I generally support your point of view in this thread, 
but I think one of your arguments is not correct.

Magnolia 2.1.5 works with the most recent version of jackrabbit without
changing anything in the code. So the reason for being incompatible is
that Magnolia was using the JCR in a special way, which was altered in
version 3. I don't think it was for commercial reasons, but it was a
design decision of the Magnolia team.

If one wanted to blame Magnolia for going commercial, I think the
vanishing of the 'multiple subscribers' option would be a better point.
