That sounds similar to the clause we have that if they with hold retainage in the amount of 10% it will cost $xxxxx.xx extra (Usually around 5%) for the loss of use and low interest available on escrow accounts. Usually makes retainage go away.

The other issue is architects refusing to give cad files because of liability or whatever (can you say Walmart?). I have a clause in my standard contract that covers both. The dollar value I include is somewhere around the value of my mortgage, so that typically makes things disappear.

The client paid for the design, but not the cost of producing multiple sets of drawings to be sent out to bidders. The small fee that is charged is not
for the design, but for the paper output.

You are right Bob, especially when is a Gov. Job. We are suppose to have a
clause in our contract that states that if we have to pay for drawings it
will be an extra to the contract. So cost of work goes up. Gov has already
paid for it once.
