3.5 LTS already uses the unregistered numbers in the draft.

I am not disagreeing, but that would be dumb of OpenSSL. If different numbers 
are assigned, then OpenSSL would have to change, and also update their FIPS 
validation.  It would not be the first time someone shipped without waiting for 
the IETF. Good thing the DE’s are unlikely to be petty :)

Consensus is not needed to get IANA assignments. The draft authors could do so 
by making a request as described in 
https://www.ietf.org/archive/id/draft-ietf-tls-rfc8447bis-15.html#name-registration-requests
 I guess anyone could make the request, actually.
