You are Right On Scott. I can tell you as a 30 year Telecommunications Consultant, the last 15 of which were in Washington working closely with the FCC staff on a lot of issues - that the quickest way for us, as "professional" WISPs to shoot ourselves in the foot will be to abuse the rules and this "unlicensed" band. The commission is currently sympathetic to WISPs who are attempting to bring broadband to unserved and under-served areas, however their syspathy will quickly turn to annomosity if the WISPs take advantage of the rules. This is "shared" spectrum and the Commission and Staff are dedicated to their mandate to protect it. As you mention, there is currently a pending Proposed Rule Making which will ease certain restrictions regarding equipment, and there are about 60 days remaining on the Comment and Reply Comment periods - if the Commission gets the impression that WIPS are going to bend the rules and stretch the boundries of band sharing, you'd be surprised at how quickly an easing of the rules can turn into handcuffs. Worse yet, for anyone who is old enough to remember - consider what happened to the now almost abandoned Citizens Band (CB). After the Commission abandoned regulation of that spectrum, the noise floor rose so high and so quickly that the shared band became almost unuseable for anyone.
Yes, the RF output limitation of the APPO occassionally frustrates me, although with proper channel planning, successful WISPs will be looking toward smaller cells not larger ones. I am also occassionally frustrated by the relatively small number of antennas with which the sB units have been type accepted, but I realize that there is a not inconsequential cost associated with submission of a radio/antenna pair for type acceptance, so I live within the family of certified systems and hope that eventually sB will add more options to the list.
