Generally fees and the method in which they are calculated are provided for by legislation, statute, ordinance or code. Ask the city to cite the statute, code or ordinance. At the same time ask how to appeal their position and be prepared to challenge them. In New Jersey anyone can challenge a code official by filing an appeal to the construction board of appeals. In that arena the code official must prove the citation to an impartial board. The boards ruling is binding on both parties.
I don't know how it works outside the garden state. Hope that helps John Drucker Fire Protection Subcode Official (AHJ) -----Original Message----- From: [EMAIL PROTECTED] [mailto:[EMAIL PROTECTED] On Behalf Of [EMAIL PROTECTED] Sent: Monday, April 21, 2008 3:09 PM To: [email protected] Subject: Re: Determining permit fees on total value What I meant was, what kind of documentation do I take into the city manager that supports my assertion that what the plan checker is requiring is wrong? It is stated on the redondo beach fire department web page: Fees: The fees for plan review are set by contract total. I thought the fees were based on the cost of the materials, not labor, insurance costs, other overhead, etc. -----Original Message----- From: Steve Leyton <[EMAIL PROTECTED]> To: [email protected] Sent: Mon, 21 Apr 2008 11:30 am Subject: RE: Determining permit fees on total value The demand from the fire department for a copy of your contract. If they just TELL you across the counter and refuse to document it, I'd complain about that too. I now have additional information. The city of redonodo beach, ca. is now basing their permit fees on the "total contract value", meaning, cost of install and the profit. They are requiring the customer contract to be submitted with the plans for review and approval. They are currently withholding approved plans and will not release them until they get copies the signed customer contracts. Can anyone offer a swift and definitive way to counter this requirement?
