The only time an IP gets added in a "hair-trigger" fashion is when spam hits 
one of its hidden 
spamtraps. Otherwise you are right in that the users can (briefly) abuse the 
system, but even then 
it's hard to do. I think the reputation of over-zealousness is unwarranted, but 
that's just my 
opinion.

My experience is that only the the most onerous and prolific spammers routinely 
hit more than one 
list. I have tried using more lists and setting MAXHITS higher and am not happy 
with the results 
on my servers that have little in the way of commercial-type incoming email. 
Now on my 
LISTSERV machine that runs multiple lists, I have a real problem if I don't up 
the MAXHITS. The 
number of legitimate mail that would be blocked because of the way that large 
providers manage 
to get blocked for various reasons would be a real issue.
