I myself have actually turned the tables on MicroSoft when they tried to invoke the DMCA to keep me from selling my used MicroSoft software on Ebay. Yes, Ebay initially pulled my listing but I was able to force them to put it back on, since MicroSoft chose not to sue me (I invited them to). This is covered under the DMCA.
