Joerg is correct that CDDL code can legally live right alongside the GPLv2 kernel code and run in the same program. It is a "mind set" issue with the Linux developers rather than a legal one.
If ZFS was not tied to a big greedy controlling company then the Linux kernel developers would be more likely to change their mind.
