As said, the situation is different on AppServers. Neither jBoss nor WebLogic complain. IONA's possibly would, but it's abandonned. WebLogic *does* respect the classpath entry of the EJB artifact itself though.
That's not part of this discussion I think. We have discussed EJB problems already. It's of no interest whether JBoss cares for that. There are specifications, and I have to take care of them. For that I need correct Class-Path entries. That's it.
