in the example he gave they were separated. Also there is at least the kerb that is separating them (sometimes also grass, parking cars, metal-barriers, ...). It depends on the kind of vehicle you use what you consider a separation (think of wheelchairs). If the pavement is not physically separated at all, but just by a line on the surface I agree with you though.
