I just ran an experiment, assigning layer 1 to flute, layer 2 to oboe.
I had the oboe play for 6 bars, panned left using an expression, setting
controller 10 to 0. I had the flute enter at bar 3, panned full right
using an expression. The oboe stayed full left when the flute entered

This is giving me some clues. Opening in Cakewalk showed a couple of tracks
set to pan correctly but the layer two tracks are not.
I have found it very easy to set panning using expressions -- I create
non-printing expressions and set playback for Pan and the appropriate
value. That way I can see exactly where I have placed the expressions
and can change them very easily.
I find this much easier than using the midi tool,
One last thought for tonight:
Do you have an expression assigned to Midi controller 10? This would
override the value just sent.
