I'd agree that a flexible drop listed for dry systems, or not limited in its listing to wet, installed in a manner that goes up off the line and then down to the sprinkler, will fulfill the intent of the code both in language, intent and actually DO what it is supposed to do.

I believe this scenario is the only reason they're even listed for use in a dry system. You'll need to face your branch outlets up obviously to get the return bend effect. I believe Viking's Flex Head system is listed, but you should check, there are or were 2-3 systems and most people call them all flex heads so you need to be sure the actual system you're using is listed.
