Hawks probe Malema 'barrel of a gun' comment

The Hawks are investigating charges against EFF leader Julius Malema after
the ANC laid a complaint against him at the Hillbrow police station.

The ANC reported Malema to the police when they heard Malema say in a TV
interview at the weekend that the EFF would replace the government through
the barrel of a gun.

His utterances dominated Parliament yesterday, and were condemned in the
House of Assembly and at two separate briefings held by the ministers of
State Security David Mahlobo and police Minister Nathi Nhleko.

Both appealed separately for the Hawks to be given space to carry out their
investigation.

Charge to follow investigation

Nhleko said at his late afternoon briefing that a case was being
investigated following the lodging of the ANC complaint on Monday.

He could not say what the charge was, he said, because a charge was always
the product of an investigation.

"Let me just say that the matter now is now being investigated by the Hawks.
The reason why the Hawks are investigating the matter is precisely because
there has been a complaint registered with the Hillbrow police station. In
this case we are following through on a complaint that has been brought to
the fore," Nhleko said.

He said freedom of speech was not absolute. "That right is not so absolute
in cases where such utterances have the potential to plunge the country into
chaos."

Ready for the EFF

Of today's Freedom Day celebrations and protests, Nhleko said the police
would not stand by and allow the country's reputation to be tarnished.
Manifesto launches by the ANC, DA and UDM were to take place.

"We are also ready for the EFF launch this weekend." At his briefing,
Mahlobo said it was up to the courts to decide if the Constitution had been
violated.

Mahlobo said of the complaint against Malema: "The law enforcement agencies
must deal with it. And let's allow them to deal with that particular
incident. But our message in the House (when he presented his budget vote)
was to say there are those among us who are reckless, who are not fit (and)
in a position to lead the nation we envisage, whose statements must be
condemned."

The Constitution was clear, he said, that no one was allowed to propagate
for war, incite violence or hatred. He said that was a contravention of the
Constitution.
