In most states, you can not have a lawyer in small claims court and can only claim actual monetary damages.   My wife and I had to go this route with an insurance company that would not pay off on our car that their client’s tow truck ran over.  (Yes, RAN OVER)   The judge does not expect you to know any legal stuff only to be polite and to have your ducks in a row.  Receipts, Terms of service, other documentation to verify your side of the story.  The clearer and easier to understand, the better.    I won’t presume to advise you, but Small Claims court was a pleasant experience for me.   Kevin B.
