Yes, as a matter of fact we're doing a small addition to a dorm where the
existing building is designed to 13R for the two wings, 13 for the center
section housing Campus Security's office (incidental use if you stretch a
little), and a daycare (likely NOT for the college students at this ritzy
alma mater, and thus NOT incidental use). They first spec'd 13 for the
center section and I pointed out that the seminar room, living room/lounge,
and common area in the addition were exactly the incidental use 13R
addresses in areas outside the dwelling unit, and they allowed it, although
the responsibility for dealing with the new 3rd party AHJ is mine, as if
he's got 3 eyes and horns. Hey, it's the state code, I understand it, and if
he needs help understanding it, I'll be the first to offer assistance.

So NO this is not correct, and they'd need a horizontal separation equal to
what building separation would need in order to apply two codes. But it
happens a lot more often than it should.

If they resist you pointing out the fact that 13 should apply to the entire
building, maybe point out that using their logic, you could do the top 4
floors of a residential high-rise using 13R?

IF the insist you do it their way, and the AHJ is agreeable, get everyone to
sign a Memo of Understanding and take responsibility for whatever events may
occur (including death) and design it their way.

I know this has been bantered around before, but I am still a little 
confused. I have been asked to quote a building where the 1st floor 
is a church and the upper 2 floors are apartments. The spec calls for 
the 1st floor to be 13 and the upper floors 13R. To me this doesn't 
make sense since 13 is a property standard and 13R is life safety. Is 
there any situation where this is allowed?
