[Videolib] Halsted Street on folkstreams.net

Does anyone have experience with this provider?  We'd like to use the streamed 
Halsted Street USA film for classroom viewing.  Their rights page says to ask 
for permission for classroom use but the contact page doesn't seem to work.  My 
question, however,  is whether or not we are within our educational fair use 
rights to stream the film anyway.  It does grant home viewing rights.

No they are just a slick bootlegger /pirate site. Basically when you have 
feature film that is "only" available from a site like this , it is a illegal 
copy. Their own wording is bizarre claiming most of the films are in the Public 
Domain ( they are NOT) or provided by "inside studio sources"
As for THE GLASS MENAGERIE it had long fallen out of distribution along with a 
collection of films originally distributed by Cineplex Odeon.  Sadly there tens 
of thousands of films that simply are either out of release or never been in 
release ( actually probably hundreds  of thousands).

I think what faculty and librarians have trouble with is that a complete 
legally purchased film can be shown in class but for the exact same class and 
using the exact same film to be shown in a distance class, we have to pay 
significantly more licensing/access and do not even own the film.  So 
transformative fair use is sort of a work around.I agree though, it may not 
be justifiable in court.

All,

110(4) is a great (and under-appreciated) bit of law, but why would it apply to 
audiovisual works when it doesn’t specifically mention them?  Are documentary 
films really both literary and audiovisual works?

My problem with things like this and the you can stream any feature film 
released in theaters without permission/license claim/theory is that all  these 
"theories" some  from the same exact voices in the same echo chamber. IF 
institutions actually believed this was legal, then they should state so 
publically on their web sites and/or inform rights holders particularly major 
studios, foreign distributors etc in writing. The dirty little secret is that  
a lot of illegal streaming and showing does go on but rights holders are in the 
dark and have no way to legally challenge it. Now I don't actually expect a 
school to send a letter to Disney saying "We are streaming FANTASIA" to our 500 
intro to animation students and we don't believe we need to pay you or get your 
permission" but it would be interesting if they did and might actually result 
in  the kind of legal clarity people say they want.. What I would like is for 
there to be more balance in the voices,sources that the educational community 
solicits for opinions. Is it really that much to ask for the many, many 
webinars, seminars etc,  to invite a legal representive from a studio, 
filmmaker or similar to participate?

The argument goes something like:  if the copy is transformative, that is, 
transformed from original purpose for (non-profit) educational use and that the 
entire work is required to meet the educational learning objectives, then it is 
fair use.

You digitize and post an entire book on campus system. This is exactly what GSU 
did  BEFORE they were sued and then they took them down and  cut back to 
"chapters" or sections of books. This would again be the exactly the same as 
digitizing and streaming a film. You are taking an ENTIRE work digitizing it 
and putting up for many to access without paying for rights. Even the current 
GSU decision ( which did not go over well with the appeals court but no ruling 
has been issued) made it clear that you could not use entire works and they did 
in fact rule that 3 of the "portions" GSU did use probably violated "fair use" 
and sent them back ( though this is on hold because of the appeal).

Can anyone explain to me how it is illegal to digitize and post an entire book 
but legal to digitize and post an entire  film? When I asked this at ALA of one 
of the chief proponents I was told " that was an interesting question"

Personally I think it is part and parcel of the contempt that media works are 
given by libraries and academic institutions. They are somehow less worthy of 
copyright protection just as they are less worthy of targeted collection 
policies, budgets etc. (obviously folks on this list are often the exception 
but I find "AV" being more denigrated than ever before)

the copyright session in which two of the main ALA experts on copyright 
discussed the general issue. Let's just say one of them ( I suspect the other

PBS had two prices for their dvds:  PP and HV

Their statement reads:  Videos with limited public performance rights may be 
shown in a classroom screened by a public group that is not charged for the 
viewing, or transmitted on a closed circuit system within a building or on a 
single campus.  Videos with home rights may be viewed only in a home or in a 
face to face classroom situation as part of a systematic educational program.

I know this has been gone over before, but why would one buy the PP version if 
only using in class – just in case one wanted to show in a theater setting?

More problematic is the ripping of segments or whole film for LMS remote 
viewing by students which is a fair use discussion we’ve gone over ad nauseum….

Hark. It ends withsort of a cook off to the death between the good chef and the 
bad chef, basically like Samurai film with food. An earlier scene involving a 
petty criminal who becomes a chef to be with girlfriend and ends up wrestling a 
giant fish in the kitchen makes me laugh just thinking of it.
