Is it visible publicly legally (either locally or through remote
imagery) ? Is it legal for you to map it, according to the laws of the
country where you are physically ? If the answer to both of these
questions is affirmative, then you are legally entitled to map to your
heart's content.

Then there is the question of being caught accessing or publishing data
that was mapped by someone legally unrestricted in doing so, but whose
possession is illegal in your own country - or might just cause trouble
for yourself, lethal or otherwise.

Let's imagine you are developing a GIS portal for an Israeli government
agency and still want them to do business with you. Then you might not
want your map to feature that military base that was perfectly legally
mapped by an Inuit using publicly available Bing satellite imagery, but
whose pinpointing is frowned upon in Israel - but please do that bit of
self-censorship as part of your own post-production process on your own
copy of the data, not as censorship of the common work.
