State decision which does have some positive aspects for the librarians.
We've all discussed how the vague guidelines for fair use can be and how we
all needed a court decision to clarify and define the laws. And for now,
the 10% is the new guideline -- though any appeal would most likely change
that for better or worse.

As a distributor, I've always been uncomfortable with clips of my films on
the internet longer than five minutes, but I could live with 10% for
educational use.

The Georgia State ruling merely reinforces what has always been true about
fair use that it is for using the smallest possible portion of a work to
create a new one. I am sadly not expecting ARCL, VRA EFF or others to
suddenly admit oh I guess we were wrong about using an entire work. I would
even point out that the the ruling emphasized that since the works involved
where all non fiction and aimed at the educational market they got more
leeway. I have no problem with 10% but it is likely that would actually be
too much for standard fiction feature film .
