I've always wondered what the motivation was behind blind people
questioning the legality of services like the Movie Vault from BlindMice
and blindy.tv. Sure if it were obviously illegal, or the blind would
face some retaliation from the movie industry or if the movie industry
itself were actually being harmed, I could understand why blind people
would bring this up, but other than that, I don't see why blind people
would want to see a service that some people enjoy and take advantage of
be declared illegal and cease to exist.
I'm not familiar with blindy.tv, but in the Movie Vault you have MP3
files containing movie sound tracks along with described video. I simply
can't imagine sighted people taking advantage of this and stop going to
theaters or buying DVD's or streaming movies from services like NetFlix.
I'd also be shocked if there were that many blind people who are
listening to these MP3's that would otherwise be buying, renting or
streaming these movies, at least in numbers that would even register at
all on a production company's bottom line. Like I said, I can't imagine
these services are in any way negatively impacting the movie industry.
That being said, I'd be interested to hear from a lawyer who looked into
this issue and could point out which laws are being violated and how the
various laws allowing media to be altered to be accessible do not apply
in these cases. I'm not sayhing blind people should run out and
knowingly break the law by pirating music, videos or applications, but
in issues where it isn't very clear at all, I don't see the point in
this idle speculation.
