When people in one country use servers in another country, the laws affecting those users may not be the same as those affecting the servers themselves. For example, some works are public-domain in Australia, but still in copyright in the USA. So, it is legal for those works to be on the Gutenberg Australia web site, without it being legal for users in the USA to download those works.
