There's a fabulous article on the legalities of the US situation by J Nowak (1999) Employer liability for employee online employee acts in Federal Communications Law Journal March 51(2) pp.467-491. Is availableonline but I forget where It's very thorough and sets up a framework for policies and so forth - would have to update the US legislation though cos is a bit old.
