It's like that by design and has been that way for a while now. It's obvious why, too: they believe people using that application are using the icon view exclusively and is the reason why the "paste" will always work in that view. The current nautilus design for the list view is, in my opinion, broken. Why? If I can't paste in list view when the list is full, it's broken.
