I don't have much knowledge of the history of btrfs, but unless Oracle is the sole copyright holder for btrfs (seems unlikely), they will have to distribute any source updates for binaries they distribute.

Depending on how CDDL is written, and depending on if all contributors signed a contract assigning copyrights to Sun, Oracle may be forced to distribute source updates to zfs if it has been 'tainted' by contributions by outside developers.
