Hi Emmanuel, As Apollo and others have expressed, it would be nice to double check the accuracy of the information on the official opening time for public offices and banks in Uganda, if possible. Some of us have not been in Uganda for a while, and may not be in touch with some policy changes. Where an error has been made it does no harm to correct them so that people can receive reliable information. Thanks. Hopefully lessons can be learnt from the process, both by lawyers and non-lawyers. LORD MAYOR ARGUMENTS: We start with the Lord Mayor's arguments; 1. INJUNCTION: An injunction is merely a court order stopping a certain act from taking place. In this case, an Interim injunction was obtained from the Registrar of the High Court. Now, there are 3 types of injunctions, a) Permanent Injunction, which is issues after the trial, b) Temporary Injunction, which is issued to last as long as the trial, c) Interim Injunction, which is issued chap chap, in this case it was issued at 8:30am as a matter of urgency to prevent the Council meeting from going on at 9am pending the court process due to start at 10am to entertain another injunction hearing. This was a very bright move by the Lord mayor's lawyers and kudos to them for their quick thinking. 2. SERVICE OF THE COURT ORDER: Now to the controversial part, the service. Now, when an Injunction is got, it is supposed to be served to the other party. Service simply means delivering the order following the RIGHT PROCEDURE as prescribed by court. In this case, the order was taken to City Hall, by the Lord Mayor's Lawyers, who were barred from accessing the meeting venue while the meeting was taking place. A Councillor, who was in the meeting, then delivered this document to the chairman of the meeting but the Minister refused to accept. No matter how absurd it might seem, the Councillor was not the right person to Serve/ Deliver that order on the Minister, it should have been served by either the Lord Mayor, or his Lawyers. So legally, as far as the Law is concerned, the order was NOT duly served onto the Minister, who in "ignorance" then proceeded to conduct the meeting. The blame should go to the Police and other persons at the gates of City Hall for refusing to allow the Lord Mayor's Lawyers (in this case acting as officers of the court) from delivering that court order, hence obstructing justice and frustrating delivery of the order, but not to the Minister because legally, the Minister has a solid argument based on his "ignorance" of the existence of the injunction. 3. REMEDY: In the end, the meeting was carried out, and the Lord Mayor impeached. He still has a solid remedy, which is to appeal against that decision within 21 days. Now, if he appeals, then he still remains Lord Mayor for the duration of the appeal, if he fails to appeal or apply for Judicial Review, then elections will have to be carried out. PETITIONER ARGUMENTS: From what transpired yesterday, tough questions were raised by this side too which questions we cannot resolve, but we will endevour to shed some light accordingly because the Media will focus on these arguments for the rest of the year. 1. TIME FOR COURT BUSINESS: Court business officially starts at 9am countrywide, so questions are being raised as to how the Lord Mayor's lawyers managed to obtain a Court document before 9am. Now, if this is true the order was obtained before 9am, then any business conducted before 9am is void. However, courts also do have powers to conduct business longer than usual e.g late into the night. 2. COURT FEES: A court case, hearing etc is null and void if court fees are no

Thanks Emmanuel. Just two things, not from a legal point of view as such. 1. I am in Arua and I know Banks that start business at 8am and even 8:30am. So I do not really understand when you say Bans in Uganda start business at 9:00am. 1. I work for a local Government and I know the Standing Orders indicate 8:00am as official time for commencement of business. Where have you got your 9am from? Acidri Deogratias. Dear Moses and fellow West Nilers, I would like to add my words of congratulations to the ones other colleagues have conveyed regarding the wonderful job you and your team have started. I also want to this golden opportunity to thank all the councilors of Arua District Local Government who, not only unanimously endorsed this initiative, but also overwhelmingly pledged to contribute 10,000/= each towards its success. Although I am not yet a counselor, you can count on my 10,000/ pledge to complement their efforts in this initiative. I am confident that the rest of the District Local Governments in the region will do the same. I am glad to hear that there is already a budget which I am sure was made out of different activities members must have suggested to tackle the challenges we have at hand. Some of us may not have cash, but we ourselves form part of the resources we may need to realize some of the objectives of this project. Kindly share with us what is in the proposal so that we can identify some gaps and find out how we can fill them. I am writing as a son of the soil, an active member of a Civil Society Organization and an academic staff of a University. I am therefore stakeholder in multiple capacities who would like to make my humble contribution to the development of our region. I want us to take the education sector seriously because it appears to be the only tool we will use to fight for our existence as a region in this country. Once again, bravo! and thanks very much. Let us all do what we can to make West Nile a better place, not only for us to live, but also the seventh generation we are expecting to replace us. Dear Friends Please take some time to read this,God bless and take care. A pastor was traveling Last week, he saw an old man, and gave him a lift. While they were going, the old man said; my son, do you know what happened in Heaven last night? The pastor was so terrified and hurriedly parked and asked; Sir, are you sleeping? How did you get the information about Heaven? The Old man said; last night in Heaven God ... became very angry with man and asked the Angels to blow the trumpet. The angels picked up the trumpets and as they were about to blow it Jesus fell down and began to plead in tears. The blood that came out of His hands and body were very fresh. He told God that His death shouldn't be in vain. God couldn't stand the pains of the saint and the wickedness of the evil ones. So He said; "AM GIVING THEM THEIR LAST CHANCE.".Jesus then turned to the angels and told them to move down in their numerous numbers to tell the world that "THE END IS NEAR, JESUS IS COMING VERY SOON". The pastor (sweating and crying) asked; sir, how did you know this?.The OLD MAN replied; I am one of the Angels sent to the World. Please use every medium of communication to send this message. No time to waste, Please! And the old man disappeared. Brethren, this story is real, Christ is coming Soon. Please REPENT. I beg of you. Please pass this message round. Copy and paste it, share it, call, email and text it. PLEASE SAVE A SOUL TODAY. Have done my part, it's now your turn to spread the Gospel. No wealth can be compared to life everlasting in Heaven. Knowing M7, this is basically a start of the next campaign. Starting to buy and impress the impressionable youth who have known no leader but him. Refer to D Kalinaki's article in yesterday's monitor. On the other hand if he is dishing out the cash in sacks, why can't our youth get their share as long as they are prepared to vote really wisely inspite of the inducement? After all it our money. Charles, Reading from the youth in Teso, I personally do not think the so called money the President is giving to the Youth has improved youths situation improve in any way. If the money they dished out to buy the last elections in West Nile ( I understand there were two trailers full of hard cash packed at Barifa) has not improved the lives of people who got the money in West Nile what is really behind the idea of encouraging the Youth from West Nile to go and make noise about money that youths in other regions are fighting over.. What does this kind of behaviour teach the youth? Is this not some behaviour that we should all condone rather than encourage? Hello Caleb, hello westnile leaders... It has become trendy for the president to be throwing sacks of money to youth in other districts causing youth elsewhere to also demand meeting with the president... one wonders when West Nile youth will also start making noise.. so the bones can be thrown ther way while the real meat goes to those closely affiliated.!!! By GODFREY OJORE Youth leaders in Soroti district on Tuesday walked out of a meeting convened by the eastern youth MP Peter Ogwang, rejecting sh20,000 transport refund saying it was too little for them. Ogwang had called the youth councilors in the district to discuss how they could benefit from government programmes like the Northern Uganda Social Action Fund (NUSAF) and the National Agriculture Advisory Services (NAADS) among others. The state minister for Teso affairs Christine Amongin Aporu was to explain to the youth about the programmes and also get their grievances since they had complained to Ogwang that they had not benefited from most government programmes. Besides rejecting the sh20,000 transport refund, the youth also protested the delay by Ogwang and Amongin to arrive at the Lukiiko hall where the meeting was slated to take place. The meeting was scheduled to begin at 3.00pm but both Amongin and Ogwang arrived at the venue at 6:30pm. "Which meeting do you want to begin at 7.00pm? We demand for our refund then call us on another day but now we are not ready to meet you," one of the councilors shouted as the minister watched on at a distance. Ogwang explained that they delayed in Ngora and Serere districts where they were meeting youth leaders on similar issues. Efforts by the Soroti district LC5 chairperson George Michael Egunyu and the resident district commissioner (RDC) Ben Etonu to calm the angry youth fell in deaf ears as they insisted on more on top of sh20,000. Ogwang accepted to top up the refund to sh30,000, which the youth received and left. "The youth have been calling me demanding an explanation towards government programmes but I am disappointed that the very youth have turned rowdy over money," Ogwang said. Amongin explained that the youth in Soroti have also been asking her to connect them to meet the President. "We shall organize another day for Soroti since my programme is to meet all the youth in eastern Uganda," Amongin said after the meeting aborted. ___ WestNileNet mailing list WestNileNet@kym.net http://orion.kym.net/mailman/listinfo/westnilenet WestNileNet is generously hosted by INFOCOM http://www.infocom.co.ug/ The above comments and data are owned by whoever posted them (including attachments if any). This one...! Lesson to All Women/Men A couple was invited to a masked costume Halloween party. The wife got a terrible headache and told her husband to go to the party alone. He, being a devoted husband, protested, but she argued and said she was going to take some aspirin and go to bed, and there was no need for his good time to be spoiled by not going. So he took his Batman costume (mask) and away he went. The wife, after sleeping soundly for about an hour, awakened without pain, and, as it was still early, decided to go to the party. In as much as her husband did not know what her costume was, she thought she would have some fun by watching her husband to see how he acted when she was not with him. She put on a Goldilocks costume (mask). So she joined the party and soon spotted her husband enjoying himself on the dance floor, dancing with every nice woman he cuddled and occasionally giving a little kiss here and there. His wife went up to him and being a rather seductive woman herself, his husband left his new partner devoted his time to her. She let him go as far as he wished, naturally, since he was her husband. After some more drinking he finally whispered a little proposition in her ear and she agreed, so off they went to one of the cars and had quick sex in the back seat. She slipped away before unmasking herself or her husband and went home and put her costume (mask) away and got into bed, wondering what kind of explanation he would make up for his outrageous behavior. She was sitting up reading when he came in, so she asked what kind of time he had. "Oh, the same old thing. You know I never have a good time when you're not there." Then she asked, "Did you dance much?" He replied, "I tell you, I never even danced one dance. When I got there, I met Pete, Bill Brown and some other guys, so we went into the spare room and played darts all evening." "You must have looked really silly wearing that Batman costume playing darts all night!" She said with unashamed sarcasm. To which the husband replied, "Actually, I gave my Batman costume to your Dad who seemed to have had a jolly good time on the dance floor. I am told that he was seen by Frank taking a prostitute in a Goldilocks outfit out for a few minutes. Don't ask me what they did; you know your dad still wants to behave like a kid." Moral of the story: Don't try to sneak up on your husband/wife pass it on to all ladies/Men you Know ___ WestNileNet mailing list WestNileNet@kym.net http://orion.kym.net/mailman/listinfo/westnilenet WestNileNet is generously hosted by INFOCOM http://www.infocom.co.ug/ All Archives can be found at http://www.mail-archive.com/westnilenet@kym.net/ The above comments and data are owned by whoever posted them (including attachments if any).
