Dan I believe a citizen can, but the undertaking will be long and 
expensive (otherwise I would do it myself).

You know how these suits work, but for others reading:

You have to gather the facts on paper.  

That means sending subpoenas for records for enrollment records and 
performance records before and after the Commissioner's ruling in 
1996.  Not just Asbury, but the sending Districts too.

Then you'd have to get similar discover from Red Bank Regional.

Certianly then there would be depostions to clear up matters in the 
paper record.

Then you need to get it all to an expert witness to give you a 
report on the facts, and whether in his opinion there resulted 
segregation from the Commissioner's ruling.

Briefs have to be written on the balacing test that weighs the right 
for Blacks to be in a desegregated school and the right of the 
others kids to learn the oboe (obviously I jest, but that would be 
the crux of the legal analysis).

When you prevail, and go through the appeals (another huge process) 
you end up with an order that tells the State to desegregate the 
school.

Then the decision would HAVE to be made as to whether the other kids 
come back or the Asbury kids get split up and go out.

1000 to 1 odds says the political will shall be that we close Asbury 
and send the kids out to many schools.  1000 to 1.

Lot's of money to prosecute that claim, but well worth it.

I like how you are thinking there, but this would take more than the 
$25.00 a pop funderraising that SUFA does.

Since Asbury Park's annual budget is around $80 million and I've 
seen them pay their lawyer as much as $750,000 in 15 months, then 
$500,000 in the next 12 montsh, they can afford it.
