The purpose of max-width loses if it can't overruled the ems behavior.
It's not a case of max-width overruling ems. Ems is related to font-size which is why it's used for fluid/elastic layouts - it's *supposed* to increase as you increase the text size. If you don't want your layout to expand past a certain fixed size, then you should be using a pixel value, and not ems.
