The problem I see here is that the amenity=fountain wiki description is
too restrictive.
Saying that "A fountain for cultural / decorational / recreational
purposes. (...) This might range from the usual fountain that you'll
find in lots of city centers, up to large fountains like the Trevi
Fountain in Rome (...) The water of those fountains is often not
suitable for drinking."

leaves these kinds of fountain in a limbo.
To me amenity=drinking_water should only be used to map simple water
points where people can drink clearly potable water, like bubblers in
parks or free water dispensers in public areas.
Maybe the wiki could be more clear on that, to allow better mapping of
these features.

The first is designed like a Roman or Medieval drinking fountain, so
amenity=drinking_water is appropriate. The second example does not
have water running in the picture, but if it can be used (perhaps
there is a handle which turns on the water?), the same tag would work.

I would also use amenity=drinking_water for the first although if it
wasn’t drinking water I would probably tag it amenity=fountain
(clearly there are decorative elements present, and there isn’t a hard
distinction between fountain and drinking fountain). The second
example seems to be designed for animals as well.

If you have recurring types of fountains you could add a new specific
type to the key fountain page:
